This letter is in response to Case #XXXXXXXX: Mr [redacted]. While I do understand some of the frustrations in getting the job completed in a timely fashion once we started, I am caught off guard as to why Mr. [redacted]...

felt the need to file a complaint, as I was very open in communications with Mr. [redacted] as to what was happening the entire time. I also disagree with the complaint that the job trailer was there for 14 days as of the 29th of May.
Starting in the fall of 2014, we signed a contract to get the roof done in October, 2014. However, the weather changed for the worse early, and after discussing with Mr. [redacted] the need for warmer weather in order for the shingles to seal down properly, as well as the need for at least 24 hours of 40 degree weather and direct sunlight on the shingles for them to get sealed properly, Mr. [redacted] agreed that it would be best to wait until the spring of 2015 to do the roofing, but was insistent on at least getting the north half of the roof completed last fall, acknowledging that he would have to pay for certain items, such as a second dumpster, in the spring as well. At the homeowner's request, we completed the north half of the roof, then due to blistering winds and weather, stopped short of finishing the roof. His initial down payment was $5,500.00, which covered all materials for the entire roof. The portion of roof that we had completed, labor and materials combined, only came to $5035.70. Mr. [redacted] was met at his place of work (Lowes) and returned a check for the outstanding balance of $464.30.
This spring (3/10/15) Mr. [redacted] signed a contract to get the remaining portion of the roof completed. He was told that we had some roofs with leaks that needed to be addressed 1st, and he stated that he was in no rush and understood. We thought we would be able to get to him in April, which is what the contract states as a time frame.
This year was an extreme year with people signing that needed priority with either leaking roofs or had to be accomplished before a certain date to either not get canceled from their insurance or in order to finalize a sale of their house. I was very up front with Mr. [redacted], discussing this with him a couple of different times. Each time I would talk with him, he said that he understood and that it was no big deal. There was a couple of weeks that we would have been able to be there if the weather would have held out, but it wasn't cooperating.
On 5/12/15, we started on Mr. [redacted] roof, completing all but 5 square that was a 2 story portion of a 10/12 pitched roof that was left untouched. We needed to replace all of the wood where there were currently roof vents and the forecast was for rain on that Thursday afternoon. We were afraid that we would not be able to complete it before the rain came. My foreman had already asked off that weekend, and the following week I had commitments to complete another job that needed done before closing on the 29th, and we didn't want the weather to get in our way of completing the job. I talked to Mr. [redacted] about this, and he seemed very understanding of the situation. We were not able to complete that job until Friday, and my foreman had planned on working Memorial Day weekend to finish Mr. [redacted] job. So Friday evening, the 22nd, I dropped my job trailer back off at Mr. [redacted] site.
The worker that was supposed to help my foreman backed out at the last second, and my foreman was unsure that he could finish the job by himself before incoming weather, as well as deal with getting the sheeting changed out with the winds at Mr. [redacted] house. I had prior commitments out of town that weekend and wasn't available to help him either. So we were planning on finishing the roof the following week. It rained Monday the 25th (Memorial Day), Tuesday, Wednesday morning, Thursday, Friday (the day the complaint was filed), and Saturday.
I received a call from Mr. [redacted] on Thursday the 28th asking why we hadn't finished the job. I explained to him that the weather had called for the rain to come earlier than when it actually came, and that we had not finished because we didn't want to open a steep, 2 story roof and take a chance on ruining the inside of his house. He said that it should have been completed and wanted to know when it would be done. I said that it was supposed to rain Friday and Saturday, but I would complete the job the following week. We completed the job June 1, 2015. I had no idea that he had filed a complaint.
I left the job trailer on site for 2 reasons. 1st, he had a secondary side drive that leads to a lean-to shed where my trailer was out of his way, and 2nd, I wanted him to know that his roof was the next roof that I was going to work on no matter what. I didn't want to pull it off the site even though I wasn't able to work that week because I didn't want Mr. [redacted] to think that I was putting getting his house done on the back burner anymore.
However, I didn't have the job trailer sitting for 14 days as Mr. [redacted] claimed on the 28th. I had dropped it off Friday evening on the 22nd - and Mr. [redacted] was present when I was dropping it off. And then the whole next week it rained. Although the rain on certain days didn't come until at a time we could have gotten it done, we didn't want to chance it because the weather was calling for storms, we had to replace some wood, and we can't cover up a steep roof fast if the inclimate weather were to come early. My contract does say a time frame of April, but it also states that completion dates are dependent on the weather. If it had not rained the week that Mr. [redacted] decided to file the complaint, we would have gotten it finished and there would have been no complaint filed. I don't feel that Mr. [redacted] timing in filing the complaint was fair nor just, especially with the communications that had taken place and Mr. [redacted] not showing any sign of irritation until he called me on the 28th, then deciding to file a complaint directly after we spoke without giving me a day of good weather to complete the job.
After we completed the roof, I had called Mr. [redacted] and apologized for taking such a long time to complete the roof and that I would try to see what I could do about taking a little off of the bill in appreciation for him being so patient, not realizing that he had already filed a complaint with both the Revdex.com and the Illinois Office of the [redacted] However, 10% of the entire initial job is neither fair nor just, especially because he agreed that the 1st installment of the roof he was satisfied with and had no complaints. The time that it has taken for me to set aside to respond to this complaint, as well as the potential business that filing this complaint has cost me, is more than just compensation. At this point in time, I don't feel that Mr. [redacted] deserves any more than the apology that I have already provided.
If I don't receive payment in full for my invoice, then he will not receive his 50 year warranty on the shingles. GAF has allowed the contractors to be the ones to register them, and they do this so that the roofers will not get stiffed by the homeowners on final payment.
