CUSTOMER [redacted] ID [redacted] PER MY INFORMATION THE CUSTOMER SIGNED A CONTRACT FOR BOTTOM LINE CONTRACTING TO BUILD THEM A HOME.WE HAD STARTED ON PLANS BEING DRAWN, AND THERE WAS A LIST OF OPTIONS WITH COST GVEN TO THEM.THEY BACKED OUT OF THE CONTRACT WHICH PUT THEM IN DEFAULT.

Please be advised this office represents Bottom Line Contracting, Inc. I am in receipt of your letter of June 2, 2015 addressed to my client regarding the allegations/complaint of [redacted]'s complaints are totally without...

merit.By way of background, typically the realtor meets with the prospective client to obtain all necessary information. To the best of my client's knowledge, there was never a request to meet with the owner. The realtor procures the necessary information regarding flooring, cabinets, countertops and the like from the prospective purchaser.
All units are built with the same components, including concrete foundation, concrete basement and garage floor, wood framing, PVC drain lines, [redacted] water lines, drywall, and the like.
The [redacted] water line is standard in today's industry. Likewise, PVC drain piping is standard. My client is unaware of any "gasoline smell” coming from the plumbing drain. That is highly unlikely. Further, my client has never had anyone get sick, headaches, or blurry or burning eyes on any units that have been finished.
My client checked with [redacted] to make sure the right cleaners were used. [redacted] advised my client that they could use vinegar and baking soda and that is exactly what my client did. Thereafter, my client received a call indicating that there was an alleged problem and my client recontacted [redacted] as soon as possible and had the cleaning people talk to [redacted] to verify that they used exactly what [redacted] had requested.All appliances are new and have a standard one year warranty. The dishwasher, when it was hooked up to the garbage disposal, had a problem in that the drain plug was not taken out. [redacted] called to say the dishwasher was not working. The next day the plumber was out to fix the plumbing problem but not the dishwasher because the dishwasher was working. At that time, and at [redacted]'s request, the garbage disposal was removed because she did not want it. She again called about the dishwasher allegedly not working.
She was advised to contact the appliance people. My client is not in the appliance business. Apparently, [redacted] set up a time for the workman to come out. When the repair person walked in the door, she would not allow the individual into the property. The report my client received from the appliance people is not the same story that she alleges.
Additionally, [redacted] has alleged that the stove is not working correctly. Again, she was referred to [redacted] to have them come out and look at the stove. She said she called and allegedly could not make contact. Accordingly, my client contacted ** and was able to get through promptly. However, it is incumbent upon [redacted] to contact the repair people, since the items are under warranty but I suspect, just as with the other allegations, that the oven works fine and there are no problems. However, [redacted] can contact [redacted] and have them come out and check into the alleged issue since it is still under warranty.
My client used the paint that was specifically requested by [redacted]. My client sent her the invoice, from the painter, as proof regarding this issue. The painter used the same type of paint as the primer. Additionally, [redacted] was advised not to use semi-gloss paint on drywall as it shows all imperfections and does not touch up well. Unfortunately, and against advice, [redacted] opted to utilize semi-gloss paint on the walls.
Likewise, the flooring was picked out by the owner and installed per standard installation. Vinyl was put on the stairs at [redacted]'s request. The flooring company called [redacted] regarding the alleged problems to set up a time for repairs. [redacted] was to call them back and, to the best of my client's knowledge, that never happened.
Separately, [redacted] raises an issue with regard to the floor being “cold”. Vinyl tile is Somewhat cooler even in the summer months.[redacted] also raises issues with regard to the temperature in the unit. There is no heat in the garage so any allegations regarding a heated garage are misplaced and were not part of the contract. In fact, there are very few constructions projects where someone installs heat in the garage. Installing heat may be a hazard due to exhaust fumes with a heat pump system.As with any alleged complaint, my client will look at the item and make standard repairs but, in order to avoid issues, would prefer to do everything all at one time. My client cannot control what repair people wear, how they wash their clothes and other related matters.Separately, it is my understanding that there may be a significant odor, from dogs on the property, which could be an issue. The fence is controlled by the Homeowner's Association and not by the builder.
My client has fully complied with the contract. [redacted]'s allegations are totally baseless and without merit.
Accordingly, my client respectfully refutes all the allegations alleged by [redacted].

