I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Thank you for your response.  
Despite what your pest control people are reporting back to you we are still seeing roaches ALIVE in the kitchen, bathrooms, and now the master bedroom.  We're also starting to see small baby roaches as well.  While I understand that under normal circumstances you require a 60-day notice, however in our situation we need a 30-day notice without penalty.  Even though we're suffering through living with roaches we still want to be fair and give the office a notice, but living another 60 days with roaches is unacceptable.  There is an infestation somewhere in our building and they are spilling over into our unit.  We will not live here any longer than we have to in these conditions; it's unethical and illegal.  We will be out of the apartment by the end of November and not a month longer.  I have attached pictures of just a few of the roaches we've encountered just these past couple of days since we instinctively try to kill them before they get away by stepping on or smashing with a paper towel/tissue.
The electrical outlets in the kitchen indeed were fixed and have worked fine since, however we did ask that other outlets in the apartment be replaced and that someone look into the wiring as well.  The other outlets we requested were eventually fixed but no one has seemed to address the flickering lights that we have called about.  Not surprising because most of our requests by phone seemed to have fallen through the cracks and we ultimately have to come make the request in person (which we also did).  We've been fortunate that nothing serious has happened to us because of the flickering lights but you would think that the office would at least look into it as a safety precaution. The same with the roaches in our building and the structural integrity of the stairs and buildings; you would think one would be proactive instead of simply reacting after an incident has happened.

In response to the complaint by Ms. [redacted] and Ms. [redacted],
The staff at Breckinridge Square was given permission to allow the pest control into the apartment each time the residents called. The residents where notified on more than one occasion that the pest control service is on property every...

other Wednesday even if there is no request in the book. We had also been notified by the pest control company that the bugs where coming from the sewer lines and it was illegal for any company to spray chemicals in the lines and there for we have put a complaint into Louisville water and sewer. As a precautionary measure the entire building was treated. To address the refrigerator issue, before replacing the house keeper had gone back to the apartment and cleaned the refrigerator for the residents and the residents did not call back for several weeks to report the smell was still there. Several of the statement made in this complaint are false and not justifiable. The Breckinridge Square staff never laughed at the resident about their work orders and take every maintenance issue very serious. .
Breckinridge Square Apartments where built in 1968-1969 and over the years have gone through several renovations to include the most recent in 2005. The manager has recently signed several contracts to replace, repair and paint the exterior issues that have arose over time due to the age of the buildings. The staff is looking forward to the 2015-2016 renovation projects that will begin in the next 30 days.
We are sorry they feel they need to move and will allow them to turn in a 30 day notice to vacate without penalties. Residents are required to complete a move out notification with the office staff in order to schedule the final walk through inspection.

To Whom It May Concern,
 
This letter is in response to a claim #[redacted] filed on 10/21/2014.  The claim states that Breckinridge Square Apartments has not properly responded to maintenance requests.  The below statement and documents provided show that Breckinridge Square...

has not only responded in a timely manner to all requests submitted but we have also gone above and beyond to work with the residents. 
 
All work orders that both residents have requested have been completed. On more than one occasion [redacted] the property manager personally went to the apartment with the residents to address any concerns the residents had at the time.  The residents requests have been addressed at the time they were submitted in addition the manager has provided the residents with her personal cell phone number so they could contact her at any time and also offered to stay late if they were unable to be home during normal business hours for the inspection.  
Breckinridge Square Apartments uses only a 2nd party company to approve or deny applicants based on information obtained from Experian. If a resident has a history of writing bad checks the system will flag them and then we are unable to accept checks and they will be required to pay rent with certified funds.  This is a company policy and we are unable to treat any resident differently due to fair housing laws. 
 Breckinridge Square uses a professional and licensed exterminator for pest control.  The exterminator has been to the resident's home to spray the apartment and has explained that no evidence of roaches were found.  Breckinridge Square provides pest control twice a month and residents are instructed to call the office to place a work order to be put on the list.  
In regards to the comments pertaining to the condition of the buildings or look of the exterior we are very disheartened to hear that they feel so negative about the property.  The staff takes great pride in all the upgrading we have completed over the past 2 years.  Breckinridge Square spent $26,100.00 in the past 30 days alone on resurfacing the parking lots.  
The [redacted] family rented an apartment before several upgrades had been performed and to our knowledge they were aware of the condition and age of the property when they leased with us.
The drainage problem that Mr. [redacted] is referring to has been addressed with the Jefferson County and State Highway commissioner due to the fact that the water on occasion in the property is due to the drainage under highway 264.  Mr. [redacted]'s apartment is on the tree line and water way of the property which is owned by the utility company so they may be seeing a little more water flowing in that area.  It has never been reported by the [redacted] family that water has come in close proximity of their apartment home.  
Breckinridge  Square staff takes any electricity call very serious and not once has it been reported by the [redacted]'s that their lights have flickered in the past. On 2/18/2014 the [redacted] family reported the outlets in the kitchen where loose. On 2/18/2014 the same day, maintenance replaced the outlets with new GFI plugs.  
We are very sorry that the [redacted] family has not enjoyed their stay at Breckinridge Square and we have offered to allow them to place a 60 day notice to vacate on file and we will not charge the family the termination fee and they will be released from their lease obligation.
