Brandon Stimetz Painting

On November 8, 2019, *** contracted with Brandon Stimetz to paint various areas of her home; build two sets of shutters; re-install soffit vents; and install door knobs. The agreed price for this work was $1,800 plus paint for the hand rails. Mr. Stimetz requested a $725 deposit for this work which *** paid. Mr. Stimetz took a quart of special mixed paint owned by ***. Per the attached text record from Mr. Stimetz, on November 17, he told *** he should be able to be at her house Tuesday, November 19, but he never showed. On multiple occasions thereafter, Mr. Stimetz repeated his promise to begin the work at ***’s home. *** was concerned that the weather was going to turn cold and Mr. Stimetz would not be able to finish the work because the painting required two days at approximately 50 degrees or better. Mr. Stimetz and *** discussed Mr. Stimetz at least sanding the railing, and completing other work not contingent on warmer weather. Mr. Stimetz said he would come to ***’s home but other than the day he came to collect the deposit, he never showed again. Mr. Stimetz repeatedly had excuses as to why he did not show or reasons he could not start, i.e., he was painting cabinets for a client, he was in court in St. Louis or he was installing a floor for his father. On December 22, 2019, Mr. Stimetz said he would be by to begin sanding ***’s railing. He did not show and he did not call. At this point *** had lost confidence that Mr. Stimetz would complete the work he agreed to do and *** requested a refund December 23, 2019. Mr. Stimetz has not done any of the labor nor has he purchased any materials. Per the attached email, Mr. Stimetz agreed to return ***’s paint she gave him plus the $725 deposit but to date he has not made any attempt to do so.