This letter is in response to
the letter I just received from Craig H[redacted]'s attorney, [redacted].  I think [redacted] summed it up all very
nicely as to how his client has felt since day one about responding to his
responsibilities in honoring the house's warranty it 'would be
counterproductive'.  That is precisely
the attitude I've gotten from Craig H[redacted] and Leon C[redacted] all along.  They have made it clear that fixing what they
did wrong was a waste of their time and completely counterproductive.  It is obvious from the entire ordeal that Craig
finds it counterproductive to respond to any complaints even while under contractual
obligation to do so and this attitude from the attorney just continues and
enforces that pattern.  It may be
counterproductive in their minds for them to fix this house, but it certainly
is not counterproductive to me.  I guess
they should have done it right to begin with instead of trying to take
advantage of the disabled and elderly.
If there are misstatements, then
I would think that they could at least point out specific instances that are
incorrect, but all they respond with is a bunch of nonsense with absolutely no
substance.  I can give very specific
problems and I can prove them right here right now.  They have done nothing but talk in circles
and have provided no proof to back up their claims.  I can provide physical proof and I can provide
written proof.  Where is their proof?  Just saying that I'm wrong does not make me
wrong and there has been nothing said or done to back up their assertion that I
am wrong.  Give specifics that are
relevant to what I've said and not talk in circles then back it up with some solid
proof.
The accusation of my claims
being baseless is yet another deflection to steer the attention away from the
problems and their lack of ability to back up their baseless claims and put it on me.  According to the dictionary baseless means:
having no base; without foundation; groundless: a baseless claim..  So here's the thing: my claims can be proven,
so not baseless.  Can their nonsense
disprove it?  I have yet to see one
specific thing to disprove anything I have said. They talk in circles and say nothing.  Typical legalese.  I have been very specific. Why can't they do the same?  They are the ones that brought us to this
point because they feel that acting like grownups and doing their jobs is
counterproductive. 
It is no concern to me what
legal fees Mr. H[redacted] incurs.  That is
his problem, not mine.  My concern and
only concern is about this slapped together house we have purchased and Mr.
H[redacted]'s refusal since day one to even talk to us about the problems let alone
fix them as per the warranty.  All he has
ever had to do is give us information and be willing to talk to us about how we
can fix the issues here.  Not once has he
responded to us.  Not one time.  If he is now incurring legal expenses I do
not see where that is my problem. I
tried to talk to him and reason with him as did my dad, but he ignored us for
months.  I've incurred the financial
disaster that is this house.  We paid
cash for this low quality dump - in good faith. 
I put everything I had into this house so that I could have a safe place
to start my medical treatment and to eventually heal.  This house was supposed to be someplace quiet
and peaceful where I could be left alone to finally take care of myself and
deal with my medical condition with no outside concerns.  I just wanted to be left alone. I don't want to deal with other people.  I certainly did not want to be dragged into
this ridiculous nonsense of a business owner refusing to do his job and
refusing to honor his promises and warranty. 
I definitely don't need all this hassle. 
I have more than enough on my plate dealing with my health issues.  All this house has done is cause more
problems.  I would think anyone with any
kind of soul or conscience would feel at least a little bad about that
particularly if they were responsible. 
Dealing with all of this is what is counterproductive.  This is beyond ridiculous and could have been
easily avoided had Craig just taken responsibility for the lousy job they
did.  So simple, yet so arrogant and
immature to just refuse to respond like a petulant child would.  Everyone makes mistakes.  It is ok as long as you are grown up enough
to own up to them.
I won't go into all of it, but
it is not baseless that I still do not have a mailbox or a proper way to get my
mail every day.  It is not baseless that
the air quality tests came back with the results they did. It is not baseless
that there is a mountain in the floor of my room or the floor boards move and
are coming up in numerous places throughout the house and the nail pops are
pushing through the poorly laid flooring. It is not baseless that my windows do
not close completely and cannot lock and that the stench from outside then
pours in through the open cracks or that the walls were not prepared or painted
properly.  It is not baseless that my
HAVC does not work properly and we cannot climate control the house.  It is not baseless that I have documented the
lies that we were told in email that did not materialize in this house.  None of this is baseless and all of it is
very easily proven.  And all I hear from
them in their childish way is 'no it isn't'. 
Give me a break.  Grow up and be
responsible.  Where is their proof?
As for [redacted]'s offense
at my comments, well then maybe he should not have implied I am too stupid to
know if there are problems in my own house. 
I understand that is what lawyers do, but then he should also understand
that most people are going to be insulted and offended at being treated in such
a manner.  You do not get to treat people
in one way and not expect them to take the same tone with you right back.  There is nothing professional about being
disrespectful and condescending.  If he
had been civil and respectful then I would respond in kind.  There are ways to phrase things without
sounding like a condescending bully and making me out to be an it.  Suggesting I am too dumb to know whether my
appliances work or not is pretty disrespectful. 
I would wager I've spent a lot more time in a kitchen using appliances
than he ever has and I am very familiar with how they are supposed to
work.  How insulting and condescending
can you be?

