March 15, regarding a Ford Flex (“Collateral”) financed by borrower *** *** *** Credit Union (“Lender”) is insured by *** *** Property and Casualty Company (“*** ***”) under a collateral protection insurance policyAllied Solutions (“Allied”) serves as the claims administrator for *** ***. The Lender filed a secretion claim under their collateral protection insurance policy on November 7, because the borrower, *** ***, failed to make the required loan payments and failed to maintain comprehensive and collision coverage on the Collateral as required by his loan agreement with the LenderIn exchange for the claim payment of the actual cash value of the Collateral to the Lender, the Lender released its lien on the collateral and appointed *** *** as attorney-in-fact for duplicate title, allowing *** *** to repossess and liquidate the Collateral and retain the sales proceeds up to the amount of the claim payment. On March 13, 2018, *** *** requested and Allied, on behalf of *** ***, sent a Guarantee Of Release and Assignment of Title (“Letter of Guarantee”) detailing the amount necessary for Allied to release the title to the Collateral to *** ***In order for the title to be released, *** *** must pay the amount of the claim payment paid to the Lender plus reasonable collection expenses*** *** has not made payment and continues to hide the Collateral despite the fact Allied has the right to repossess the Collateral. *** ***’s allegation that he “refinanced” the Collateral with the Lender is not accurate. Regarding this issue, the Lender sent the following correspondence to Allied: “We [Lender] set up a workout loan for the deficiency balance that he owed to us after the secretion claim was paidI explained to him [*** ***] what he was paying us for and gave him a number to call to discuss the balance that he owes to Allied.” *** *** should contact Allied to make payment for the title to the Collateral.
