Re: Fraudulent Claim from [redacted]

Revdex.com Complaint ID [redacted]

Summary: Bravo Pet food conducted a recall/market withdrawal of selected Bravo products in the fall of 2014. The recall allowed customers who had purchased and still possessed qualifying products to dispose of them for replacement product or a full refund. The terms required that the customer provide proof of purchase in one of two ways:, a receipt from the store from which they bought the product;  or, submission of a form signed by the retailer verifying that they carry the Bravo products involved and that the consumer was likely to have bought it in their store (a ”known” customer).

Claim from: [redacted]

The above---mentioned consumer claims that we have not complied with the terms of the recall  and has demanded an immediate refund. Bravo believes that this customer has not submitted a legitimate claim and in fact is making a second attempt to claim a refund under the terms of the September 2014 recall based upon the following:

First claim: The customer submitted a cclaim with a retail value of $332.89 on October 30,2014, covering a variety of Bravo products. The claim was
submitted under the name of Denise Montoya but they requested the check be issued to [redacted] and sent to[redacted]. That check was issued and sent on November 10, 2104. Due to the driving distance from the customer’s home,
Bravo made an exception and did not require the customer go to the store and submit either form of the required proof of purchase. A copy of that claim form which Bravo completed on the customer’s behalf is attached. This exception was granted despite the fact the retailer in question stopped selling the products involved on July of 2014. We assumed the customer had mistakenly identified where they purchased the product.
Second claim: The customer again submitted a second claim on January 9, 2015 for the same products but with slightly different quantities involved with a retail value of $285.00. They stated that they had once again bought them at a retail location in [redacted]., approximately 110 miles from the customer’s home.

The name of the person making the claim was now [redacted] using the same return address for payment, [redacted]

When the claim was not paid immediately, a person now using the name [redacted] began complaining on the Bravo Facebook page that the company was not standing behind our products per the terms of the recall.

Over several days, Jan 29-- 2015 to February 3, 2015,[redacted] conducted a libelous online smear/attack campaign on the internet. She/he has also submitted complaints to the Revdex.com of CT. along with threats to take her case to court and the FDA unless the claim was paid promptly and without further delay or question(s).

On February 2, 2015, Bravo offered to replace the product she had reportedly bought and disposed of until it became clear that [redacted] (Claim #1) and [redacted] (Claim #2) were one in the some person living at [redacted]
As well, the customer once again reported the store was “too far from their home” to allow them to gain proper proof of purchase and no receipt had been kept.

Bravo’s suspicions that the claim may not be legitimate were further verified by an unsolicited email from an SVP at the retailer in question advising us of the following regarding [redacted] et al.:

“We suspect this is a scam and we are planning on informing her that unless she has both the product and a receipt that she will need to deal directly with you guys (since so much time has passed and we have not stocked the product in some time). She has gone by the name of [redacted]
This customer has been communicating with Bravo over the course of both claims via email and phone (one call from our Founder, Bette Schubert to the customer during resolution of Claim #1 and discussion of Claim #2) under various names and email address as follows:

Names: Skye Gregory, Karyn Patrick, Denise Patrick Parkerson, Karen Montoya, Skye Montoya, Denise Montoya
Email addresses: [email protected], [email protected]
In Bravo’s judgment this customer did not submit a legitimate claim in November (Claim1) and is attempting a second illegitimate Claim #2 in Jan/February of 2015.

As such we have removed their comments from our Facebook page, blocked them from further access to our social media sites.

Bravo has also referred this claim and the associated actions by the customer to our legal counsel , Diana, Conti & Tunila, LLP, 1091 Main Street, Manchester, CT 06040, 860-643-2181 for further action as required.

Bravo will continue to pursue our rights until such time as the customer can provide legitimate proof of purchase.

Full documentation of various claim forms etc are attached as a pdf.
