On or about November 24, 2015, [redacted] emailed me a settlement agreement stating that I would receive a refund of $2,000 payable on the 15th and 30th of each month. I made changes to this agreement and sent a signed copy via email to [redacted]. On December 14, 2015, [redacted] stated via text message "I will have [redacted] mail the copy of the agreement along with another payment to you tomorrow." This statement indicates acceptance of the agreement. As further acceptance of the agreement, the [redacted] have refunded a total of $400 for the unused sessions. While [redacted] states that another $200 has been mailed, she does not provide a date for mailing and the funds have not yet been received.
In the correspondence with the [redacted] states that he is agreeing to issue a refund in the amount of $2,000 for the unused sessions. We did relocate our training business 2.4 miles away and are servicing our clients sessions [redacted] Our contract states that refunds will be issued within 30 days if and only if the client relocates or if a physician feels that thier patient can no longer...

perform excersise. The client acknowledged and has signed this such contract with our company. This client has also trained at our new location then decided that they no longer wanted to train. In which this reason does not apply to thier signed contract. A payment of $200.00 was mailed to the client bringing thier unused session balance to $1400.00 not the stated $1600.00. Furthermore under our legal Council we never signed an agreement for refund after all with this client. Based on several factors, mainly that of our company's contract regarding refunds. This client will be serviced or they forfeit their sessions. We will agree and our willing to a transfer of sessions should they have an individual who would like to buyout their remaining sessions.
