Initial Business Response /* (1000, 5, 2015/09/04) */
Breathe Therapy is very disappointed that we must defend our great services against this false claim - and we will not give-in to the unjustified demand of Mrs. [redacted] to give her money.
Mrs. [redacted] received Breathe Therapy to quit smoking,...

for which she paid $499 (her husband [redacted] received a $499 Breathe Therapy treatment from us at the same time). While Mr. & Mrs. [redacted] received exactly the great services they expected and paid for, later, Mrs. [redacted] said she would complain to the Revdex.com if we did not give her money.
Mrs. [redacted] tried to defraud us by rescinding the charges on her husband's credit card, a total of $998, after they both received our services and even after [redacted] stated on multiple occasions that the program worked. After submitting significant documentation showing the charges were correct & fully justified, VISA refused to allow them to defraud us by rescinding the charges.
After they weren't able to get away with not paying for the services they received, they threatened to smear our reputation - if we did not give them money.
[redacted] states in her Revdex.com complaint that Breathe Therapy is not FDA approved. Breathe Therapy does not manufacture or sell foods, we don't prescribe any drugs or nicotine replacements. We do nothing that would make the Food and Drug Administration need to approve us. We are proud that we don't make our clients take drugs or nicotine and are offended by this attempt to show us in a false light.
Mrs. [redacted] now claims she wasn't informed that we use low intensity medical lasers as one part of our services. She repeated to us during a phone call that when she went to our website there was no mention of our use of lasers and she claims that we never mentioned lasers before we treated her. On the Client Authorization Form (Exhibit 1) (which Mrs. [redacted] and her husband both read and signed before paying for or receiving treatment), we mention lasers 8 different places on the one page. On the MN Client Bill of Rights page (which Mrs. [redacted] read and signed before paying for or receiving treatment), lasers are mentioned 4 times. Both documents Mrs. [redacted] read and signed BEFORE paying for the services or getting the treatment. We never rush anyone to read the two pages. In fact, we go out of our way to get clients to relax while in our reception area. And Exhibit 3 (Copies of screen shots of our website) shows just some of the dozens of places, on almost every page of our website we mention or show videos of our use of low intensity lasers in our treatment. Our use of lasers is the primary differentiator between us and our competitors. People even often refer to us as Breathe Laser. We mention and show lasers in the highlighted TV News reports, videos, magazine articles, radio spots about us and website content on every one of the first 7 of the 9 pages of our website (the 8th page just lists street directions and the and 9th shows our contact info) - though you might have to click on links to some of them to launch the content.
Mrs. [redacted] claims she notified us that she had a severe skin condition before receiving our therapy and that she didn't want treatments with a red light. That is patently not true. The Breathe tech that treated Mrs. [redacted] stated that she never said anything about red light or lasers not working. In her pre-screen call, we asked her about any potential maladies and she didn't mention her alleged condition at that time. In our Client Pre-Therapy Form, filled out by the [redacted]s before receiving the treatment, we asked her about many potential maladies and she didn't note a condition at that time. In fact, she specifically wrote "N" for No in the Photosensitivity blank. When asked in the form, "Is there any other information we should know about your health" she filled in no information. Her technician told her about the use of lasers when she first sat down in the treatment room, about ten minutes before the laser therapy commenced (the tech even demonstrated the laser for her during the first 10 minutes) and she didn't say that she could not be treated. The laser treatment covered about two dozen different points, with each point being covered for about 30 seconds... at any time during the 16 minutes of laser therapy she could have said we need to stop. It was only after she failed to follow our instructions and well after we provided the services to her and her husband that she complained about not wanting to receive laser therapy. In fact, [redacted] came back for two more treatments with us and was doing very well in his tobacco cessation. He told us he had none of the common physical withdrawal symptoms (increased irritability or appetite, headaches, trouble sleeping, etc.) one would normally suffer when quitting... he even felt extra relaxed. Over the next several days, he re-iterated to us on two more occasions that his cravings had decreased and that "it was good not to have the smell and taste of the cigarettes."
[redacted] was provided the services and we were told she decided to not follow any of our handful of easy suggestions, starting within hours after she received services. We can't undo provision of services any more than a doctor could undo giving a shot. [redacted] and her husband had the right to refuse service (we do not force anyone to go thorugh our treatment) any time prior to receiving the full services. She could have gotten out of her chair and walked out of her session anytime during the one hour session. We do not have handcuffs on our chairs. Not only do we not pressure anyone into quitting once they are in our office, we have a policy to never even tell anyone that they should quit (we only say that when you're ready to quit, Breathe is faster, easier and more effective than other methods). [redacted] also claims we rushed her through a contract. But we have no contract and we never rush anyone. In fact, all we do is geared toward getting people to relax and slow down once in our office - we even have a fireplace and big brown chairs and a Northwood's cabin theme in our reception area to try to reduce stress and reinforce feelings of relaxation - as quitting tobacco is stressful enough.
Mrs. [redacted] stated she had seen our website, which clearly shows that while our success rate far surpasses most any other tobacco cessation method, we don't guarantee success (see 2nd page of www.QuitWithBreathe.com with comparison of our 80% success rate*, as reported by KARE 11 TV news.) There is nothing from us that Mrs. [redacted] could have heard or read that would give her any hint that we would refund her money just because... especially when she didn't do any of the simple follow-up tips we gave her. This is especially odd when her husband successfully went through our program with her - and he told us that he did quit much easier than he expected with our services.
Mrs. [redacted] and [redacted] received the services and then decided they did not want to pay for them. Mrs. [redacted]'s use of threats to slander and libel us based upon false claims - just to try to get us to give her money are highly unethical.
Our services work as described, and this can be documented by thousands of past customers and media stories on us.
One note: Mrs. [redacted] now claims she did not want to have laser treatments on her skin so as not to exacerbate any skin conditions she was supposedly suffering from. Over several decades there have been hundreds of published medical papers showing how low intensity medical lasers help in treating numerous skin conditions and soft tissue injuries. While our program is explicitly not marketed or described to treat or cure any illness or disease, it would shock us to find out that our use of medical lasers would cause harm to anyone with any kind of skin condition. If anything, we would guess it would be positive. We have served more than 7,000 clients and have never caused a serious medical trauma to anyone.
Should you have additional questions, do not hesitate to contact us. We are happy to stand behind our services - just as we are happy to be able to help so many thousands of people improve their health and enhance their lives.
