I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. Hello, thank you for the opportunity to respond to the letter you received regarding my complaint against Bowling Green Fireplace and Grill. My first contact with Bowling Green Fireplace and Grill was Sept 9, 2016. After spending some time in the showroom, and speaking with *** and ***, I felt very comfortable in placing my order to have a total of fireplaces installed and covered with " ***" Dutch Quality Stone. I selected a Dutch Quality Stone "***" because of its rough and rugged appearance, which would be compatible with the style of house I was building, which is a Victorian/Craftsman style house. I actually asked why they didn't specify the exact stone on the estimate, and I was told that all the stone was the same price, so it didn't matter.I also purchased the see thru fireplace for the family room/dining room because I wanted it to be able to heat the basement with the gravity vent. I purchased this fireplace specifically because it had the gravity vent. Even though this fireplace had a square top, I was told that they could put stone over the metal (as long as it did not lock the vents) in an arch pattern. I purchased a fireplace for the second floor that had a blower (for heating the second floor) that was on site. *** told me they had purchased the fireplace during a home show. I took pictures of this fireplace on site.On the first day, I told them that I didn't want a big joint in the stone. I was told this was called 'dry stack". I was also told that the stone I had selected '***" could not be dry stacked. I replied that if it couldn't be dry stacked, to make the joint as small as possible. When I walked into the house on Dec 9, I very calmly stated that the colors were nice, but that wasn't the stone I had selected. The situation very rapidly deteriorated. *** came into the house and became very angry. He repeatedly called me a " *** liar". His actions were extremely unprofessional, and I was concerned that his verbal assault would escalte. I walked away from his verbal assault, thinking he needed some time to gather himself. As a year old woman, I was very concerned about his behavior, and his use of profanity.I would like to point out several thingsthe see thru fireplace that I purchased with the intent of heating the basement I was told (by ***) after they had installed the fireplace ...that the gravity vent a mistakethat the fireplace that I had purchased did not have the ability to heat the basement.The exterior stone was applied in temperatures around degrees Farenheit.The blower on the second floor fireplace did not work.*** removed the doors from the see thru fireplace (between the family room and dining room) after I pointed out that the wrong stone was installed. I have pictures to document that there was nothing wrong with the doors..On estimate 1742, the blower is not operable.On estimate 1744, the wood burning pipe is not installed. The custom chase cover is not installed. The storm collar is not installed. The round top cap is not installed.. The chimney is not covered in stone.On estimate the gravity vent is not installed, and not available on this fireplace. The intent of this fireplace was also to heat the basement. After installation, I was informed that this was not possible.The exterior fireplace chimneys were not completed. The exterior fireplace was not completed. The stone was applied in 17-degree weather. The incorrect stone was applied. The exterior chimeny for the family room/bedroom fireplace was not completed.I was also told by *** that an arch could be imitated across the metal fireplace (the see thru fireplace) as long as it did not obstruct the vents). After installation he told me that this could not be done.When I walked in on Dec 9, I calmly told them that the colors were nice, but the wrong stone had been installed. The situation rapidly deescaleted. I have never wavered from my decision of the selection of "***". I have text messages that show my intent was to have "***" applied.I am willing to have a polygraph test to prove what I have stated is fact. I offered to pay for half of the stone (minus the cost of removing the stone and repairing the wall to apply the correct stone). Apparently this offer was rejected. Even though I was billed as if the job were complete, there were a number of things that weren't completed... *** ordered the work to stop on the fireplace outside (in degree weather) and told the workers to remove the tarps.

SEE ATTACHMENT.In response to your communication of January 17, 2017, in which you reported further complaints by the customer, I am responding on behalf of Bowling Green Fireplace & Grills.It is the position of my client that it has performed the contract with the customer in accordance with the written termsThe only exception is that the customer ordered our Workman off her property before some final finish work could be done and an inspection madeMy client emphatically deny any defective Workmanship or deviation from Contract terms.I would also report, that on behalf of my client, I have filed a Materialman's lien against her property in *** County, KentuckyVery soon, in the event that payment pursuant to the contract terms are not forthcoming, an action to enforce the lien and Collect the balance of the contract price will be commenced.If you have any questions, feel free to contact me.Yours truly,*** ** ***

complaints about workmanship or furnishing the correct material.My client is adamantly of the opinion that they have followed the contract precisely to its terms. They furnished the materials that are identified by merchandise number and signature of Ms. [redacted].The workmanship is excellent.Ms. [redacted] has been unreasonable regarding this matter. My client has attempted to resolve it with her by a reduction in price, while not justified by any of her claims, but solely to resolve the situation. She has agreed and withdrawn her consent to the agreement.My client is owed a substantial amount of money and it intends to seek legal action to collect that money. I am in the process of making the arrangements, at this point, to file the necessary liens and lawsuits to enforce the liens.This is just a matter that obviously cannot be mediated because of the intransigence of Ms. [redacted].I hope this will resolve your concerns.
