On July *** our representative Jordan G*** showed a potential renter, *** ***, apartment * ** *** *** Our firm handles exclusive leasing for the landlord of this building and a number of other building which they own. *** expressed interest in the apartment and was
given instructions on how to apply Due to the fact that we are leasing multiple apartments in this portfolio at one time, and therefore dealing with a large quantity of potential renters at any given time, we have instituted a policy by which we collect a good faith deposit from applicants who are 100% sure they are ready to move forward with the apartment. This deposit is held while the application process and approval can be completed, and becomes the applicant’s first month’s rent payment at time of their lease signing. The reason for this process is so we can make sure we do not waste the landlord’s valuable time submitting applications from potential renters who are not 100% ready to move forward. The agent who showed *** the apartment did not make her aware of this policy at the time she expressed interest in applying, which was an error, but then rectified it by making her aware of it prior to her submitting her application. She incorrectly assumed this was a fee which was being collected by our firm, even though we explicitly explained that it was a deposit which would become her first month’s rent at lease signing, but she seemed not to understand this, so we broke protocol and allowed her to apply without submitting a deposit. The day she actually submitted her application, she verbally asked if she was able to submit an offer below what the landlord was currently asking for rent, and was advised that she could make an offer of whatever she wanted, and we, as the representative of the landlord, would submit her offer and see what the landlord said. After this inquiry, she never explicitly stated that she wished to offer less than the asking price, and did not put this in a formal email or on her application form which she submitted to us She was made aware of the monthly rent of the apartment ($2,900), and was explained that since the landlord is currently offering a concession of one month free rent, she was given the net effective monthly rent as well. A net effective monthly rent figure is used to explain to potential renters what their average monthly expenditure comes out to when incorporating the free month of rent being offered by the landlord. It is calculated by taking the actual rent ($2,900) multiplying it by the number of months they would pay (11) and dividing it by the number of months they would be living in the apartment (12) *** was given the net effective monthly rent for apartment as $($2,* 11/ 12). She was made aware of the actual monthly rent and the net effective rent during the showing, and it was also clearly listed in the advertisement which she responded to which states the following: *Landlord offering Months Free Rent, Advertised Rent is Net Effective on an month lease - the LAST MONTH IS RENT FREE**Gross Rent $2,to be paid monthlyTHE LAST Month will be Rent Free* (Screenshot of advertisement is also attached (3147.7)) She submitted her application with the net effective rent listed as her offer. Jordan, the agent, sent her a text message (message 1) in an effort to re-confirm if she was aware of the gross rent since she only listed the net number, to which she never responded Assuming that her application as submitted accurately represented her offer as it had been discussed previously, it was submitted and subsequently approved by the landlord. Upon informing her that her application was approved, it was then that she raised a concern that we hadn’t submitted her offer correctly She asked us to re-submit her offer at a lower price, and was told by our agent that the landlord would only accept full asking price, which was the only offer she had submitted at that time. She became angry, and immediately began to threaten the agent, and accusing him of attempting to rip her off, and that she would be contacting the Revdex.com to file a complaint. She then was told to contact Jordan’s manager, Michael W***, who tried multiple times to get on the phone with her, and also sent multiple emails in an attempt to discuss what had happened, hoping to clear up any confusion and attempt to rectify the situation in a manner which would please her, but she was unwilling to discuss the events at any time, instead opting to continue to send threats and accusations. She maintained that she had been lied to and was coerced into submitting an application, even though there would be no benefit to us in simply receiving an application, as our firm is only paid a commission by the landlord upon signing of a lease. It was clear to us over the course of this interaction that *** had previous bad experiences with real estate professionals, as she alluded to that in several correspondences We understand that renting an apartment in this city is no easy task, and that the lack of oversight of real estate professionals can sometimes lead to confusing situations, but we are certain that at the very worst, what happened in this instance was a small miscommunication or misinterpretation on her part, which would easily have been cleared up had she made an attempt to actually speak to a manager, rather than jump to conclusions. The only amount of money which was taken from *** was her $application fee which she paid when she submitted her application, but, again, she never spoke with the manager to request this be refunded or to discuss what had actually happened, so at this time, all that is known to Bold New York is what our agent, Jordan G***, has explained, which was relayed in the above message. We are hopeful that as we have requested multiple times, *** will get in touch with Michael W*** to sort out any remaining confusion and we are able to refund her the application fee if we deem any wrongdoing occurred.  Bold New York is being dishonest.  The apartment rent was advertised as $2,667, and I was not informed of the actual price ($2,900) until after my application was accepted.Bold New York is attacking me, saying I hate brokers (which they are claiming I said to them but never did) - no, I hate dishonest brokers who use illegal tactics.  Jordan G[redacted] and possibly the company itself is dishonest, using deceptive practices to rent apartments.
