This letter is in response to complaint *** submitted by *** *** on 11/14/15.I have been a professional graphic designer for eight years and have designed books and dozens of magazinesand catalogsI disagree
with the "Customers Statement of the Problem" and the status of the customer's "DesiredSettlement:' I further believe the client is less interested in a reasonable settlement and is more interested indisparaging me and my company to others
I canceled the contract I had with the client on 10/23/after it became apparent that the client and I wouldnot be able to work together effectively to complete the project per her expectationsI canceled the contract inaccordance with the cancellation prevision of the contractI had designed two initial layout concepts in good faithwith the expectations that there would be edits before moving into the design of the bookI followed the designspecs and layout expectations as I understood themAfter I delivered the initial layout concepts to the client, severalunprofessional communications followed including a text at 4:51am the following morning
It was not until after I canceled the contract that the client began accusing me of"photoshoping" her images, notfollowing her layout and threatening me with legal actionI did not manipulate the color or photoshop any of herimagesI adjusted the resolution to make them print quality, per her provided printing specsI also followed her basiclayout but did add design features (features which we discussed before signing the contract)In our negotiationsbefore signing the contract, I told her bluntly that "if she was wishing to have someone simply transfer her Worddocument layout into a print-quality format, I would be a waste of her money because that is not what I do: I'm agraphic designer."
The client submitted the complaint with the Revdex.com on 11/14/requesting a billing adjustmentThe client does notinclude the fact that I offered a billing adjustment on 11/8/and requested a response approving or disapprovingof the proposal by 11/13/The client responded on 11/8/stating"! do expect more ofthe deposit givenback to me as this is the ethic thing to do:The client did not explicitly or implicitly agree to my proposal and did notcommunicate further with me before the 11/13/date I requested
Furthermore, the client stated that she had talked to another of my clients, unsolicited, to disparage meThat otherclient, who is still working with me, disagrees with the assessment of the complainantThis demonstrates that theclient is less interested in a reasonable settlement and is more driven to disparage me and my company
I have included in this packet a copy of our signed Graphic Design Agreement contact, the printing spec sheet, theletter canceling the contract, screen shots of several of the client's text messages, my email proposing a resolution,and the client's non-response to my proposal that includes the client's disclosure of the client's disparaging remarksabout meI also have saved audio files of the client's voice mails in which the client threatens me with legal action.Please let me know if you require any additional information

Complaint: [redacted]I am rejecting this response because of several reasons: 1. Justin never said the following to me during our meeting before signing the contract.: "I told her bluntly that "if she was wishing to have someone simply transfer her Word document layout into a print-quality format, I would be a waste of her money because that is not what I do: I'm a graphic designer." I communicated effectively that I required a book layout to prepare for print. 2. I did not bad mouth him to one of his clients. I was referred to him by [redacted], a family friend of Justin's, who gave me his cell phone number to contact him with any questions and concerns I had. [redacted] referred me to Justin. Justin's client is a family friend who he had designed several books (which is the experience Justin is talking about having designed 4 or 5 books of his) and [redacted] told me to call him with any concerns and questions that I had. [redacted] is an ethical and good person who believes in good business practices. 3. Justin had me change my photos from a JPEG to a TIF file. I spent 50 hours of my time changing the format and re-photo shopping the photos per his instruction. I am now working with a professional who told me that by changing formats, it destroyed the quality of the photos. He showed me the difference. I was mortified. Justin was going to put DESTROYED photos in the final layout of my book. It appears Justin is not a professional and does not know what he is doing. He did admit to me on the phone he photo shopped the photos. I told him I gave explicit instructions to not photo shop the photos. He did not deny photo shopping them. 4. None of the design layouts followed my simple instructions. Justin created layouts solely on how HE wanted them. I showed one of the layouts to several professionals and they all shook their head in disgust on how bad they were. I would not be filing a complaint if anything he said on the Revdex.com report was true. I believe in ethical and business practices. Due to the hours of professional time I lost due to wrong instructions from Justin, and his continuous mistakes I did suggest taking him to court for my losses would commence if he did not professional resolve this matter. 5. The contract also states I get the original design layout. He created a PDF which he locked and cannot be unlocked. 6. Non of my correspondence was unprofessional. It was honest correspondence stating that I was unhappy with his work and that he was not following instructions as discussed in the meeting and I should not have to pay for his irresponsibility. This is not unprofessional comments, but honest communication. I would not be filing a Revdex.com report if Justin returned the deposit and he cancelled the project after I told him that he was not following instructions and we spent many hours in 2 meetings discussing layout options. Justin has wasted hours of my time giving me wrong information and convincing me he could do the job and then cancels before changes can be made. He basically did whatever he wanted. Justin's last email suggested giving me an additional $40.00 of my deposit which he NEVER sent. Again, more dishonesty. With respects to the billing, any phone calls and emails was caused because Justin made one mistake after another. They were communications to get him to fix the layout as he refused to listen to instructions. Sincerely, [redacted]
