Review: I was arrested on March 7th of this year and Body By Scotty was the tow company called to tow my vehical off of [redacted] in Post Falls Idaho at or around 2:35pm after the cops were finished going through it.Within a few days after car was towed I signed a property release form for my girlfriend to retrieve only yet all my personal belongs out of the car. From the first moment my girlfriend contacted Body By Scottys they instructed her that first and for most there was a police hold on the vehical and she would be allowed near the vehical at all release form or not. This went on for a few weeks and I told my girlfriend to contact Post Falls Police department to see if there was a police hold because I believed it to be "Untrue" and when she did contact a deputy and the deputy informed my girlfriend that there was infact no police hold on the vehical and never was and that he had talked to a Lady by the name of [redacted] the president of the company.I spoke with my lady the next day and she said that the lady [redacted] was very rude and told her she herself would go look in the car because there was paperwork that my daughter needed to pass drivers ed and that her birth certificate in the car and needed. The detective on this case that had chatted with Mrs [redacted] said one he would go get the birth certificate and that after speaking with Mrs [redacted] she being my girlfriend could go down and retrieve the belongs.My girlfriends attempted again the next day and the detectective said if she had any problems to contact him and he would get his chef to meet her at Body By Scotty. My girlfriend went and was refused permission yet again after the detective had had contact with Body By Scotty. They told my girlfriend that since I hadnt registered the car in my name that she needed a bill of sale to get into the car. Now Scotty has had the car over 30days giving them ownership of the car and belonging even though they used false accusations to keep the car in their possession keeping my belongs.Desired Settlement: First and for most I know everything that was in the car because I had lived in my car priorie to the arrest. I was a the company to not only pay the replacement of the items that were not returened but allow for time away from work and gas for all the trips that came up empty handed.The total as I see is around $1,500 TO $2,000 DOLLARS. If needed I can and will provide a Complete list of all items not returned and estimated replacement prices. That amount includes time awat from work and gas.

This letter is in response to the complaint written by [redacted] of [redacted], Idaho.

This vehicle was towed per request of the Post Fall Police Department on March 7th 2013 around 4:00 P.M. at the location of [redacted] in Post Falls, Idaho. Upon receiving care, custody and control of the vehicle, under code 49-1803A we are responsible for the vehicle and its contents for the registered owner and/ or legal owner. The Post Falls Police Department Impound Notification Notice and the motor vehicle record stated that the registered owner is a [redacted] and [redacted] of [redacted] Texas and the legal owner is [redacted]t of [redacted] Franklin Tennesee. Because we have care, custody and control, we are obligated to release vehicle and contents only to the registered or legal owner, Mr. [redacted], or his girlfriend, are not the registered owners of this vehicle. Therefore, nothing could be released to them.

As per request of the Post Fall Police Department, we released a birth certificate and keys back to the Post Falls Police Department. Pursuant to code 49-1803A, we completed the process and have obtained the vehicle. At that point, we gave two bags of clothes to Mr. [redacted] from the vehicle. Although the laws regarding the release of vehicles and contents are educational, it is irrelevant due the fact that Mr. [redacted] was never, in fact, a registered owner or legal owner of this vehicle. Additionally, we were never compensated for our services rendered. We will not compensate Mr, [redacted],
