***.In the month of October payment was received and posted on October2, 2015. This payment was returned due to insufficient funds on October 7, and a return check notice and Notice to Vacate were issued to the resident. On October 12, the resident made a $payment but monthly rent is $per month. The account had since accrued late fees and a return check charge.An eviction was filed with the courts on October 16, 2015. The resident made another payment of $on October 23, 2015. The monies were applied to late fees, the returned check fee and left the resident outstanding in rent in the amount of $184.83.According to the Texas Apartment Association lease agreement, paragraph states:When we receive money, other than sale proceeds under Paror utility payments subject to government regulation, we may apply it at our option and without notice first to any of your unpaid obligations, then to current rent. We may do so regardless of notations on checks or money orders and regardless of when the obligations arose. All sums other than rent are due upon our demand. After the due date, we do not have to accept any payments.The $eviction charge is the amount that Sundance Apartments paid to the court in order to file the eviction for unpaid rent that was due. Since the property did indeed pay this amount to the courts, the property does require reimbursement for this expense.Sandalwood Management does offer an e-portal system in order to pay rent online. If a resident pays rent and other sums due by personal check there is not a fee for the service. If a resident opts to pay by credit card, debit card, etc there is a charge for this service and is so stipulated on the e-portal prior to making payment. The service also reiterates this charge prior to submitting the payment. Once a check has been returned due to non-payment or a credit card charge has been rejected, the resident is required to redeem by cashier’s check or money order unless the option is available on the e-portal to use a credit card again at this time.Regards, *** ***Director of Residential OperationsSandalwood Management, Inc
