Please see attached documents supporting this claimPlease note: This is the first correspondence I have knowingly received and have not received anything by U.S Postal mail service. Also, My attached response is the exact response used when [redacted] filed through: [redacted] * [redacted] [redacted] [redacted] [redacted] [redacted] [redacted] This complaint was investigated thoroughly through this office in 07/01/and [redacted] was advised to not pursue this and the matter went in My favor. If you have any further needs, questions or concerns please don't hesitate to ask.Thanking you in advance for your time,Sincerely,B.W.H General ContractingByron H [redacted] Investigator: Revdex.com11/26/2014B.W.H General Contracting did receive a complaint notice via e-mail with reference to the above matter with a postmark date of: 11/26/ and this was the first correspondence I have received as it states I have been contacted several timesIn response to the complaint filed there has been prior discussions about this manner in April, and the job was performed on December through January I have also been notified that pages of e-mails and pictures were submitted as I too have these e-mails/pictures and at this time do not want to inundate this matter with more e-mails and picturesIt is a fact that I, B.W.H General Contracting; did a partial kitchen modification as per request of [redacted] on a “Pay for Performance” basis meaning that no monies were appropriated during the time of work as I took all of the risk by performing the requested kitchen modification work and would only get paid as the work was completed to the satisfaction of [redacted] through her daily inspections of the work performed; then by releasing that portion of the labor monies earnedThis is a very fair “risk free” contract to the homeowner ensuring that the work gets completed and meets their satisfaction before having to pay the contractor any monies before the work is completedOnce the work is completed and is inspected by the homeowner and is of satisfactory standards then monies are released on that portion of the work and goes on until the last task is performed, inspected by the homeowner and then releasing final payment completing the contract upon final overall satisfaction of the complete jobBefore final payment is paid it is the duty of the homeowner to express any concerns about the overall job and hold the General Contractor to those obligations until the job is completed to their satisfaction. The invoice that was submitted was correct and shows multiple small labor payments and the materials purchased overall as well as the cabinets purchasedAlso, the invoice is dated January 1’st while showing multiple small labor payments and it does show final payment and terminates the contract at the date of January 1’st with [redacted] approval upon final payment and receipt. At this juncture the rest is speculation and subjective on my partBase Line 1) Of [redacted] complaint states dissatisfaction of the cabinets that make up the island which was the first project completed; purchase cabinets and set them so she can get Granite installed in her kitchenThere were no issues at the time of installation and a countertop was installed made of Granite stone and carries much weight and must be properly installed or it will cause separations in any cabinet due to the weight during the installation process [redacted] passed the installation on my part of the cabinets and paid after this portion of the project was done as per agreement and upon her satisfaction.NOTE: At this time it needs to be understood that the complete kitchen project was not performed by B.W.H General Contracting and there were to be: A professional installation of Granite/Counter-top that was the choosing of [redacted] Granite countertops are made of stone and are a specialty product and must be installed by Granite/stone professional [redacted] needs to forward the name and company information of all parties who took part in this kitchen remodel and that should include: The Granite professional and the type of counter-top installed, the Master/licensed plumber who is responsible to install the final plumbing and perform all plumbing test and inspections and finally, a Master electrician who also does the final electrical work and aslo performs an electrical test ensuring proper and tested electrical functions.B.W.H General Contracting operated as the initial carpenter re-routing an existing kitchen utilizing all existing functions of the current kitchenMoreover, It was clear that [redacted] was to have a final plumbing performed, a final electric performed as B.W.H General Contracting explicitly shows that all hook-ups are temporary so she can function until the Granite countertops get installed which includes: the new countertops with a brand new sink which a Master plumber has to install and run plumbing test ensuring that all is correctMoreover, the stove and dishwasher were also a part of the final project to be performed as they were re-routed and temporarily set in place ready for the final hoas they need to be set in final place for the new Granite countertops to be installedAs a result, B.W.H General Contracting is only responsible for a “rough in” stage of this existing kitchen modification which fixtures were relocated and temporary hook-ups were performed and there were no issues that were not resolved at the time of the work performedMost of [redacted] complaints pertain to electric and plumbing and if there were any plumbing issues that would cause any damage that would of occurred immediately during my time of workMoreover, [redacted] had the Granite installation person remove the temporary countertop and sink which has; the garbage disposal, sink and dishwasher all hooked up together and this was done in January after my job was completedI was not a part of this kitchen final remodeling stage and therefore cannot be held responsibleIt is [redacted] ’ responsibility to supply the information as to who she had install the countertops, the final plumbing, the final electric and the final installation of the kitchen arrangements of the fixtures such as the: cabinets, sink, stove and their counterparts along with the plumbing and the electric. At this time I have previously asked [redacted] to produce her licensed plumber, electrician and the company who installed the granite upon the final stages of this kitchen projectShe claims damages occurred in March (to my knowledge) and I asked for her certifications as well as actual proof of these damages and any supporting information relating to my work in January, approximately months prior to her claim of having a plumbing issue/flooding of her basementWho removed the sink, dishwasher, garbage disposal and re-ran these water supply lines as well as hooking up the drains and where is that contract, company information and certification? Did she get License and inspection in [redacted] to inspect the plumbing? Who was the final electrician and was that inspected and their certifications and insurance information? Who was the granite company who installed the granite on the kitchen and appears to have interrupted the “Brand new” cabinets for the island that [redacted] approved upon my placement of empty cabinetsWhere is the insurance information of the Granite Company?Too date: [redacted] contends that I showed her my license and insurance information showing that I am a certified, registered licensed professional who has insuranceI believe that [redacted] did not follow the proper chain of professionalism and whatever she is claiming that went wrong she is going back to the one person who is licensed and insured and that is B.W.H General Contracting leaving her stranded because she cannot make a claim elsewhereThis is fraud and her claim is fraudulent and is in no way supported by any factual information and again, she needs to produce the other parties who were responsible to finish this kitchen and their credentials as well as proof of work/contracts and inspection process through the proper parties of inspections in her townshipRecords need to be produced and verifiedThis matter has been forwarded to my insurance company at that time: [redacted] insurance for a possible fraudulent claim as they have already informed me that any action taken this will go to the fraud department immediately. Please evaluate this carefully and thank you in advance for your time in this matter: [redacted] Please inform me immediately if you need any further information and please terminate this claim as you see fitFraudulent claims are a serious matter and [redacted] needs to understand that this is being seen and treated as to what it is if this complaint moves forward, fraud.Thank you Revdex.com,Sincerely,B.W.H General Contracting – Byron H [redacted] – [redacted]

