March 27, 2017In regards to the complaint filed against Hamilton Equipment I will try to state our position,Hamilton Equipment is a wholesale distributor who sells through a network of dealersThe person who filed this claim purchased the item from a dealer in Bedford, PA who has an account with Hamilton Equipment.The [redacted] *** product was delivered to the dealer on the 19th of September can not say for certain the date where this product was picked up by their customer or delivered to their customer.At some point between delivery to customer and November 4, we received notice that the attaching bracket for the Bale spin-off was not latching properly and became detached and fell off unto the customer’s tractor, Hamilton's salesman drove hours to visit with the enduser and take photos of the bale spin-off in particular the latching mechanism the dealer did not attend this visitAt which time [redacted] the manufacture, was notified and they informed everyone that a latching spacer kit would be provided at no charge to correct the issueDuring the visit between our salesman and the enduser the reimbursement of damages to the tractor was never discussed.The customer returned the spin-off to dealer in Bedford and our Salesman visited with dealer on the 14th of December with the intention of taking the spin-off backThe dealer informed our salesman that they would keep it if the spacer kit was sent to themOn the 21st of December the spacer kit was sent to the dealer at no charge after receiving the kit from the manufactureOn the same day the dealer called and wanted a new spin-off which was delivered by *** Trucking on the 22nd of December Delivery fee was not charged for the replacement,A Return Goods Authorization was issued by Hamilton Equipment to the dealer for the return of the first spin-off on December 21, with the intention of returning to [redacted] for warranty considerations.As for the damage to the tractor, alter speaking with ***’s customer I was told the the loader with the [redacted] spinoff mounted on it was being used in a safe manner with the round bale was raised above the tractor hood for visibility to transport the round bale using the [redacted] product.The owners manual reads as follows:When transporting large round bales, keep load as low as practical to maximize tractor stabiltiy.Transporting large round bales on front loaders can limit visibilityKeep load low and go slow if visibility is obstructedAlways use extra care.Carry the bale slowly and as low as possible to the ground.For operator safety when using a front loader, always deep bale in front of tractor hoodNEVER position bale back over operatorALWAYS BE CAREFUL.On January 26th I received the intimate from D & B Restoration and Collision and photos for the repair of the endusers tractor hood;On February 13th the defective spin-off was received into Hamilton and I completed a warranty request for the Spin-off and repair estimate from [redacted] .The spin-off and warranty request was received by [redacted] on the 7th of March, On Tuesday morning of March 21, received a phone call from the end-user requesting an update on his claimI contacted [redacted] and was told [redacted] will not be held liable for the damages and received a copy of their Warranty policyAlso, I was informed [redacted] hooked the spin-off up to their Skid Steer loader and attempted to get it to fall off when pinned properlyThey could not get the unit to fall/disengage from skid steer.After receiving [redacted] s response I contacted the end user and this is where we are today.Sincerely,Jan R

At which time [redacted] the manufacture, was notified and they informed everyone that a latching spacer kit would be provided at no charge to correct the issue.
