Bower's Towing Company, IncCuyahoga Street *** *** 44310January 25, Dave D*** Investigator & Dispute Resolution Coordinator Revdex.com West Market Street Akron OH Dear MrD***, Regarding complaint ID *** we reply in response to additional information contained in your message: Any vehicle left for days, even in one's own driveway or garage with food, food wrappers and trash, as was in the claimant's vehicle (please review pictures previously submitted) is at risk for damage due to mice, squirrels or other crittersBower's Towing does not "clean" vehicles, but will always make every effort to help with any situation when reasonable requests are made to work with people, to protect property and accommodate personal situationsThe towing business is one that is directed by the police departmentOur obligation is to remove vehicles that they deem obstructing, nuisance or in some way of interest to them due to some violation of lawAPD expects prompt performance and confidence that we have a safe place to put vehiclesAll vehicles impounded byAPD are placed on our lot awaiting further disposition either initiated by owner or State of OhioStrict policy is: No vehicle is searched, examined, inventoried or evaluated in any way other than to insure safety of our drivers and propertyThis means we do not disturb contents for any reason until a "release" from APD is presented at our location by the owner or person with power of attorney and with proof of ownershipAt that time the owner may tend to their interest in the vehicle and it's contentsAfter this, if appropriate, the insurance company may take possessionIf no contact is is made by the owner then Bower's waits, as long as necessary, for documentation passed on from the State permitting the removal from our lot and for recycling We do not "clean" the vehicle.In this complaint there is no way to assess when damage alleged by claimant occurred, or if it occurred at allOur position is that no damage was caused or allowed to be caused by Bower's TowingClaimant states "the car was never abandoned." According to the officer's report the vehicle was "abandoned." (please see indications highlighted on APD report) Claimant says "Akron police towed it to Bower's." Not so, Akron Police ordered Bower's to tow the vehicleThe tow truck driver did not meet anyone, except for the police officer, at the accident siteWe had no contact with and, therefore, made no arrangement with owner or claimant for any concern for the vehicle or it's contentsIt was owner's responsibility to mitigate the situationWe would have been glad to see someone at the tow yard earlier onThe owner never made an effort at all nor did the claimant, the driver, until days laterClaimant indicates "the car sat so long" because the BMV made a mistakeShe claims it was a "process to get that fixed"Apparently to explain why it took so long (days)The insurance company made several contacts with Bower's beginning three days after the accidentThey wanted to have the vehicle removed from our lot (to minimize the storage charges, as insurance companies usually do)They could not because claimant had not secured a release from APDMany vehicles which have been in accidents like the claimants routinely are impounded and the towing company (Bower's) never sees the ownerThe next step after the State of Ohio deems it appropriate is to dispose of the vehicle to a recycle center where it is compacted and/or shreddedWe only know the difference if the owner does something first; the earlier the betterIn claimant's original settlement request she asked for "refund for the towing fees and storage cost." In the additional correspondence to your office she indicates that "Allstate insurance paid full storage fees and cost on my behalf"There is no resolution to this contradictionThere must be some other motive hereIt is regrettable that claimant feels a need to blame everyone but herself for consequences of her accidentShe did not mitigate her situation nor request that we might help her do soBower's Towing feels that we have correctly assessed the events in this incident and performed appropriately and declines to make any refund or other payment to Ms***Respectfully, Robert DB***, PresidentBower's Towing Company, Inc

reply: On 12/04/16 a 2008 Dodge Charger driven by Alberta [redacted] was in an accident with a 2009 Ford Ranger near intersection of [redacted] and [redacted], [redacted], At the-time of the accident the vehicle driven by Ms. [redacted] was registered to a Samuel [redacted], [redacted], [redacted]. (please see Akron Police report) This fact had no bearing on action taken by Bower's Towing on 12/04/16. Bower's Towing was contacted and instructed by Akron Police Department (APD) to remove The Ford Ranger from the Streets due to "accident" at 03:09. (3:09AM) The Dodge Charger was allowed by APD to be removed by another tower per the request of the driver, Alberta [redacted], who had indicated the towing company was "on the way". At 03:41 (3:41 AM) APD instructed Bower's Towing to return to the scene and remove the Dodge Charger due to "accident" and "abandoned" at the same location. (please see APD report) The vehicle was still in the original location, partway on sidewalk and partway in the street. The Dodge Charger was towed to Bower's impound lot at 585 Cuyahoga St., Akron, OH. It is clear, at this point, no contract or agreement was made between Alberta [redacted] and Bower's Towing. Bower's Towing had possession of the Dodge Charger as a consequence of accident and enforcement of city police regulations. No arrangements were made by Alberta [redacted] or assumed by Bower's Towing for special consideration for the contents of the vehicle she was driving. The owner, Samuel [redacted], also made no contact with Bower's Towing.City wide policy of police ordered tows: Personal effects in towed vehicles are the responsibility of the owner of the vehicle. All vehicles impounded by APD as well as others are placed on our lot awaiting further disposition. No vehicle is searched, examined, inventoried or evaluated in any way other than to insure safety of our drivers and property. It is the responsibility of the owner of the vehicle to arrange further action. It has been learned that title for the Dodge Charger transfered from Samuel [redacted] to Alberta [redacted] on 12/14/16, ten days after the accident. On 12/30/16 at 3:00PM Ms [redacted] presented an APD release form to Bower's Towing permitting her to recover personal effects. She did so and left the lot. Later that day she telephoned and indicated that the items were "all chewed up". She said she thought they were damaged by mice or rats and wanted some restitution for the damage and compensation for storage costs. She was told Bower's had no responsibility for condition of items in her vehicle and she became loud and beligerant. Bower's Towing has no way to account for Ms. [redacted] position regarding damage to said items. If they were damaged by mice, squirrels, chipmunks or other wildlife they were very likely carried to our location in her vehicle. Since she was not the owner of the vehicle until well after the accident perhaps the car was inhabited before with out her knowing. Additionally, allowing the damaged vehicle to stay on our lot for 26 days without mitigating the damage very well can have a few surprises. When the Allstate insurance finally obtained necessary documentation due to Ms. [redacted] delay in obtaining the APD release, they arranged with an auto recycle company, Copan, to take possession of the vehicle. Copan came with proper documentation to remove it. On the way out we took pictures of the vehicle including trash, McDonalds wrappers, milk containers, soft drink bottle and package of cookies with "chew" holes. Any unkempt vehicle with food items and heavy front end damage (please see APD report) will allow access to all kinds of wildlife.  In conclusion, Bower's Towing feels the claimed damages, if they occurred, occurred because of Ms. [redacted]' neglect and failure to mitigate her situation and not because of Bower's Towing, it's employees or affiliates. I am rejecting this response because:Whatever reason the car was towed to bowers towing is neither here nor there? There was no damage to anything inside the car at the time is was towed. The car was never abandoned, at the time of the accident I had no way of moving the car therefor,Akron police towed it To bowers. The car sat so long because I was unable to get a Release because the bmv made a mistake on the registration and it was a process to get that fixed. Reguardless of the reason why it was towed it was in possession of bowers towing and there responsible because it was on there property when my items were damaged! They were very rude and unprofessional. Also the car wasn't just sitting for free Allstate insurance paid full storage fees and cost on my behalf. Who wouldn't be mad after discovering there personal items where damaged while in tow ?