I am rejecting this response because:
First of all, you do not need to know who fixed your work You were hired to do the work originally If you were not capable of doing the job you should have said so You wanted the money upfront You were paid for new material, labor totalling $and $for the new cabinet that you assembled and fell apart The contractors you are referring to are the ones I hired to correct/fix your work If you have forgotten what you have done and considered professional see the attached pictures This is just an example of what you call professional work I have spent money fixing your mistakes At this point in time I am requesting you reimburse me the money I paid you

I have also been notified that 18 pages of e-mails and 25 pictures were submitted as I too have these e-mails/pictures and at this time do not want to inundate this matter with more e-mails and pictures. It is a fact that I, B.W.H General Contracting; did a partial kitchen modification as per request of [redacted] on a “Pay for Performance” basis meaning that no monies were appropriated during the time of work as I took all of the risk by performing the requested kitchen modification work and would only get paid as the work was completed to the satisfaction of [redacted] through her daily inspections of the work performed; then by releasing that portion of the labor monies earned. Also, the invoice is dated January 1’st 2014 while showing multiple small labor payments and it does show final payment and terminates the contract at the date of January 1’st 2014 with [redacted] approval upon final payment and receipt. At this juncture the rest is speculation and subjective on my partBase Line 1) Of [redacted] complaint states dissatisfaction of the 2 cabinets that make up the island which was the first project completed; purchase 2 cabinets and set them so she can get Granite installed in her kitchen. There were no issues at the time of installation and a countertop was installed made of Granite stone and carries much weight and must be properly installed or it will cause separations in any cabinet due to the weight during the installation process. [redacted] passed the installation on my part of the 2 cabinets and paid after this portion of the project was done as per agreement and upon her satisfaction.NOTE: At this time it needs to be understood that the complete kitchen project was not performed by B.W.H General Contracting and there were to be: A professional installation of Granite/Counter-top that was the choosing of [redacted]. Granite countertops are made of stone and are a specialty product and must be installed by Granite/stone professional. [redacted] needs to forward the name and company information of all parties who took part in this kitchen remodel and that should include: The Granite professional and the type of counter-top installed, the Master/licensed plumber who is responsible to install the final plumbing and perform all plumbing test and inspections and finally, a Master electrician who also does the final electrical work and aslo performs an electrical test ensuring proper and tested electrical functions.B.W.H General Contracting operated as the initial carpenter re-routing an existing kitchen utilizing all existing functions of the current kitchen. Moreover, It was clear that [redacted] was to have a final plumbing performed, a final electric performed as B.W.H General Contracting explicitly shows that all hook-ups are temporary so she can function until the Granite countertops get installed which includes: the new countertops with a brand new sink which a Master plumber has to install and run plumbing test ensuring that all is correct. Moreover, the stove and dishwasher were also a part of the final project to be performed as they were re-routed and temporarily set in place ready for the final hook-up as they need to be set in final place for the new Granite countertops to be installed. As a result, B.W.H General Contracting is only responsible for a “rough in” stage of this existing kitchen modification which fixtures were relocated and temporary hook-ups were performed and there were no issues that were not resolved at the time of the work performed. Most of [redacted] complaints pertain to electric and plumbing and if there were any plumbing issues that would cause any damage that would of occurred immediately during my time of work. Moreover, [redacted] had the Granite installation person remove the temporary countertop and sink which has; the garbage disposal, sink and dishwasher all hooked up together and this was done in January after my job was completed. She claims damages occurred in March 2014 (to my knowledge) and I asked for her certifications as well as actual proof of these damages and any supporting information relating to my work in January, 2104 approximately 3 months prior to her claim of having a plumbing issue/flooding of her basement. Who removed the sink, dishwasher, garbage disposal and re-ran these water supply lines as well as hooking up the drains and where is that contract, company information and certification? Did she get License and inspection in [redacted] to inspect the plumbing? Who was the final electrician and was that inspected and their certifications and insurance information? Who was the granite company who installed the granite on the kitchen and appears to have interrupted the “Brand new” cabinets for the island that [redacted] approved upon my placement of empty cabinets. Where is the insurance information of the Granite Company?Too date: [redacted] contends that I showed her my license and insurance information showing that I am a certified, registered licensed professional who has insurance. I believe that [redacted] did not follow the proper chain of professionalism and whatever she is claiming that went wrong she is going back to the one person who is licensed and insured and that is B.W.H General Contracting leaving her stranded because she cannot make a claim elsewhere. This is fraud and her claim is fraudulent and is in no way supported by any factual information and again, she needs to produce the other parties who were responsible to finish this kitchen and their credentials as well as proof of work/contracts and inspection process through the proper parties of inspections in her township. Records need to be produced and verified. This matter has been forwarded to my insurance company at that time: [redacted] insurance for a possible fraudulent claim as they have already informed me that any action taken this will go to the fraud department immediately. Please evaluate this carefully and thank you in advance for your time in this matter: [redacted].
