Mr. B[redacted] signed up and purchased a Pass product that has age parameters (8 to 18 years old) and he is clearly over the age of 18 he is 19. Our terms and conditions clearly state this information and Mr. B[redacted] "agreed" to these terms and...
conditions by click through during his online purchase. Our online shopping cart does not have the ability to restrict entered birthday data we rely on the purchases acknowledgment of the Terms and Conditions. Mr. B[redacted] received his pass as part of the online purchase and once the purchase had been processed we were able to identify Mr. B[redacted] as too old for the program and thus sent a notification email making him aware of the situation at which time he did not correspond. His pass was flagged once he used it and we were able to track him down once he returned to property and suspend his pass for being outside the age parameter for the product.

While I admit that I should have thoroughly reviewed the terms and conditions I NEVER received an email regarding the situation. Also I was accused of committing fraud even though I submitted all the correct information which I disapprove of. I am a student who works hard for my money which they are stealing.

As the business we are going to stand by our first rebuttal that Mr. B[redacted] is not going to be offered a refund because he clearly entered into a purchase contract acknowledging he was between the age of 8 and 18 years old and he is not. Mr. B[redacted] is 19 and legally bound to the terms and conditions that are associated with the product. Mr. B[redacted] has acknowledged he did not "thoroughly review" the terms and conditions before agreeing to them which is not an acceptable reason to be excused from what those terms and conditions outline. Furthermore our records in fact show that he was sent an email regarding this issue but he did not open the email so his claim that he "NEVER" received an email is false.
