This is our 23rd year as HPS and the first ever complaint to Revdex.com, with whom with are an Accredited A+ Rated member and proud of our record.Thus, I am most distressed to receive this letter, but do understand why [redacted] ***’s is seeking to justify compensationHowever, they have, in our opinion, provided less than the whole st***But, nevertheless, I have learned that the buck stops here, as the old cliché goesThus we will be willing to refund $1000, which is half before taxesIt is nice to know the $will go to a house of the Lord.However, there are some salient other facts to complete the picture and thus do our job to explain to Revdex.com that this is not a simply black and white complaint as portrayed, and, in the end, the church got a one of a kind, completely custom built special door and hardware which no other licensed company was evidently willing to tackle.Work onsite was actually done in to days, but we were remiss in not explaining to you directly, but rather to the office manager, [redacted] , the nature of obtaining the door blank for this strange size door, modifying it down to the right size for an inexact opening peripheryThen reconstructing the inner edge banding, the door surround which is capsulated in a concrete filled CMU block wall and foundation, thus fixed as built at less than perfect square, level, and plumb dimensions.What took so long was the fact that the door vendor had to do its work, then we had to set up a paint booth and do various coats of priming and finishing, allowing for proper drying time between stepsWe sent pictures of this process to [redacted] Did she show you them?Additionally, the contract stipulated we might not be able to start for to MF work days, which is more than a month, due to various factors, such as sourcing the door, having the vendor custom modify it, then having our supervisor do the extensive priming, and finish painting and weatherproofingTo be candid, there was a delay at the beginning due to other projects for this particular project supervisor, as well as he had some serious health issues affecting his finish of those projects, and his start time on the custom manufacturing process for this special challenge.Reverend, you may not be aware of all the communication, especially that we were not allowed to work on the property except on certain days and certain times, and that [redacted] forbid any work for a two week period for a spring break or vacation or traveling to a conference or somethingSo to paint a week blanket condemnation is not substantively true Additionally, it was not mentioned in your letter to Revdex.com that the original project was supposed to be in September, six months previous, when this particular one of a kind craftsman, [redacted] Chamberlain, was available for immediate work on the projectHere is something to help the Revdex.com and you see some other extenuating circumstances, which they may not have explained to you:“February 18, (Revised from Sept8, 2015)” .Aloha Again [redacted] and [redacted] : Please contact [redacted] directly for any questionsThank you for getting back to us on this and for understanding the “one of” custom made nature of the door and frame, etcas [redacted] explained originally (to [redacted] ) Gerald P [redacted] HPS Pres/GenMgr.cc [redacted] ..”Relative to the door inconvenience, I am sorry, but I was under the impression that the additional entrance referred to in your letter, was not a great inconvenience relative to the worn out door being removed to provide access and measurability to the previous site built framing around the opening of the cmu tile blockNor was I informed that your user of the kitchen were constantly complaining, and no one told [redacted] that access was a subject of complaints by the kitchen usersIn fact, [redacted] was told that they put a dead bolt on the other double door entrance in order to maintain control over the kitchen accessThey said that it would be no problem having access to the kitchen through the double doors.Nevertheless, I personally apologize for your and your staff’s consternation and trust that the $compensation will prove my contrition and humilityI am also certain that you and we do not want to get into a tangled he said, she said, etcword debateThus, please do accept my apologies and indicate your acceptance of this compensation, Upon receipt of said email, providing this shall bring appropriate and fair consideration financially without the continuing need to debate the chronology and mitigating factors, then we shall mail you the check

Complaint: [redacted] I am rejecting this response because:My complaint is that HPS withdrew the balance due upon completion from my checking account, without my knowledge or consent, even though the work specified by the contract was only 50% completeI am asking for a refund of $14,833.84, and not $15,445.75, as MrP [redacted] seem to imply in his responseNothing in MrP***' response offered a resolution to this complaintMrP***, when we both signed the contract, we were both bound by its termsHowever, your actions and your reponse to this complaint indicate that you believe that the terms only apply to me, and not to youIf you will not honor the very words you yourself put down on paper, then the contract is meaningless Sincerely, [redacted]

HPS RESPONSE TODAY: ***: I am sorry to see you trying to rewrite the record, breach the contract, unilaterally terminate us, kick us off your property, and not let us finish the project, and then attempt to create a fiction about wanting 50% of your money refunded
