Attached is Boyar's response to complaint # [redacted] , filed by Mr [redacted] On 02/03/the office received a phone call from Mr [redacted] requesting a cancellation of the contractThe reason given was not that detailed in Mr [redacted] ’s complaintRather, the client requested to cancel due to his personal health issue, which now caused him to sell the home and not move forward with the kitchen project Mr [redacted] originally contracted forOn 03/24/Boyar’s reached an agreement with Mr [redacted] , cancelling the contract and refunding all but $of the deposit to cover our costs for the design and administrative work performed on this projectThis case has been brought to resolution

Regardless of a paper warranty being physically in her possession, the client's warranty is already in affectUpon completion of the contract & payment in full the warranty becomes valid, not upon receipt of the formBoyar's will honor Ms*** warranty now, should there be any issueIt's unfortunate that we will now have a negative rating for three years against our business because of a formShe have this documentation as proof, until such time the forms come in and we can mail it out.Sincerely,

For your reference, details of the offer I reviewed appear belowI have attempted to return the calls from Melanie, but with no successThis is how it has been each time I have tried to call their office ever since I made the final paymentEach time I have called I am told she is not in the office. The contract does NOT state that drywall repair and painting will be required, as Melanie states in her letterI made the final payment after ** *** ensured me the drywall would be repairedHowever, then when they could not get their drywall person to do the work for less than a minimum amount, ** told me it could not be done and I was responsible for the repairs and at the most they would refund me $since that is what it would cost them This statement contradicts what ** previously told me about why their drywall repair person could not do it (because he charges a minimum amount)I cannot even get the HOA contractor/maintenance company who does this type of work for our complex or any other licensed and insured handyman to come out and give a written estimate for $They know that is may cost them $100, but that it will cost me much more just as how it cost me $for the re-surfacing of the cabinets but cost them much less than thatThe maintenance company our HOA uses has told me it will cost about $to repair the drywall based on the work they have previously done in my unit (in Nov 2014.) For your reference, details of the offer I reviewed appear below.I have been calling the company for months and no one ever told me that they were out of 'warranty paper.' The excuse I got was 'we are late on sending warranties.' Knowing that I had been constantly calling to ask, this issue was never elevated to anyone beyond those answering the phone calls which is still 'poor customer service.' Had someone from Boyar's just called and let me know that they had run out of paper and an approximate "date" of when I should expect to receive the warranty, that would have been sufficient. Instead the company just chose to 'ignore' my questions. Unfortunately, I have a hard time believing that the reason I have not received the warranty is that they ran out of 'paper.'Please let me know if there is anything else I need to do to close this out on your end. I do appreciate the assistance of the Revdex.com as sometimes this is the only way to get company's to respond

Once Boyar's gets your money then the customer service goes out the windowMy family has been without a kitchen for months! It bothers me to see my children amongst this messThe salesman Bill painted a pretty picture of how the process would beWhich were all liesI was told our kitchen would be measured and we would receive a 3D drawing within daysTwo months later and $8,taken from usWe have nothingWe even gave him the layout with measurements from another contractor and still nothing! Oh wait, I received a color sample and an email of a kitchen layout to approve, which you would think we'd sit down with him to discuss it since we're not kitchen cabinet expertsWhy did we hire him? Aren't they the experts not us? I trusted these people to create my dream kitchen, which this whole experience has been a nightmare

It was never the intention of Boyar’s to make any customer feel that their project is not important to usOn the contrary, all clients big or small, are all of equal importance. I initially spoke with the mother (which was a Friday afternoon) who was immediately expressing
that she wanted to cancelThis was after having signed the contract, after the project had already been processed, plans prepared, and a field measurement/inspection doneThe field measure appointment was initially postponed by the client by about two weeks until it was finally done, creating an initial delay in the project
I did explain to the mother I just needed a day or two to review all the paperwork, check the status to have all of the facts and see what I could do to expedite the completion of their projectSince this was on a Friday afternoon, I could not even start to look into the facts until Monday My next conversation was with the son on MondayI told him I am aware of the situation and will be in touch with him as soon as I knew the answers to their questions. Between the mother and the son, I expressed I just needed the opportunity to review the file, speak with the designer who been to the home and staff so that I could have accurate information to know how and when we could proceed to finish. Before having an opportunity to respond to either the son or the mother, I was contacted by the son and was told he wanted to cancel and wanted a full refund. I informed him we've already incurred expenses since the project had progressed into the final stages. However, I was willing to try and be accommodating or to come up with a reasonable solutionThat was unacceptable to him.
He stated he did not want to continue, was calling to cancel, and wanted a full refund of all money paid to date. I told him that since we had already incurred expenses in fulfilling his contract that I would have to see what amount could be refunded and could give that information to him the next morning. He responded that if he did not get all of his money back "he would do what he needed to do." That evening, within hours of that conversation, and without giving me the opportunity to determine what amount, if any, would be applied to the work done to date and refund the balance, he filed this Revdex.com complaint
It is never our intention to be unreasonableBut what is fair is fairThe project was postponed not by our doingI believe we reserve the right to be given a couple of days time to figure out what would have been the best course of action to bring resolution to the delays in completion. Also I was not even given to the next morning to determine what the refund would be. With that being said, we have canceled the contract and have refunded and mailed the customer a check for all but $of the over $2,which had been paid to dateThe $was retained to pay the outside vendor who went the their home and did the filed measure. The losses due to stopping production and costs for custom materials already purchased will be absorbed by Boyar’s. Thank you
