Bowman's Tree Service damaged my driveway while removing trees from my neighbor's yard. On October 22, 2014, Bowman's Tree Service removed trees from my neighbor's yard and drove their heavy duty skid loader up and down my driveway to haul the tree to their dump truck. This was done without my permission. I came home from work early and found them and their skid loader loaded down with trees in my driveway. Early in the morning that day we removed a tree located very near the property of Mrs. [redacted], working so close to Mrs. [redacted] property made it almost impossible to avoid some branches from falling in Mrs. [redacted] driveway. Immediately after this occurred Mr. [redacted] worker and owner of the Bowman's Tree Service company proceeded to speak with Mrs. [redacted] to offer an apology and explain the situation. Mr. [redacted] told Mrs. [redacted] that it might be necessary to use one of the machines to pick up the heavier branches to which Mrs. [redacted] agreed and replied stating that there would be no problem in doing so.Later that day, Mrs. [redacted] husband arrived home and when he did he saw one of the machines coming out of his driveway, he acted very upset and left to talk with Mrs.[redacted] and after with his wife Mrs.[redacted] who at the time was not home to clarify the whole situation. Evidently Mrs. [redacted] withdrew from what she had said that morning early in the week in her conversation with Mr.[redacted] and was not even willing to speak to him to argue the supposed damages she claims were done to her driveway. Mrs. [redacted] instead continued by calling our office to threaten us with bringing this case to court in order for us to respond before a judge for the damages caused to her driveway. The secretary who attended her call not knowing what had happened, suggested that she communicate with Mr. [redacted] because he was the appropriate person to attend her demands, but Mrs. [redacted] responded that she did not want to clarify anything, she would only speak to Mr.[redacted] when they were brought before a judge.Mr.[redacted] explained the whole situation to Mrs. [redacted] and together proceeded to speak to Mrs. [redacted] but she was not home at the time therefore they proceeded to review the alleged damages and took photographs of them as well, in Mrs.[redacted] driveway there is an existing damage that is not recent and could not have been made by the machine that had access to Ms.[redacted] driveway property only once.Luckily at the time when Mrs. [redacted]. and Mrs. [redacted] were reviewing the alleged damage and taking photographs, a son of Mrs. [redacted] arrived home. The Young man kindly greeted his neighbor Mrs. [redacted] who asked him if he noticed something odd in the driveway of his house to which the young man responded that he did not. Furthermore,Mrs.[redacted] asked him how the existing damage previously observed had been done to the driveway the young man responded that the damage occurred a long time ago as they parked a boat into their driveway.Our company is prepared to face this situation in court if it becomes necessary, we have enough evidence and testimony that our company did not cause any damage to Ms. [redacted] driveway,[redacted], [redacted].