Your contract Disclosures-Miscellaneous complies with the Hawaii Contractor Law by disclosures HRS law 672E, which was established to protect contractors from exactly such brazen attemptsPlease re read that Also, you verbally approved the $1,charge as a change to the original payment terms since you did not allow us to proceed from the bottom floor to the main floor for about a month and on many other occasionsYou cannot falsely restate the record and claim a material breach of the contract when I offered to refund it that one small payment terms change to you and you said no need Furthermore, not only did you approve that change, but you also approved two further additional work orders for further payments, one a week later on 3-1-for $1,to remove and replace and repair many termite damaged ceiling joists which were discovered after removal of the old canac (to be replaced with drywall on all the ceilings) to be extremely damaged and unsafe And, even furthermore beyond that, days later, on 3-14-18, you requested more additional work and approved another charge of $to trim out the wall to ceiling junctions with partial round molding throughout the canac and joist repaired rooms Additionally, you terminated us with one hour work day left to complete the second additional client requested work order presumably so that you could try to say that we weren’t finished So even that is a blatant specious attempt to poison the well unfairly and unlawfully relative to contractor lawsThat is because although you said the flooring was available, you now will not give access to it for the two (2) man days left to install it, and the one (1) man day left to install the sink base kitchen cabinet and small wall cabinet you bought from Home Depot and told me was outside ready to be installed. Our workers were in Mililani and one also tending to his wife with terminal stage cancer and unable to meet your unilateral dictate of only allowing them until noon Friday 3-30-to pick up their, not HPS’, toolsThat is additionally unfair, and hopefully you relented and allowed Vincent to come over thereIf not, then to consider them abandoned on your own unrealistic terms, is to be considered an illegal ransom or worse, theft There is no basis in fact, nor legally, to demand 50% refund, when the project, delayed by you intentionally on several occasions, and for over a month, only required four (4) man days to complete (other than you having Home Depot install the granite top and sink) I am sorry you have money problems, but we will not allow this no-basis-in-fact, unilateral falsehoods, and obvious manipulative attempt with no legal basis claim, in fact directly in violation of HRS 672E laws, to build up your money at our expense There is no reason other than your financial problems to not allow us to finish the last four (4) man daysPerhaps you ran out of money to buy the flooring, or pay Home Depot for the counter top and installation…I don’t know, and it doesn’t matter legally or ethically The laws (again please re read) instruct you (and us) to get to the truth and attempt to negotiate a MUTUALLY SATISFACTORY settlement if you simply don’t want us back, although Vincent said you have been very nice to him and the othersYou nor us are allowed to file any legal claims during this legally mandated “cooling off” period which is I believe to days Furthermore, the contract specifies mediation between us, or, if that fails, then arbitration…..not through the court system However, we are in a superior, strong, unshakable legal position, with decades of legal counsel advice and experience, and your breach is notRemember, we did not breach and you cannot rewrite the facts weeks later that you approved that small payment Your position in your faxed letter and email is specious, illegal, false, and laughably presumptuousIt is better to follow the contractor law and agree to try to compromise and reach a mutually satisfactory settlement, or allow us to complete the project unless you simply don’t have the money to purchase the flooring Please remember that it is further damaging to your presumptions and illegal under the contractor laws to simply hire someone else or try to finish it yourself, thinking you will gain $15,at our expenseWith four (4) days work left, for you to claim the project is only halfway done is simply not legally or pragmatically supportableIn fact, it’s really a blatantly thoughtless subjective joke, in case you want to get a feel for how hard a fight you have tried to start If you do not take the route of compromise or allow us to finish, and think you can plead “woe is me” in mediation, arbitration, or worse yet in the court system, then remember any proceeding involving attorneys will further worsen your financial situation We are not the chopped liver, ignorant blue collar people your ridiculous claim presumesWe can afford attorneys….and are not afraid of complaint because it will be dismissed for insufficient factual evidenceWe know this road well PaulThis is my 25th year of HPS, and 45th year of a lot of legal and paralegal training and experience I hope you will reconsider your approach as required and as I mentionedBut if you don’t, you don’tWe are ready to stand our ground 110% against this attempted robberyIf you don’t believe me then ask an attorney familiar with contractor law, and not just an non specialist attorney who would love to charge you $200-$an hour Gerry P*** for HPS
