February 6, 2018Dear Agent ***:I am in receipt of your correspondence dated January 22, regarding the above-referenced individualsAt the outset, I would like to thank you for the opportunity to respond to the claims made by the individuals that filed the complaint against my business.I am
the third-generation owner of Bovani's Towing and Service, incin West Pittston, where we have had our location for over yearsI am in the contract tower for Pittston CityThis is a position I have as a result of a contract bid which requires me to file all charges for services with Pittston City.The tow in this case was a result of a call wherein I was dispatched to the location of *** ***'s cemeteryThis call was after hours at 3:a.mThe vehicle was approximately feet off the roadway and was required to be winched with the use of a rollback tow truck in order to get it back on the roadway.At the scene the owner of the vehicle, or the father of the owner of the vehicle said he would pay with a credit card but that he was going to dispute the chargesThe charges were very basic:$Rollback service ( a rollback was used to respond to the call and then the rollback was used in order to operate the winch)$for winching (this is usually billed out at $per foot)Once the customer said he was going to stop the payment, our driver was instructed that he was only to take cash for the payment, as we successfully performed the job we were sent out to doThe car was then taken back to our lot until it was paid for.At 4:a.myour complainant called the tow company and demanded to speak to the ownerPlease note that after hours calls are only taken for emergency tows and police callsI personally went to the garage and met with him because he was so upsetAt this point the vehicle had been towed and locked in our storage areaAs a courtesy, I met with him when we were not open and I only charged him for the rollback being sent out and used, and the winching fee, as I listed above.At no time was there any charge for a towAt no time was there any charge for storageAt no time was there any charge for gate fees or administration feesThere simply is no money that is owed to this gentlemanHe is, in error, stating that the rollback charge was for towing the car back to our lotThis is simply not the caseIn fact, once his car was towed back to the lot, we could have charged him for all these items and we did not.We responded to a call and ail of our charges are in line with the costs represented in our contract with Pittston CityAnyone who needs a tow service in the City is welcome to use their own tow company and can request this of the PoliceThis was a caii we were dispatched toWe did our job and did it with professionalismSince this tow, the claimant has taken to social media to blast my family business with defamatory remarksHe goes further in the comment section of his posts to allow people to post about where I live and things about my wife.I hope you find my correspondence helpful in your assessment of this situationI've been doing this for thirty years and I understand that it is upsetting to have your vehicle towed and I'm sure very scary to have your vehicle land almost feet off the roadwayThese are situations we are familiar with every dayOur business has been here for years and we will continue to beIf I could provide you with additional information, please do not hesitate to call me at ###-###-####I thank you for the opportunity to resolve this matter and I remain,Sincerely,Dante JB***, Jr
