Hi, I spoke to Mrs*** and informed her that because she canceled the project after signing our "design fee" form that she had forfeited her refundWe had done the site survey, and started the design for her projectWe had also made several trips to the county office for form to submit for her
permitShe called and stated that she had an "out-of-town" family problem that needed her attention and she wanted to cancel the projectTherefore it was clear to her that she would lose her deposit (since the design & filing process was almost complete)As far as the requested "$10,000" she mentioned her complaintIt was clear to her at the time that Breach Builders was NOT requesting that amountThe fabricating company was the one requesting paymentThanks!

At no time did Mr. [redacted] indicate to me that I had forfeited my refund.  If this were true, why would he have issued me the [bad] check (see attachment to my initial complaint)?I am forwarding to you additional documentation for your review. Thank you for your attention to this matter.Sincerely, Dr. [redacted]

At no time did either my representative or I state that the check was not enough money.  When I took the check to the bank, the teller said that there were insufficient funds to cover it, and that I definitely do not want to deposit it.  Two tellers said to me that there was something drastically wrong, but that they were not able to tell me what it was.I reiterate that I checked with the city of Jurupa Valley more than once, and was informed that no one had been in to pull permits on my behalf.  This is the location where Mr. [redacted] would have gone, because of the location of my property.I also want to point out again that the $5,000 deposit was well over the amount that I legally should have been required to pay.If Mr. [redacted]'s intentions are truly honorable, I believe that he will re-issue a refund check to me at this time.Dr. [redacted]

I explained to Mrs [redacted] that we would be working on the design for the room addition, the plans and application for the permit. We did collect a design fee/deposit upfront and she signed the agreement and the estimated cost report. She signed all the paperwork authorizing us to do the design work. We completed the design for the room addition and the floor plan layout. We had a meeting with Mrs. [redacted] to submit plans for her approval. She approved and signed the application for the permits through the county. We went to submit and was told we needed to survey the site and show the corner points. We went back to the property and surveyed the entire property to make amendments on plans. We were pre-approved for the permits when I received a call from D [redacted] indicating that she had a family emergency and needed to cancel the whole project.I spoked to [redacted] on the phone and told her I would access the time and work we spent and would send her the balance. We sent a check to her as she indicated. We sent everything certified mail with a signature request. She never cashed the check. Six weeks later we received a call from a family representative on her behalf and when I told him that we sent a check, he replied saying she didn't cash the check because "it wasn't enough money". So we issued a "stop payment request" through the bank. we never issue bad checks, but we do stop payment when funds are refused!
