I am rejecting this response because: I am rejecting this response because: This most recentresponse from *** *** is actually an old one he sent me and it isactually inaccurate and has inconsistencies that I would like to clarify and/orcorrect in addition to pointing out some facts.First, *** states he does not recall accepting full responsibility in regardsto missed appointments on numerous occasions because his employees failed toshow up but I do have a voice recording that I will provide to the B.B.Bthatspecifically and clearly records *** stating that he guarantees that is exactlywhat happenedIt also is recorded with *** apologizing morethan once for those missed appointments.Next *** states that not all policies are published in the Home Owners Manual.My response to that is that his statement is rubbish and shockingBraseltonHomes’ internal policies apply to me no more than Home Depots lunchbreak policyHow ridiculous is it for *** to say he is holding me and mywarranty claim to a policy or policies that I not only do not have a copy ofbut I am also not aware of?It is like saying that Home Depot allows me to use their bathroom but tells meafterwards that I must scrub the toilet and mop the floor after I have used thefacility and reference a policy they have stored in their officeIn a previous scheduled repair for a separate claim thecontractor not only did perform the repair on a weekend but he also stayed past4:00pm and continued working until he finished so that further proves that ***is being unreasonable and is only referencing these so called unpublishedpolicies when it is convenient to him.Not only is *** stating that not all policies are listed in the Home OwnersManual but he later references that very Manual stating he is sending me acheck per that Manual Policy for the value of the warranted item.That check was in the amount of $and the letter stated it was for thecrack in the drywall but there was no check for the door frames or the otherdamaged drywall that his contractors caused when repairing a separate claim ona hanging door nor was there a check for the flooringI did not cash that check because I do not believe that wasthe only warrant-able claim that Braselton Home is responsible for as outlinedin my claim and that $is not nearly enough to fully cover the cost toproperly repair the cracked drywall by a licensed company.Any professional company would provide at minimum three repair quotes fromlicensed companies and provide those estimates along with a check that totalsthe average cost of all three quotes/estimates which *** did not do butinstead writes a check for $without providing a statement that shows howhe reached that repair value estimate.Regarding ***'s statement that none of his employees recall committing torepair all items on my schedule I must also disagreeI have a voice recordingof his Warranty Manager stating he will not only repair the cracked drywall buthe will also repair the door frames and any other damage that may occur as aresult of them repairing/replacing the frames and he will work with me toschedule the repairs/replacements at a time that works for both parties.*** references unpublished policies, he doesn’t recollectstatements he made, his employees do not recollect making certain statementsand he refuses to provide me with a copy of the Flooring Manufacturer’s investigationresults and states it’s because those findings/results are proprietary***also refuses to try to work with me to come up with a repair schedule thatworks for both parties despite the fact that he flat out guaranteed that it ishis companies fault that appointments were missed (which caused me to loseincome by not only taking time off of work so that I could make it to theoriginal scheduled appointments but also when I had to take additional time offof work to make it to the rescheduled appointments).*** has not tried to compensate me financially for my lostincome nor has he tried to work with me so that the repairs/replacements can beperformed.I would also like to point out that *** first respondedsaying that only the cracked wall was the issue but when I providedphotographic proof of the other areas in disrepair he did not dispute them butinstead referenced unpublished policies and states the flooring investigationresults were proprietary.I do not wish to go back and forth providing photographical,written and audio proof and I do not wish to entertain ***’s inaccurate andunsubstantiated rebuttalsInstead I will accept a final compensation paymentin the amount of five thousand dollars ($5,000.00) from Braselton Homes toclose this matterIf *** does not agree to pay that full amount or if he doesnot work with me to repair each item/area that I have mentioned in this claimthen I will provide a copy of all written, audio and photographic evidence thatI have that prove my case to the B.B.Bso they can record said information intheir records to use for their evaluation(s) to rate/score Braselton Homes andto provide copies for the public as allowable by applicable laws.If *** does wish to financially compensate me to close thismatter but disputes the settlement value then I am willing to acquire threeseparate quotes for each item in this claim (flooring replacement, framesrepair/replacement, cracked drywall, warped drywall and damaged drywall plusthe cost of labor and materials) if *** will pay for the fees for thoseestimates and I will then settle in the amount of the value of those separaterepair/replacement estimate averages plus $1,which is to be paid in fullto me by Braselton Homes without further stipulation(s) from *** and/orBraselton Homes