in either letter.  He talked a lot, but
many of the things he said were either irrelevant to the complaint or just untrue.  He did not state any facts about how my
claims are wrong, just they were wrong. 
Facts can be proven.  Where is his
proof?  As a lawyer I would think he
would be familiar with the concept of offering proof for what you say.  He has given absolutely none to back up what
he is calling facts.  He talks around
every issue calling me a liar, but there is nothing substantive there.  And what is truly offensive is that these
people have stolen eight months and counting of my life.  I have not been able to get treatment because
of the air quality in this house and the fact we have been living in a
construction zone for over 8 months, which pollutes this house from the toxins
used in the other houses and it also prevents healing with the constant noise
pollution.  That is what is offensive and
what should be offending the others involved if they had any sense of decency,
humanity, or compassion. 
I do have the right to question
both his and H[redacted]'s integrity and ethics in the way the issues with this
house have been handled.  I have not been
treated with decency, respect, honesty, or integrity. If I had we wouldn't be here.  Again, neither of them have stepped foot in
this house to be able to state factually and without a doubt that my claims are
false.  They have not experienced any of
the nightmares of this house.  So how can
they state facts about something they know absolutely nothing about?  Saying they doubt it does not make it
so.  So yes, I do have to question the type
of people I am dealing with when they state things as fact when there is no
possible way they can actually know.

This letter is in response to
the letter I just received from Craig H[redacted]'s attorney, [redacted].  I think [redacted] summed it up all very

finds it counterproductive to respond to any complaints even while under contractual

enforces that pattern.  It may be
counterproductive in their minds for them to fix this house, but it certainly
is not counterproductive to me.  I guess
they should have done it right to begin with instead of trying to take
advantage of the disabled and elderly.

I am rejecting this response because:Bottom Line is correct that plans were started, but the issue was they never completed the plans as discussed when the deposit was put down on 12/28/2015.  We discussed at a meeting with them that we needed to have plans before our current house went on the market.  It was before we put down the deposit that we were assured that 30 days was typical for getting this done.  It was not until 3/7/2015 that we asked for our deposit back due to them not following up on several requests to complete the plans and get flooring and cabinet pricing completed and our current home was on it's 2nd showing.  They were unwilling to complete the plans in the timeframe agreed to or even reasonably close, which would be Bottom Line in default of the contact.  There nearly a month to respond with 3 sentences is typical of what we saw during our attempts for planning to build with them.  Our own realtor who we met at their open house was just as frustrated with the lack of response.  I have the emails to show the frustration we experienced if they are willing to look at this issue they have with their process.  Perhaps they are not aware of how poorly [redacted], who represented them during this process, handled the lack of planning.  I've attached 4 emails and have more (limited to 4 in this response) to send if they would like to look at our experience and fix this issue to prevent further customer issues.We will continue to pursue this issue until we received our deposit back as the reason we are currently not living in a home built by Bottom Line was that the plans could not be finalized.
