Review: This is a terrible 'contract' type fitness facility to be involved in. Basically when you give them your credit card information they charge it as many times as they want during a billing cycle without notice to the consumer. A regular monthly rate is $32.50 and because after a 6-month account freeze, I was told I had to pay $96.00 to get the problem resolved and also I found out that during the months after the freeze I was being charged $32.50 every month and I had completely stopped going to this fitness facility for nearly 8 months. I don't see how it is right and ok for a business to keep charging a card that does not have the funds available at that time. The charge of $29.00 showed up on my statement 3 times. I tried to quit going and cancel my membership but I was told that a fee would be incurred along with an additional $32.50. I don't see how business being conducted like this is legal and I find it appalling. And when I approached an the owner of the fitness center I was told that's just the way it is and there is nothing she can do about it, and also tried turning it into a profit oppurtunity by telling me that if I did not cancel that I would not have to pay the following months membership rate of $32.50.Desired Settlement: Ultimately I would like to be reimbursed the $29.00 I was charged several times for not having the funds available on my credit card on file with them and not be required to pay a penalty of an extra month of membership ($32.50) that I no longer want to retain. Also, I would like to alert anyone who thinks about joining this fitness center of how their business is conducted. It is a very poor way of treating customers.

Response:

This letter is in response to the above-referred to complaint submitted on September 13, 2013. I am enclosing a copy of his contract (Exhibit A), a copy of his payment history (Exhibit B), a copy of his account on file with our billing company, ASF (Exhibit C), a copy of his “Request To Freeze Form” (Exhibit D) as well as notes that are included in his file regarding his contract and billing issues. As you can see, this member has been a repeated billing issue since July 25, 2013. On August 6, 2013, Mr. [redacted] called BSF to inquire why he was charged, and we explained that there is a difference between freezing and cancelling a membership. When you freeze a contract, the payments are stopped altogether for a period of time specified, and they begin again once that time period has expired. When you cancel, we require 30 days notice (which is clearly written in the contract) and if there are no monies due, we proceed with the cancellation. However, there is absolutely no Request To Cancel in Mr. [redacted] folder whatsoever, just a Request to Freeze. In addition, I would very much like to comment on Mr. [redacted]’ written statements regarding his membership. In response to the statement “this is a terrible ‘contract’ type fitness facility to be involved in. Basically, when you give them your credit card information they charge it as many times as they want during a billing cycle without notice to the consumer.” This statement is uncalled for and completely false. We cannot, nor would we, repeatedly attempt to pull a monthly fee for any membership. What Mr. [redacted] needs to understand is that if there is NO money in his account, that is HIS responsibility, not Body Systems Fitness. For example, if he would write a check to a food store, and that check would bounce because that money was not in his account, then it would be HIS responsibility to make sure he doesn’t write a check he doesn’t have money for, and when that check bounces, he would have to pay a fee. It’s that simple. As you can clearly see on the billing history form (Exhibit B), when his monthly payment of $32.50, due on the 25th of each month was unable to be withdrawn, ASF attempted again on July 31, 2013 and was finally able to withdraw his July payment on August 6, 2013. When the again, attempted to pull his August 25, 2013 payment and was unable, they again attempted and was successful on August 28, 2013. He was charged a $29.00 service fee for not having the money in his account, which again, is not my responsibility. In response to his comment “I don’t see how it is right and ok for a business to keep charging a card that does not have the funds available at that time.” Can I inquire, how is that Body Systems responsibility? If there are no funds in that account, then l would suggest making sure they are when you have a legal and binding contract in force. When Mr. [redacted] came to the gym, I was extremely polite and tried to encourage him to make sure funds were in his account when they were to be pulled. He was very polite and seemed to comprehend what I was suggesting. I offered to give him a new swipe card (allows members access to the gym) and he left seemingly satisfied. And I have NEVER, EVER told a member “ there is nothing I can do about it,” although, if you don’t have money in your personal account, what WOULD a member expect me to do? And believe me, it is not a “profit opportunity” by charging someone $32.50 for a membership when they are a repeated billing issue. As long as there are no funds due at this time, I will HAPPILY cancel Mr. [redacted]’ membership at Body Systems Fitness per his comment “I no longer wish to retain”; however, as we do every person who requests a cancellation, he will owe Body Systems Fitness the final payment of $32.50 due on September 25, 2013, and the contract will be cancelled permanently. If we are unable to pull that amount, we will proceed to contact the local magistrate to collect any and all dues owed. And regarding him “alerting” potential members about our facility, he might want to be totaling honest in that regard. Body Systems has only collected the funds due, and nothing more. If you need anything further or additional, please feel free to contact me at any time. If Mr. [redacted] still would like the reimbursement of $29.00,1 would suggest he contact our billing company, ASF, at the following number [redacted], Extension [redacted] as Body Systems Fitness will not be reimbursing him at all.
