My husband, ***, and I went to The *** Apartments at *** N *** Street, ***, VA XXXXX on Saturday, October 20, 2018 to tour the premises, look at apartment options, and seek out additional information, such as amenities. Derek *** was the individual who assisted us. He showed us a couple apartments with the floor plans we were interested in. One was in the process of being cleaned/renovated after a move-out, and the other was a model apartment. He even showed us the Club House, and what The *** has to offer. We were very impressed and interested in being a part of this community. We discussed amenities, fees and the lease protect deposit. A couple days later my husband and Derek had a conversation about the previously discussed amenities, fees, and lease protect deposit. Derek mentioned a different price on the monthly rental, and that he would waive certain fees. We agreed, paid the lease protect deposit, and waited for the lease to be sent to us to approve and sign. When we received the lease, it was completely different than what was agreed. We refused to sign the lease, until it was corrected to reflect what was verbally agreed upon between my husband and Derek. Derek then said he couldn't make changes, and that we would have to wait until a manager was available to discuss the circumstance and the refund of our lease protect deposit. The lease protect deposit of *** hit our account on October 24, 2018. My husband and I have been trying to reach the manager of this location, with no luck. We have left multiple messages at this location as well as their main hub in Utah. Everyone we speak to says they will take our message and make sure it gets addressed, however, no one has called us back to further discuss this issue. The *** Apartments still has our lease protect deposit (which is not a hold deposit) and a lease not agreed upon that they were hoping we'd sign. No one at The *** wants to resolve this issue at The Encore, and therefore, I am having to leave multiple messages with no response or further action.

Other (requires explanation) The lease protect deposit is a move-in alternative fee to the lease, instead of paying the traditional security deposit. Since the lease that Derek wanted us to sign was not agreed upon by both parties and we did not in any way move in to an apartment owned by The Encore or any other unit on the premises, this lease protect deposit should be refunded back to us, with no hassle. My husband and I would like a refund of *** that is owed to us. The written lease (contract) was not what was verbally agreed upon, and therefore the lease protect deposit should have been refunded the second we told Derek that we weren't going to sign the lease with the terms and conditions not agreed upon.

Comments: I feel as though this wouldn't have been resolved, if I didn't complain to the Revdex.com (as well as on various rental property websites). I'm not sure if the company read my reviews left on various rental property websites and/or if their response and resolution of the matter was in reference to the Revdex.com reaching out to them. Either way, I received the refund that I was owed, in addition to the numerous communications from various individuals seeking my opinion and forgiveness from the company and/or its subsidiaries.
