Complaint: [redacted] I am rejecting this response because:MsB***’s statements in Boyd Wilson’s response to my complaint contradicts the actions of the [redacted] Agent that I dealt with To paraphrase MsB***’s first paragraph, she is stating the agent would not have discussed the construction with me because it is years away and there is no construction schedule at this time.However, in a May 8th email response to my May 7th email, asking about the construction, the agent did not say that the construction was several years away, the agent said “To prospective renters, the construction has been disclosed” This written statement by the agent contradicts MsB***’s statement that construction was several years away and therefore there was no need to disclose.Emails are verifiable, I have a copy of the May 7th and May 8th emails, and I am sure [redacted] has copies of them too.Then additional confusion occurs when I, a prospective renter, was not informed of major construction to gut and modernize the townhouse next to townhouse I was looking at This was not disclosed before I put down the $ In fact, I don’t believe the agent would have told me if I had not asked, on my own initiative, about the constructionFrom experience, I know that this modernization process is very noisy I know because when I was at [redacted] in Horsham, PA , I experienced this noise and never wish to again However, unlike Old Hickory’s Agent, The [redacted] agent told me, before I put any money down, that this modernization was happening I suffered the unpleasant consequences of the modernization However, I can’t blame [redacted] because they disclosed this information before I made an initial deposit In contrast, The [redacted] Agent made no effort to inform me Only the unusual complexity of the lease, which indicated construction was to happen, motivated me to investigate on my own and discovered the pending major construction Unfortunately, the lease was not sent to me until I had put down the $depositAlso, MsB [redacted] is saying that they have no construction time lines or plans so I don’t need to be notified, but there are plans for major construction -- according to an October 3d, article in the [redacted] (see attachment) Why did [redacted] representatives say they expected construction to begin in mid if there was no timeline? Shouldn’t they have said: “we have several years due to regulatory hurdles before we start construction so we have no construction time line yet”?Therefore [redacted] Agent and [redacted] are acting in deceiving advertising practices by withholding from me, plans to gut and modernize the apartment next to me, as well as other major construction plans that would have adversely affected my peaceful enjoyment of the propertyHad they disclosed the information, they wouldn’t have incurred the costs of taking the town home off the market and background checks, as MsB [redacted] states in the next two paragraphs of her response, because I would never have chosen to apply at old Hickory.Sincerely, [redacted]

Dear [redacted] :Thank you for your letter of May 15, regarding a complaint involving advertising issues, [redacted] states that [redacted] failed to inform him of any major construction projects that are intended to begin on the propertyThe agent that showed him a townhome would not have discussed this information as there are no timelines or any construction schedules at this timeA land development plan is in the approval process with the Township that the property exists in; but at this time, potential Construction may be several years in the future do to firanting restrictions and regulatory loopholes,The application that [redacted] filled out to rent a townhorne at [redacted] states that it is a non-refundable applicationWe do have administrative expenses involved in processing the application, running a credit check, land Ford references etcFurthermore [redacted] stopped marketing the townhome that [redacted] was interested in renting, so [redacted] incurred damages by having to re-rent the townhome which had been taken off of the market for several weeks to prepare for [redacted] 's move-in.Therefore to respond to the complaint, [redacted] forfeited the application processing fee when he notified [redacted] that he would not be moving into the townhome that was reserved and made ready for his tenancyWe did return the security deposit of $to [redacted] when he informed us that he would not be moving into the townhame.Thank you in advance for your consideration,Sincerely,Lisa B***, CPM, AMS Vice President of Property Management