Complaint:[redacted]Please note that I have tried multiple times to add pictures and I have also tried to add a PPT and it will not allow me to proceed. Please send me a business address or an email address that I can send the copies of photos and voice recordings.I am rejecting this response because:Braselton Homes is fully responsible to repair all areas that I have brought totheir attention or they must pay in full the cost for all required material(s)and pay for a licensed company to perform all the required work to complete allthe repairs.In this response I am providing details about my claims and willalso include a response to [redacted]’s reply to this report.First and foremost I must list the areas that I have brought tothe attention of Braselton Homes for repair/replacement. Additionally I mustalso provide a rebuttal to [redacted]’s response and further clarify my position onwhy I am holding Braselton Homes fully responsible to either make all therequired repairs and/or replacements at a time that fits my schedule or theymust pay in full the total costs to purchase all required materials and thetotal amount to hire a licensed company of my choosing to make all the repairsand/or replacements. Regarding the flooring: I filed a claim with Braselton Homes becausethere is warping and gapping on my flooring in numerous areas in my home.Braselton Homes sent their Warranty Manager to inspect the flooring and as aresult of that inspection Braselton Homes Warranty Manager stated he wouldschedule an appointment for the flooring manufacturer to inspect the flooringto determine if the warping and gapping was a result of a defective product orif it was due to improper installation.Just by this action alone proves that Braselton Homes agreed thatthere was enough significant warping and gapping that justified further actionsto have the manufacturer inspect the flooring therefore the report submitted bythe flooring manufacturer must be provided to me as it is evidence and does infact contain results of why my flooring is warping and has significant gapping. Regarding my interior door frames: I filed a claim with BraseltonHomes on my door frames because there is significant gapping between the bottomof the door frames and the flooring and there is drywall damage that needs tobe repaired that was caused by the contractor(s) that Braselton Homes hired toperform certain repairs on a separate other claim. As a result the BraseltonHomes Warranty Manager scheduled an inspection and as a result of thatinspection the Warranty Manager stated that they would try to make repairs orif the repairs were not acceptable then he would have his contractors replacethe door frames and repair any and all damaged drywall(s) that was caused by thecontractor(s) replacing the door frames. The Warranty Manager also stated hewould work with me to have the work performed on my schedule. Please note thatthe door frames have nothing to do with my floor claim.This conversation waslegally recorded by me and I will mail a copy of said recording(s) to theB.B.B. as soon as I am provided with an address. Regarding my cracked drywall: I submitted a claim for the crackeddrywall in the Master bedroom to Braselton Homes  and their Warranty Manager inspected the crackand stated he would have it repaired. I also have this conversation recorded. Regarding the warped/leaning fence: I brought to the attention ofBraselton Homes Warranty Manager that my fence was leaning outward toward myneighbors house. He inspected the fence and stated he would have someone comeand repair the fence which has not been done. I have this conversation recordedas well. Regarding the dishwasher: My dishwasher is not operating properlyand Braselton Homes stated they would have a service professional come to makethe repairs. No one ever contacted me and no one ever was scheduled to comemake the repairs. Regarding warping on areas on my walls: I submitted a claim for significantwarping on my walls to Braselton Homes. They have not made any repairs.  Braselton Homes, in their response to this claim, states they havea policy of not starting a project that they cannot complete during the workdayavailable. In response to that I must clearly state that there is not a singlepolicy that states this in the Warranty handbook that Braselton Homes gave me.In fact, the handbook they gave me specifically states that appointments areavailable most weekdays between 9:00am and 4:00pm. Furthermore it furtherstates that if a subcontractor is required to complete the repair(s) BraseltonHomes will notify the appropriate company(ies) and I would be contacted to schedulethe needed work and it also states that completion of services can be expectedto be completed within forty five (45) calendar days unless otherwise notified.The phrase that states appointments are available most weekdaysdoes NOT provide and/or list any exclusion(s) regarding the weekends nor doesit identify any limitations on the number of visits/appointments allotted tocomplete the required repairs(s)/replacement(s) and it does not lists anylimitations on when the work can/cannot start within the parameters of 9:00amand 4:00pm. I would also argue the fact that if Braselton Homes hiressubcontractors to perform the services then I would think that the work can andshould be allowed to start at any agreed time and date if it so suites both thecontracted company and myself.In closing I must clearly state that Braselton Homes has also costme to lose income on several occasions because I took time off work in order tomake scheduled appointments that they failed to show up for despite receivingphone calls from Braselton Homes day(s) prior to said scheduled appointments toconfirm the appointments were still taking place. I have a recordedconversation between [redacted] and I that clearly records [redacted]admitting fault to those missed appointments.I also have numerous photos of all areas that I have filed a claimon as well as other photos during the construction phases of my home that Ifeel may be questionable as to whether or not follow and/or are withinacceptable building codes which I can also mail to the B.B.B. for review.I will state that all voice recording I have were done so legally(reference Texas’ “One-party Consent” Law).Additionally I am including a photo copy of a portion of Braselton HomesService Policy and some pictures of some of the areas I have filed a claimagainst. Unfortunately I am limited to just four photos so I ask for the B.B.B.to provide me with an email address or physical address for me to sendadditional photos and/or the recorded conversations.     Regards,[redacted]
