I received a copy of a complaint to Revdex.com dated June 2, for case # XXXXXXXXThis complaint states I am a scam artist because I charged a rental application fee, did not return phone calls to the applicant and then rented the house applied
for to another applicant allegedly days after the complainant/ applicant submitted his applicationComplainant also contends in this complaint that I could not have done a back ground check in that short amount of time and therefore he should refund the application fee
I am a licensed Real Estate Broker and received complainant's application to rent and charged $(per adult) fee to cover processing costsI don't recall whether or not I tried to contact him prior to the rental decision, but know we did not speak directly before the house was rented to another applicantIn this regard, most Landlords whose policies I'm familiar with don't notify applicants of a rental decision until a lease is signed, move in monies are paid and/or keys are given out or the rental property is taken off the marketOnce a decision has been reached and is final, I attempt to notify applicants of results within hoursIn the case of this complainant he supposedly learned the house had been rented to another applicant less than hours afterward but before I could notify himThough I regret not being able to notify him of the decision as soon as he would have liked, this does not mean I'm a scam artist
This complainant and/co-applicant knew or should have known, my application fees are not refundable as stated on back of the rental application he signedLike most rental agents, I charge fees to all rental applicants is to compensate for time and expense for reviewing, evaluating, copying, forwarding, summarizing and verifying the applicants information for my Landlord clientsThey are not just for a "back ground check"I contacted Complainant's Landlord and searched online court records for evictions and criminal history and this was done soon after receiving the application fee and long before any rental decision was madeThe complainant's assertion that I could not have done all this in a day time period is nothing short of ludicrousI made no promises to him that were not fulfilled, did not misrepresent the application process at anytime and have broken no lawsWhile I understand him being a bit frustrated with not getting return phone calls during the rental process, it is my contention he filed his Revdex.com complaint out of spite, unreasonable suspicion and/or ignoranceHe has not offered one shred of evidence I did anything unethical or improper and there is no basis whatsoever for this complaint or for a refund of the application fee
