I accepted the terms of Bob [redacted] keeping my $and giving me $backThe car was a lemon and needed well over $1,worth of repairs to fix it - immediate repairsI wanted out of the contract because I did not want to pay him another thousand for the sale of the Buick Rendezvous and then have it sit in my driveway until I could come up with all this money for repairsIt's a pile of junkNo wonder when I said I only had $1,saved and he wanted $1,for it he said, "Well that's almost the sale price." And I was thinking no, that's $less than what he wantedAnyway the morning before I was coming out to make my final decision he called me and told me he would sell it to me for $1,all tax and fees includedI should have realized then that something was upHe told me a couple of times that day that he would be taking a loss on that vehicle I would take a loss on that Buick Rendezvous too if I was him just to sell it quick and get it off the lot before anyone realized how bad a shape it was in I asked him if he would take the $from the $I had gave him, keep it, and give me my $backHe said he would think about itThat was a SaturdayI called him back on Monday and he said he would take $that's 20% of the price of the car The money was suppose to only hold the car - not to be used as a deposit on the carBut he wrote up the contract that dayI knew I was totally screwed because I had signed that contract I am glad to be out of the dealI did get a receipt saying the sale of the Buick Rendezvous is NULL and VOID I won't be returning to him as a dealer because of how horrible of shape that one vehicle was in and another one I test drove had major steering problemsYou at least would think you would get a car that works when you buy oneHis lot should say FIXER UPPERS FOR SALE If he tries anything sneaky in the future with the contract he said he would shred - which he didn'tI will be reopening this caseHopefully he is happy with his $dollars and will forever leave me alone Now he's on the list with one other dealer in town that none of us who buy used cars will ever go toCan't trust neither of them to sell you something that won't be a piece of junk Thank you Revdex.com for listening to my complaint and getting a response out of Bob ***I ended up resolving the situation myself as best I knew how

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
The company's response does not address the fact that they cashed our deposit check knowing that they would not be able to meet our often-repeated timeline By doing so, they eliminated our ability to contact another contractor in a reasonable time frame Other potential customers should be aware of that possibility with this company
Regards,
*** ***

I have not received any moneys from this company yet. And why would they not tell us that they could not complete our job in the time frame we needed? They must have known when they cashed our check. We might have had time to contact another fencing company had we known
Regards,
*** ***

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me.

Initial Business Response /* (1000, 9, 2015/08/12) */
Received voicemail from owner, stating that deposit was indicated as non-refundable in contract, but dealer opted to refund half of deposit on a goodwill basis
Initial Consumer Rebuttal /* (2000, 11, 2015/08/17) */
(The consumer indicated
he/she ACCEPTED the response from the business.)
I accepted the terms of Bob *** keeping my $and giving me $backThe car was a lemon and needed well over $1,worth of repairs to fix it - immediate repairsI wanted out of the contract because I did not want to pay him another thousand for the sale of the Buick Rendezvous and then have it sit in my driveway until I could come up with all this money for repairsIt's a pile of junkNo wonder when I said I only had $1,saved and he wanted $1,for it he said, "Well that's almost the sale price." And I was thinking no, that's $less than what he wantedAnyway the morning before I was coming out to make my final decision he called me and told me he would sell it to me for $1,all tax and fees includedI should have realized then that something was upHe told me a couple of times that day that he would be taking a loss on that vehicle
I would take a loss on that Buick Rendezvous too if I was him just to sell it quick and get it off the lot before anyone realized how bad a shape it was in
I asked him if he would take the $from the $I had gave him, keep it, and give me my $backHe said he would think about itThat was a SaturdayI called him back on Monday and he said he would take $that's 20% of the price of the car
The money was suppose to only hold the car - not to be used as a deposit on the carBut he wrote up the contract that dayI knew I was totally screwed because I had signed that contract
I am glad to be out of the dealI did get a receipt saying the sale of the Buick Rendezvous is NULL and VOID
I won't be returning to him as a dealer because of how horrible of shape that one vehicle was in and another one I test drove had major steering problemsYou at least would think you would get a car that works when you buy oneHis lot should say FIXER UPPERS FOR SALE
If he tries anything sneaky in the future with the contract he said he would shred - which he didn'tI will be reopening this caseHopefully he is happy with his $dollars and will forever leave me alone
Now he's on the list with one other dealer in town that none of us who buy used cars will ever go toCan't trust neither of them to sell you something that won't be a piece of junk
Thank you Revdex.com for listening to my complaint and getting a response out of Bob ***I ended up resolving the situation myself as best I knew how

Our intentions are not to be deceptive. Our policy is to perform the jobs in the order that we receive the deposits. Our estimator was at their property on April 27th to give an estimate. At that time our backlog was weeks. We received the signed contract and deposit on May
20th. Our job ledger shows that contracts came in between the time of the estimate and the time we received their contract. When contacted by the customer with their time frame issues we returned their deposit in full as per their request

On July 2, 2015, Bruce *** from our office stopped at Mr ***s home to inspect the fence. He found the toprail to be defective in two areas. The following day he spoke with Mr *** and asked him if he had his copy of the warranty, he said he did not think so, our contract
states that the warranty is in effect for months from the time of installation. The manufactures warranty covers the material onlyI will happy to take a look at the fence on his property and supply the material needed if I find it defective and install it if he is willing to pay the cost of the labor needed. I will not put any profit on the labor cost. I would also like to see his copy of the contract. As for the 3-follow up calls, no one in the office is aware of them

North American Fencing was at Mr***s home on April 30th to measure and give him a price to install a chain link fence, at this time he was told the backlog was about four weeks and we do the projects in the order we receive the down payments. We received his down payment on June 3, 2015,
one month later than when we were at his home. During this month the backlog has grown to six or seven weeks. Due to the amount of rain we had in June and July it has been difficult to keep up with this scheduleWe called Mr *** today at 9:A.Mto schedule his project, no answer, had to leave a message on his phone. We are trying to schedule for this Friday, July 31stWe are very sorry for the delay, but we do not control the weather, we are doing our best, our installer are working fifty hour plus to get all the work done as quick as we can

The refund was mailed the day the customer requested the refund which was 6-16-15. The check was cashed by *** *** on 6-22-
