On June 24th, 2017 my daughter and I had an appointment to view mattresses that Mr. B. had advertised at a beginning price point of $150. However, upon arrival the dmattresses available for fpurchase were dmany times that advertised price. Since my daughter and her children jwere dmoving to a new apartment on August 1st and needed new bedding, we settled on 2 mattress sets with a total cost of $1600, taxes included. Since the bedding wasn't needed for several weeks,
I paid a $600 deosit on the 2 mattress sets and was sent an electronic receipt. On July 5th, I realized I would not be fable to complete the purchase due to an unforeseen lossmpof income. On July 7th, I called Mr. B. to cancel the order and was instructed to contact him the next day to discuss how to arrannge the logistics to gain a refund of my deposit as he was not, at that time, at his place of business. The following morning, when I called at the instructed time, my phone call went unanswered, and my voicemail was message was not returned. I sent an email with my receipt attached, offering to send my bankcard information to precipite my refund. Mr. B. responded to my email 27 hours later, stating he had a no refund policy. He further indicated he would keep my dedposit towards a future purchase. This policy was neither verbalized during the transaction nor indicated on my receipt. Furthermore, I have no indication when I would be able to move forward with this purchase and have subsequently bought air mattresses until such a time as my financial situation changes. Even though I thoroughly explained my dilemma to Mr. B. in a follow up email, (which also pointed out that there is no indication of his refund policy on the receipt he provided me) he declined to further respond and still refuses to issue the refund. I consider this to be fruadulent, unfair, and outright theft.

Ms. complaint indicated accurately that my business has Queen Mattress sets starting as low as $150 (and sometimes less expensive sets). Upon arranging a time to stop by, I informed Ms. that I have a selection of other mattresses as well that are 50-75% below retail store prices. Upon meeting with her, I also reviewed that I offer customers a selection of mattresses at amazing prices. She agreed to purchase and placed a deposit down on the mattresses. It is clearly stated on her receipt and in my location that all sales are final and deposits are non-refundable. Given her purchase and deposit, I ordered and received the mattresses that she desired. As a small business, it becomes problematic and economically difficult to stay in business when purchasers agree in good faith and purchase and fail to fulfill their legal financial obligation.

In response to Mr. B. excuse for not refunding my deposit: A. He advertised a "sale" that all *on-handinventory must be sold to make room for new stock, hence the reason for the "sale" prices. Reason would dictate that he would already have the mattresses he advertised on hand, therefore his statement that he had to special order the mattresses I was interested in just doesn't make sense. In addition, since it was made clear the mattresses weren't needed until August 1st, it's doubtful Mr. B. had ordered them by the time I requested a refund. By his own words he bragged how busy and successful his business is,so I don't believe that he is "stuck" with the two mattresses I wanted. B: As evidenced by the copy of my receipt from my transaction with Mr. B. NO WHERE DOES IT STATE NO REFUNDS. At the time of my visit to his business,there were NOT visible signs stating no refunds, and at NO time in our lengthy conversation or during the monetary transaction did Mr. B. verbalize his no refund policy. C: Mr. B. statement "Upon arranging a time to stop by, I informed Ms. ..." is simply untrue. I never called him to discuss the bedding or to set an appointment, so he never had the opportunity to discuss anything about his business with me. It was my daughter who initially contacted him and the beds were for her. In my experience,one untruth makes an entire story suspect. The facts are simply these: Mr. B.never informed me either in writing or verbally that I was entering into a contract with no recourse to recoup my funds in case of cancellation; if he had done so he would have NEVER received my money in the first place. I don't conduct business with people who resort to this method to make money. Furthermore, I never signed any contract indicating that I'm in agreement with, or that I even understood there was a no refund policy. I am absolutely entitled to the refund of my deposit. Anything less constitutes fraud by Randy B.

Mr.B. appears to consider my complaint as undeserving of his actual attention: note that both his responses are exactly the same. This makes one wonder how many others he has bilked of funds using the same verbiage that actually in no way excuses his behavior nor is it an indicator of doing business in good faith. I have reiterated, as well as provided a copy of my receipt, that at NO time was I made aware of a no-refund policy. This receipt is the only evidence of commerce between Mr. B. and myself, and therefore should be ample proof that I am entitled to a refund. I am determined to see this matter through every avenue, whether arbitration or legal, to recover the funds that are now being intentionally, willfully,and fraudulently withheld from me.
