I am rejecting this response because:As per our sales person, ***, the entire contract was contingent on us being able to secure financing for the poolI have attached a copy of the contract, with Jordan's signature and ours, with the statement added:Contract contingent on favorable financing towards the end of Planning to build March 2018.At the time we were working with Jordan, we still had not finalized purchase of the houseThis and other factors were weighing on our minds about being able to get financing so soon after the home purchaseHe assured us when we were discussing the designs and contract that if we were not able to obtain financing, we would be able to have our deposit returned. Seeing that there has been no work done at the house, at all, and we are not planning to put in a pool any longer, any plans that we had will not be used in any fashion in the futureWe request to please have the deposit returned.

This plaster invoice was paid prior to this complaint. [redacted] has cashed the checks and I have forwarded the proof of payment with the homeowner. I am waiting on the homeowner to withdraw the complaint and I will continue to work with [redacted] to remedy this...

Mr. [redacted] is correct that he may cancel his contract if he is unable to obtain financing. However, his contract also clearly states "Down Payment is considered a "Design Fee" and is non-refundable after screenshots or plans have been given by BCP to Homeowner." This clause is to protect Bravo...

Custom Pools intellectual property. I will release Mr. [redacted] of his contract due to his circumstance but since he has been given his design we will not be refunding his design fee.
