Review: Brea U Stor has been properly notified of my vacation of one of their units yet continue to refuse to return deposit and is now sending me new billings for current months.

I attempted by personal co09mmunication as well as telephone, voice mail, email and even posted notice on [redacted] as they were refusing to acknowledge or return any forms of my communication. Finally had a conversation with the owner and she refused to acknowledge any of my attempts.

I submit that she is maliciously implementing business practices that adversely impacts consumers and serves to line her own pockets with frivolous and illegal contractual policies.

Claiming not to receive multiple communications and denying service of written notice as well as denying personal notice all of which were issued to Brea U Stor prior to the required 20th of the month is disingenuous and self serving and is tantamount to theft.

Now their practices are including additional billing practices when she has been served all required documents and been duly and properly notified. Verbal notification came with two witnesses.Desired Settlement: My goal is to have business owner acknowledge my vacation of the unit [redacted]. Accept its return without any additional charges from September. And return my deposit in full. And cancel all fraudulent billings that they are issuing now.

In lieu of that legal action will be taken and that will include airfares and hotel lodging which I don't thing the storage unit folks want.

Review: Dear Revdex.com, I am currently renting 2 storage units from Brea U Stor, I have had these units for approx 1 year or longer I have paid my storage rents every month, not on the 1st, but always have paid & I have paid all late fees with no complaints UNTIL March 27,2014An employee named '[redacted]' had made a reminder call to me a couple of days before Mar 27th, reminding me to come in & pay my rents, at that time she told me that I was behind & that I needed to pay before the 29th or I would be charged an additional $50.00, I had agreed to come in & pay before the 29th. When I went to the office, [redacted] had totaled my [redacted] to $501.00 ! My rents are unit #[redacted] $290.00 (without penalties) & unit #[redacted] $141.00, My penalty fees were as follows; $10.00 late fee if not paid by the 10th & addition preliminary lien fee of $25.00 if not paid by the 15th ? total $35.00 penalties for each unit, My complaint is this employee stated "if you pay your rent on time you won't get these fees" I complained to the mgr "[redacted]" & he stated that she was correct & that she is a outstanding employee, 2nd complaint is that this company has raised these fees $10.00 & if I did not pay by the 29th an additional fee to $50.00 ea unit for the same 'PRELIMINARY LIEN FEE" which I believe is cheating the tenants ( how many PRELIMINARY LIEN FEES CAN BE CHARGED IN ONE MONTH WHEN THE TENANT IS NOT A FULL MONTH PAST DUE ? ), my 3rd complaint is the mgr '[redacted]' would not release the corporate information to allow me to call & confirm these business practices & to make a complaint on the employee '[redacted]' - I have paid my rents including all penalties every month with no complaints but when these fees are increased & brea u store will be duplicating a preliminary lien fee, I have concerns about this, Thank You for your time, [redacted]

Now this will be the second complaint on this Company because I received a phone call from the mgr "[redacted]" & he left a message on my answer machine telling me that because I filed a complaint on him, He now will EVICT me I have taken this as a threat & I am concerned about my personal belongings that are stored at the Brea U-Stor property Also I have recently found out that a property Mgmt company oversees Brea U Stor, I called & went down in person to talk to "[redacted]" & he seemed not interested about this threat of his employee, I offered him to listen to the recorded threat of evicting me because of my complaint to the Revdex.com & he told me that he was not interested at all & told me if I was so concerned about my belongings, to move ! ( The costs of moving is a lot, I have a 10x30 & a 10x5 completely full, I feel because of his employee threatening to Evict me is retaliation because of my complaint & the Company should be responsible.Desired Settlement: I would like the legal procedure to be mailed to me & each & all tenants about the fees that Brea U Stor & All Storage business are allowed by law to apply these fees & All Tenants/Unit rentalsWhat is the law on these storage companies & are they complying & If they have broken the laws & if so, All tenants be reimbursed the non allowable Penalties & fees What are the allowable fee rates & allowable time lines of these increased fees, also can the storage companies charge duplicate fees

Response:

This tenant was sent a letter in November stating that this fee was going to be increased starting January 1st 2014, It is within California Storage Laws to Have this fee at the rate we raised it to. Which is the standard rate that all storage properties charge in California. When Tenant was shown a copy of this letter she claimed that she probably didn’t open it. I had made a call to her on the 14th of the month also telling her if she wasn’t in by the 15th of the month she would have the $25 dollar fee added to both of her units. She has previously paid the $15 dollar fee many times since she is a tenant that very rarely pays her storage fees on time. This tenant has tried to “bully” things in the past to get her way.

Also we do not charge 2 preliminary lien fees. The $50 is a Lien fee that after 28 days of non-payment their property goes into lien. We do not charge this fee until the 3rd of the following month. All of these fees were explained to the tenant when the storage unit was rented, and also with the letter that was sent to all tenants in November.

Attached is the letter that was sent to all of our tenants in November.

**Regarding the second complaint. Yes there was a call to her made regarding a possible eviction, If a tenant is complaining about our service and does not want to follow policies that she agreed to when she signed the lease we have the right to terminate her lease. We have not sent this tenant an eviction notice but she is currently removing her belongings.

[redacted] and [redacted] the employees that work at the property do not feel comfortable with her making the claim that she is concerned about her belongings, we feel that she is accusing us of possible stealing and we feel she may set us up in a lie. We have security cameras on our property and I did record [redacted] on our property to protect myself against any claims she may possibly make.

I have been in the storage business for over 10 years and I know the procedures regarding fees that can be charged. In fact we do everything possible to try to avoid people receiving these charges as we make calls to the customers before these fees will be charged so they can come in and pay them. And this tenant has received these calls EVERY time she has been late. This is a courtesy and not a requirement so if we were out to get more money from our tenants we would not make these call.

This tenant has been told by myself and the owner of this company that if they aren’t happy with our services they can move out. I have been with this company for about 8 months and have never had a single problem with any other tenants and in fact many of our tenants have loved the changes we have made and the services that we have provided them. We also feel that this tenant is one of the “type” of people that if they don’t get their way they try to cause trouble and that they like to use bullying tactics to get what they want.
