Initial Business Response / [redacted] (1000, 8, 2016/10/13) */ Re: Case #XXXXXXXX, [redacted] E***, Apt [redacted] Bobtail Woods Apartments To Whom It May Concern, We are in receipt of your Letter dated September 19, regarding a complaint made by a [redacted] ***, a current resident of Bobtail Woods Apartments, about the smell of cat odors from the Apartment below her (Apartment [redacted] also located at Bobtail Woods Apartments, Peru, IN XXXXX, The Apartments were constructed with lightweight concrete floors on top of plywood separating the upstairs and downstairs apartmentsAccess to the upstairs Apartments is by open stairwell The person below Ms [redacted] had previously requested and was granted a Special Needs accommodation to allow this cat as a companion animal The resident below Ms [redacted] has since vacated the Apartments (9-30-2016) and it is in process of being cleaned up and the carpets will also be professionally cleaned when finished MsDukes current Lease Agreement, has a clause on page 9, item #22, titled Environmental, "Tenant acknowledges that there may exist in, on or about the Premises or in or about the Community, certain materials, substances, plants or other things to which Tenant, Occupants or their guests may have allergies or unusual sensitivity or which may be potentially health affecting ("Health Risks")Tenant hereby assumes any and all risks involved or associated therewith and shall indemnify and hold harmless Landlord from any loss, cost or expense, (including attorney's fees and cost of defense) arising out of or in connection with any claim or cause of action brought by or on behalf of Tenant, any occupant or guest, seeking damages for injuries or death resulting from any such Health Risks" We are now of the opinion that since this resident that had lived below Ms [redacted] has now vacated this Apartment, and after being cleaned should eliminate the issues she complained of I feel I have adequately addressed the concerns presented by Ms [redacted] and if you have further comments, please advise [redacted] for Trimac Management, Inc., General Management Agent for Bobtail Woods Apartments, Peru, IN Copy: Project Manager (Tenant file) Initial Consumer Rebuttal / [redacted] (3000, 12, 2016/11/02) */ Consumer contacted our office indicating she has talked to the company, and was advised the carpets will be cleaned, but they have not called the cleaner company yet She indicated her apartment started to smell better, but still smell is under cabinets, breaker box, bathroom and exhaust fanShe alleges has been a slow process, and still wishes the company to clean the carpets soon Final Business Response / [redacted] (4000, 16, 2016/11/16) */ Letter not received until Monday November 14, Carpets in affected unit were not able to be cleaned until flea treatments were completed which has now been done and Carpets fully cleaned as of Thursday November 10,Just a matter of record lightweight concrete separates the upper floor from the lower units, then padding then carpetWe also treated the Apartment with ODOBAN which kills fungus, molds, bacteria and airborne smellsWe do now consider this issue resolved Thank You! The Apartments were constructed with lightweight concrete floors on top of plywood separating the upstairs and downstairs apartments. Access to the upstairs Apartments is by open stairwell.
The person below Ms. [redacted] had previously requested and was granted a Special Needs accommodation to allow this cat as a companion animal.

Ms. Dukes current Lease Agreement, has a clause on page 9, item #22, titled Environmental, "Tenant acknowledges that there may exist in, on or about the Premises or in or about the Community, certain materials, substances, plants or other things to which Tenant, Occupants or their guests may have allergies or unusual sensitivity or which may be potentially health affecting ("Health Risks").
