Aqua Finance, Incand MBC Investments, LLC are in receipt of the complaint filed by Mr***. We maintain the position that Mr*** is responsible for this loan based on the circumstances surrounding the co-applicant's bankruptcy filing. If Mr*** has questions regarding how
a Chapter bankruptcy works with an ex-spouse in his state, we recommend he contact an attorney. We have provided Mr*** with documentation regarding the outstanding loan in September and October of 2015. On February 9, we spoke with a representative from a Credit Agency asking if arrangements could be made on the loan and we state that we would be happy to work with Mr*** on a repayment program. If he has any further questions, he may contact our office at ###-###-####. Thank you. Katie ***AVP - Compliance***

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]To whom this may concern,After looking over the documents that I received I still see nothing regarding the matter at hand. Until several months ago I had never heard of this company and check and open my mail daily. Had I seen this before I would have began investigating it much sooner. However at this time I feel that I need to look back further into this matter and will be contacting them directly as soon as I can obtain more information

This communication is in response to Mr. [redacted]' complaint  filed on November 23, 2017.  We take complaints seriously and have conducted a full investigation in to Mr. [redacted] file.  We offer the following findings.  Mr. [redacted] states he financed a water treatment system...

through Aqua Finance, Inc. in 2009.  This is incorrect;  Mr. [redacted] loan was financed through [redacted] in December 2009 and was subsequently sold to MBC Investments, LLC in July 2017.  I have attached the supporting documents that show Mr. [redacted] was notified that his loan was sold on August 8, 2016 along with copies of his signed loan documents.   MBC Investments, LLC cannot attest to Mr. [redacted] attempting to make arrangements with [redacted], however according to the account history, numerous attempts to contact Mr. [redacted] were made by phone and mail.  The UCC Fixture Filing Lien Mr. [redacted] refers to in his complaint was filed by [redacted] in December 2009.  MBC Investments, LLC is sensitive to Mr. [redacted] financial hardship and has options to assist him.  If he would like to arrange for repayment, he may contact our office at ###-###-#### extension [redacted].  Thank you. Katie [redacted]AVP - Compliance[redacted]

We'd like to thank Mr. [redacted] for forwarding his concerns to our office.   Mr. [redacted] recently received a letter from MBC Investments, LLC.  He also received a letter from MBC Investments, LLC on August 17, 2016 stating his loan had been sold by Carmel Financial.   Mr. [redacted] obtained...

a loan through Carmel Financial for a water treatment system in 2006.  I have attached the contract and credit application for his review.   Mr. [redacted] states he contacted our office three times and spoke with a representative.  Unfortunately we have no record of this.  If Mr. [redacted] would like to discuss further we recommend he contact the appropriate department at [redacted].  Thank you.   Katie [redacted]AVP - Compliance[redacted]

Mr. [redacted], MBC Investments, LLC will not remove the UCC Fixture Filing Lien without payment.  When the lien was filed it is attached to the home.  We empathize with your frustrations which is why we are willing to negotiate a manageable amount with you to satisfy the lien.  If you are interested in doing this, please contact me at ###-###-#### extension [redacted].  Thank you.  Katie [redacted]AVP - Compliance

We are in receipt of Mr. [redacted]'s complaint stating the product was returned.   Unfortunately we show no record of the Water Treatment System being returned.  Our records show that Mr. [redacted] purchased the water treatment system in November of 2006.  His last payment was made...

December 7, 2009.   MBC Investments, LLC purchased this account from Carmel Financial in July 2016 and the last conversation we show with Mr. [redacted] was with Carmel Financial on May 13, 2010.  At that time he stated that he had lost his job and was unable to make further payments.  No contact was made with Mr. [redacted] since then and we have no documentation to support the water treatment system being returned.   If Mr. [redacted] has proof of this, we kindly ask that he forward the supporting documentation and we will review in detail.  If he has any questions he is welcome to contact our office at [redacted]  Thank you. Katie [redacted]AVP - Compliance[redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The document that the company provided shows that I signed for a joint debt, which I myself previously stated. Said debt was included in a bankruptcy. I have correspondence between my ex-wife and the company. In that correspondence the company said that they would be retrieving the water system from the home and the debt would be cancelled. The company closed the account (which was joint) and reopened opened it with solely my name on it. The company continues to add, if I have any questions to call. I have called and left a message, with no return phone call. My complaint remains. This company uses poor business tactics. As far as the contract is concerned, I will take legal action.
Regards,
Derrick [redacted]
