ATTN: [redacted]

Dear Ms. [redacted]:

My name is [redacted]. This is written in response to the complaint presented to your office by one, [redacted], concerning services rendered by my office, at the specific request of Mr. [redacted]. Attached hereto, in pdf format, are copies of my Statement for Services Rendered, beginning November 23, 2012, through January 29, 2013. Please note that our first office visit included credit for a ½ hour “free” consultation, despite the meeting lasting nearly one hour. Then, on December 18, 2012, he forwarded legal pleadings to my office that required his immediate attention. At his specific request, I then drafted what are called Response to Interrogatories, initiated by an opposing party to his then pending legal proceeding. The necessary documents were timely completed at his request, duly executed, and served on the opposing party. I forwarded monthly billing statements to him throughout the pendency of the rendering of the services, without response or without any payment whatsoever. Some eight months later, I referred the matter to collection. Only after having sought mandatory enforcement did he then choose to lodge this complaint, asserting that he owes “nothing” for the services rendered. My desired settlement? That he immediately remit the now long past-due amount owing, in the “reasonable” sum of $840.00.

Thank you. [redacted]

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[Attorney [redacted] has falsely represented our business relationship. It's true we had a free consultation. He asked for my case information to look over and when he had some free time and he would then get back to me. We did not talk about cost or whether or not he would be able to take on the case at this time. I got a phone call ($$$) asking if I can come in to the office ($$$) to complete interrogatories. I sat in a side office by myself, without help from the attorney, completing the interrogatories. Upon self completion, the attorney had his secretary transfer the information I wrote down into a court format ($$$) and handed me the final product. He then informs me how "busy" he is and can't represent me in this case and referred me to another attorney in the office. Again, no price was conveyed up to now or at this time. I didn't think to even ask because in my head, he rejected my case, why would there be a charge at all, let alone nearly $1000. Also, these responses ($$$) were deemed inadequate anyhow and I needed to redo the interrogatories entirely soon after in preparation of the court date. Attorney [redacted] failed to properly represent me as a client nor inform me of a cost required to inadequately prepare me for trial. No retainer fee was required, no attorney/client contracts were signed, the entire charge is hinging on the attorney's "good word". I equivocate this as calling an electrician out to service your home, the electrician telling you to run some cables and then half way through, referring you to another electrician... and then getting an $840 bill from him. The right thing to do is to remove these charges.

As a side note, the referred attorney was also busy but was able to empower me with useful information to appear exparte. From the beginning, the new attorney was upfront with cost which ended up being a nice lunch. Not $840.]

Regards,
