The business claims that every car it sells is guaranteed to pass [redacted] - I bought a car in March that hasn't been able to pass [redacted] Has been at the mechanic's for over 7 weeks and haven't heard back from them. Also have not received the deposit back from them that I gave them when I bought the car.Product_Or_Service: Used AutomobileDesired SettlementI would like them to eliminate the "Guaranteed to pass [redacted] phrase form their advertising since it is not true.

Complaint[redacted] Auto Sales guaranteed in writing they did not have knowledge of any undisclosed defects & an inspection confirmed they were being dishonest.I live in Missouri & was going to purchase a vehicle from Massachusetts from [redacted] Auto Sales on 12-13-13. [redacted] advertised the vehicle on Ebay. I paid for a used vehicle inspection that was performed by the local Dodge dealership to confirm the vehicle condition prior to purchase. [redacted] guaranteed in writing they did not have knowledge of any undisclosed defects & then the inspection confirmed they were being dishonest. I have the signed bill of sale signed by Rick with [redacted] confirming their guarantee as well as the inspection report confirming the check engine light was on due to transmission failure. When I confronted [redacted] about not disclosing the check engine light they replied stating they had no knowledge of the check engine light being on. I then contacted the Dodge dealership that performed the inspection & they confirmed that the check engine light had been on for 38 days & is documented in the vehicle's computer system. Dodge confirmed [redacted] absolutely had knowledge of the check engine light because it had been on for 38 days. I then contact [redacted] & requested a refund of my $95 inspection fee that I paid to Dodge because [redacted] lied in writing with signature about their knowledge of undisclosed defects. [redacted] then hung up on the phone on me & will not return my attempts to contact them for a resolution. Please help me recover the money I lost due to [redacted]'s dishonesty as well as help prevent other innocent victims from being taken advantage of by this dishonest company. Thank you.Desired Settlement$95Business Response In December of 2013, we listed a 2001 Dodge Ram 3500 for sale on Ebay. Ebay auctions are "as is" auctions. The description for the item listed the vehicle's known defects. Mr [redacted] contacted [redacted] Auto Sales after the Ebay auction had ended and inquired about the availability of the vehicle. The vehicle listed has an NADA retail value of approximately $11,000. We negotiated a sales price of $7000 as is for the vehicle. Mr. [redacted] requested that we bring the vehicle to a dealership of his choice in order for the vehcile to be inspected prior to sale. We brought the vehicle to the requested dealership for inspection, where the vehicle sat for four days. Upon receiving the inspection report from the dealership, Mr. [redacted] called and accused us of being dishonest, stating the check engine light was on in the vehicle, and we must have known about it. He then stated that the check engine light was on for 38 days according to the dealership that inspected it. I explained to Mr. [redacted] that when the vehicle was listed on Ebay there was no check engine light visible, and possibly the code had been cleared by a previous employee without my knowledge, the check engine light must have come on again while sitting waiting to be inspected. I also explained to Mr. [redacted] that we were selling the vehicle for $4000 less than retail value, and any repairs would be his responsibility. He stated he understood that fact but continued to claim dishonesty on our part due to the check engine light being on. Mr. [redacted] then stated he no longer wanted to purchase the vehicle and demanded to be repaid for the vehicle inspection that he requested and agreed to pay for. I stated to Mr. [redacted] that it was unfair of him to request reimbursement for the inspection that he requested be done. I also explained to him that the vehicle was not on our lot and therefore unavailable for retail sale for a period of four days, and that we had brought the vehicle to the dealership upon his request, not knowing that the vehicle would be off the lot and unavailable for possible sale for that long a period of time. Normally a purchase agreement and a deposit would be necessary for the vehicle to be off of our lot for that amount of time.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I have documented proof from email attachments directly from the seller that the purchase agreement & all revised purchase agreements were signed after the 11/26 ebay listing & prior to the 12/9 Dodge inspection. The 12/9 Dodge inspection confirmed that the check engine light had been on since 11/1 which clearly is prior to the 11/26 ebay listing. The seller unequivocally had knowledge of undisclosed defects because the check engine light is documented to have been on since 11/1 & the seller knowingly listed the vehicle for sale on ebay 11/26 & then signed purchase agreements with me prior to the 12/9 Dodge inspection without disclosing their knowledge of the check engine light that had been on since 11/1.Final Business Response There were no known undisclosed defects at the time the purchase agreement was signed.
