We have reviewed your complaint and looked over your fileWe understand that there was some confusion as toyour lease datesPlumtree offers fixed lease terms and clearly states on the first page of our lease the dates inwhich your lease begins and endsIn this case your lease
began 12/1/and ended 12/We also require anearly lease termination fee which is stated on the same page of your lease termI have ensured that your initialsand signatures are on the leaseThis does in fact show that you agreed to the lease terms at the time of move in
As you stated in your complaint, "She credited my account the $deposit and $for Novrent since Iturned my keys in earlyHowever, she is charging me this money and still rented the apartment on Decwithnew tenantsThis means she is getting double rent and more for this unit." To clarify this, we are not chargingdouble rentWe stopped charging rent the day you vacated the unitWe then issued you a credit for the prepaidrent and charged the lease break feeA lease break fee does not include rent
As stated in your lease agreement on page #that an early lease termination fee Does Apply(a) If this rentalagreement conssits of a fixed term lease, and Owner/ Agent has not checked the box stating that the EarlyTermination Fee does apply, and Resident fails to fullfil! the term of the lease for any reason, then Owner/Agentshall be entitled to pursue any and all default remedies, including damages, allowed by lawSaid defaultremedies and damge claims shall include, without limitation, a right to procure (i) repamyment of anyconcessions granted to Resident, (ii) any concession given to any replacement Resident as an inducement toprocure said replacement Resident(iii) rent through the end of the day immediately proceding thecommencement of a new tenancy with a new resident or the natural lease expiration date set forth in this Renata!Agreement, whichever is earlier; (iv) any rent losses arising out of re-letting the premises to a replacementResident at a lesser rent rate than that set forth in this rental agreement; and (v) all expenses associated withobtaining a new Resident and re-renting the premises, including, without limitation, all advertising andadministrative expenses
So essentially what i'm trying to relay to you is, the reason we charge a flat rate for a lease break is so one doesnot have to endure what could be an outrageous amount of money for early lease termination.Here are a couple of Jaws that address early lease termination
As stated per law #A landlord may charge a tenant a fee for each occurrence of the following:( e )The abandonment or relinquishment of a dwelling unit during a fixed term tenancy without causeThe feemay not exceed one and one-half times the monthly rent.*As stated in the lease that was signed by all occupants of your unit, we charged l.Sx's the rent.(A)The landlord may not recover unpaid rent for any period of the fixed term tenancy beyond the date that thelandlord knew or reasonably should have known of the abandonment or relinquishment;*We reimbursed you for the portion of prepaid rent you paid for November
As far as the cleaning and maintenance fees that were chargedThese are standard hourly rate charges as statedin your signed lease agreementWe also charge a flat rate for carpet cleaning unless there are other requirementsneeded such as stains, urine, deodorazing and patch work.We are truly sorry about any misunderstandings you had regarding your leaseWe would be happy to sit downwith you and go over these items with you You can contact the Plumtree office to set up an appointment

Complaint: [redacted]I am rejecting this response because: The lease was for one year and technically it was for 13 months. If I would have signed the lease on Nov. 30, then the lease would have expired Nov. 30 the next year; since I signed it one day later you added another full month which should be illegal. The business would not have lost any money if they would have kept the Nov. rent payment since I gave a thirty day notice. The manager had the apartment rented and the tenants moved in on Dec. 1. In this case the business should have kept Nov. rent and returned my deposit to me minus fees. Sincerely,[redacted]
