I purchased a 2008 Pontiac Montana under the understanding that the vehicle has a "clean title and no rust," as this is what was advertised. Once the transaction was done, I took the vehicle to get the safety done and was informed that this was not the issue. The undercarriage is completely broken down. This vehicle was purchased in the middle of winter just after a snow storm. The weather conditions of the day inhibited a thorough inspection of the undercarriage of the vehicle before purchase. I have tried calling and texting Ayo *** and he is refusing to take my calls. I have visited *** (where the transaction was done) numerous times, only to hear that Ayo *** doesn't actually work there but just conducts business out of this location.

Desired Outcome

Refund I would like my money back as I was misinformed. I have been completely *** in the purchase of this vehicle and the actions of the seller have made this very clear.

Hello,
My apologies for just getting back to you. Byron *** purchased my vehicle 2008 Pontiac Montana in ''AS IS '' condition. I was not aware of what the vehicle needed to pass a safety inspection. When he purchased the vehicle in ''AS IS'' state, he took upon himself the responsibility of getting the vehicle repaired to safety standard. Before he bought my vehicle, Byron *** had the opportunity to test drive the car for as long as he wanted to which he did and he said he liked it and was willing to purchase it. After he bought the car he called me a few days later saying he took the car to his mechanic and it needed alot of work to be done. I told him to go ahead and fix it as he already bought the vehicle from me in ''AS IS '' condition and I could not return his money to him based on the contract of the purchase. He kept calling my phone and disturbing me for days until I stopped hearing from him. I have nothing further to say in regards to this purchase as the law is clear in regards to purchasing vehicles from private sale. Thank you.

To explain in further detail, on January 20th, 2020, I visited 607 Jarvis Avenue, Winnipeg, MB R2W 3B3. I arrived at the facility around 3 PM to inquire about the vehicle. Please note that on that specific day, the weather condition prohibited me from doing a thorough inspection of the vehicle. However, I noticed that the heat was not working based on my visuals. I asked Ayo to correct the problem to which he did. Please note that the vehicle was advertised as in full working condition with no known issues with a clean and clear - no rust title. Ayo correcting the heat issue demonstrated that he was in complete agreement that the vehicle was not in full working condition as he had advertised.

On January 22nd, I took the vehicle to*** for testing and service. Upon inspection, *** confirmed that the undercarriage was rotten. I contacted Ayo via text, and he instructed me to take the vehicle to his mechanic,***. Ayo's referred mechanic confirmed as *** did that the undercarriage was rotted. I called and texted Ayo several times with no response.

On Friday, the 24th, I went to Bodel Enterprise to visit Ayo in person about the matter since he was unresponsive to my calls and texts. Upon arriving, I met another customer who advised me that he was there to purchase the same vehicle that I had purchased. I explained that I already had the vehicle in my possession and the issues I had encountered.

There was another employee present when I arrived on Friday, the 24th. I told them I was there to see Ayo about the issue with the car. They called Ayo, and he never showed up. The other potential customer waited for about 45 minutes before leaving as Ayo did not show up.

Hi, I , Racquel *** bought a 2007 Honda Ridgeline (SN ***) on June 1, 2019 to a person name Bishop/Ayo *** of Bodel Enterprise for the amount of $8,750. The vehicle was safetied on May 17,2019. After 4 days of using it, my husband noticed that there's a strange noise coming from the rear passenger side. When he checked it, he saw a crack on a top of shock frame/strut mount. Driver side tail light is also not working. He tried to contact the previous owner but didn't get a response back. He then phoned the mechanic who safetied the vehicle. The mechanic- Nyron *** who I believe is an owner of ***. He told my husband to bring the vehicle at their shop.
June 10-My husband brought the truck at their shop.While the mechanic is lifting the vehicle, the frame on rear driver side collapsed. That's when my husband noticed that the frame was rusted. They hid the rust by putting bondo and lots of undercoat. After the mechanic saw what happened to the frame, he then admits in front of my husband, brother in laws and friend that it shouldn't passed the safety. The mechanic told my husband that he will contact Seth (name of the owner in the inspection certificate) to see who will fix and pay for the damages. The mechanic told my husband to leave the truck so they can fix it and it will be ready by June 13th.
June 13- the truck hasn't been repaired yet. We have advised the mechanic that after he fix the truck we will still bring it to MPI for re-inspection as we just want to ensure that it's done right. He then respond that he needs to check everything if we're going to bring it to MPI. He will contact Seth again to help him fix it.
June 19- my husband & brother in law contacted him and asked if they can see the car but he's at the auction outside of the city. He said it will be ready by June 24th.
June 24- vehicle still not fix. He gave another date -June 28. They told the owner that if its not done on the 28th they will take the vehicle and bring it to MPI.
June 28- my husband & brother-in-law went to the shop only to find out that the only thing that was fixed was the driver side frame that was collapsed on which they were not satisfied. The shock frame/ strut mount still not fix it actually gets worst.The driver side tail light is not working.
July 11 - We brought the vehicle to MPI for re-inspection. After inspection, the inspector told us that vehicle shouldn't been sold and should not passed the inspection as it's not safe to be on the road. vehicle is irreparable as per the MPI inspector. He wrote down the 2 pages of defects.(sheets are included on the documents that have been photocopied yesterday).
July 11 - we contacted both parties Bodel Enterprise (who sold the car to us) and *** but we didn't get a response.
July 23 - I have talked to the mechanic in person and he only said that he's sorry that it happened and he can no longer do anything about it. ***I have also talked to Ayo on the phone he said that can't give the money back. It's the mechanic fault that he safetied it.
I would like to get my money back including the $988 tax that we paid. Total of $9,738 or we will choose from the other vehicles that he is selling as we can no longer use the Ridgeline that he sold to us.

Hi, I Ayo *** of Bodel Enterprise sold my vehicle 2007 Honda Ridgeline to Racquel ***. *** Before I sold the vehicle , I had taken it to my mechanic to get it safetied which he told me he did. after I sold the vehicle, Racquel contacted me and said the car was not properly safetied and they wanted their money back. I told them that I was not a dealer so I could not help them. They took the car back to the mechanic that safetied the vehicle and the mechanic promised to fix the car for them. I was not involved in any way as all I did was to take my car to the mechanic to check the car and fix whatever it needed so I could get a safety and sell my car.. When Racquel contacted me again I told them that if they had any issues they should take it up with the mechanic and not with me ***. All I did was to take my car to the mechanic to get it safety and I was not aware that the car had any further problems. When Racquel contacted me about a refund I told them that I didn't have any money for them *** I also told them that they had a right to go after the mechanic if he didn't do his job properly. Instead they decided to come after me.*** Please I want this rectified.
