Review: I paid rent on the 1st of the month as per my lease. The rent charge was held as authorized against my account until the 5th day with more than enough in the account to clear the charge. On the 6th I discovered that the charge was not accepted by The Apartment Gallery, even though it was confirmed by [redacted], and used another form of payment to take care of the issue immediately. On the 8th I received a notice that my rent was considered late and that I had to pay fees in the form of money order or certified check. The notice was left in the evening when I could not speak with the office directly to inquire into the matter. Furthermore it only left me two days to resolve the issue. Ultimately there was no reason, per [redacted], that the payment should not have gone through in the first place but I took care of the issue as soon as it was clear that The Apartment Gallery did not accept it even though the authorization showed in the account for 5 days.Desired Settlement: I have paid and have a receipt for the late fees placed against my account. I want these refunded.

Review: I moved into the Breezewood Apartments on the 15th of August, and was prorated a $480 fee, for a partial month rent. My monthly rent was $960. so the prorated fee on $32 per day was a fair move in rate, in my mind. However when I was asked by [redacted], the [redacted], to move out on the 16th of the month during the last month of my lease (I had been moved out prior to this date already) and was told that I would receive a refund for the 16th through the 30th. Because I have had prior complications with the office staff I recorded the entire conversation, between [redacted] and I, when I was told to hand in my keys. On this day I had paid the entirety of my rent of $960. I cleaned my apartment and my husband handed off all of our keys to the unit, to [redacted], an office staff member, on the 14th of the month. When the final paperwork came back, it was stated that we moved out on the 20th and the refund was $285 (which is at the rate of $28.50 per day). I then called the cooperate number and spoke to [redacted] She informed me that I moved out on the 20th and was prorated. I then played back the recorded conversation between [redacted] and I, stating that they had found someone to move in and to turn my keys in on the 16th. [redacted] stated that the prorated amount would be refunded "IF" you turned in your keys on the 16th. I then reiterated that I had handed my key in on the 14th, and she responded that "Well the office says that you turned them in on the 20th".Desired Settlement: I would like the remainder of my rent back in the amount of $171 for being out of the apartment for the entire day of the 15th through the 20th at the prorated move out fee of $28.50 per day.

It was noted that our office received the keys on the 20th of September and the prorated amount was based on this.

Additionally, there were damages that should have been charged (which exceeds the amount she is requesting) to [redacted] for numerous capret stains that were found to be unremovable, in this case she would have ended up owing the property money as opposed to receiving a refund.

Review: I was trying to end my lease and I was hit with various fees and paying 4 months rent as well as a 60 notice. I was not planning on moving back home, but I also wasn't planning on my mother being diagnosed with leukemia. She was a very healthy woman and showed no signs of any illness until after her first round of chemotherapy. It has been 36 days since she was diagnosed and they have been the toughest 36 days of my entire life, not to mention hers. I have a little sister who is still in need of parental guidance. Seeing as my father is either at work or at my moms bedside, I have taken responsibility of her daily needs and in doing so must move back home.I'm sure apartment offices hear excuses all the time about why people need out of their lease agreements, but if my mom wasn't sick I wouldn't be leaving. I have enjoyed living in my apartment, but have certain responsibilities I must tend to. My circumstances are true and unfortunate and should be taken into consideration for my leaving.I tried to look up a corporate number to explain my situation, but could not find any contact information. When I went to the office and asked for it I was told there was no way to talk to anyone in corporate. Regardless of my situation I find it highly suspicious that there is no way to get in touch with anyone besides the two ladies in the leasing office. I was then told I would be forwarded the only information they have on corporate, but I'm still waiting on that. I was also told this from a woman sitting at her desk behind a two way mirror. She never got up to speak to me or the other office lady. Once she turned her head and spoke to me, besides that she didn't even face me.Overall I am terribly disappointed in Breezewood Apartments ([redacted].) I thought they were a better business and actually cared about their residents.Desired Settlement: I would like to not have to pay all the termination fees or 4 months rent and give a 60 days notice. I am not trying to pull as fast one and leave early just for fun. I have a legitimate reason for moving and feel it should be taken into consideration.

**.[redacted] references a 60 day notice and a 4 month termination fee in her complaint. It is actually only a 60 day notice and a 2 month termination fee, this information was sent to her in writing.

While Breezewood does sympathize with what **.[redacted] is going through, this is a business and unfortunately, when you enter into a lease (a legal binding contract) neither party expects the unexpected to happen. There is no illness clause in our lease just as there isn't when there is a home or vehicle purchase, therefore **.[redacted] is still responsible for the termination fee.

If **.[redacted] needs time to pay the termination fee, I am sure the collection company would be willing to make payment arrangements with her.

Hello to all,

I just want to give a little background. I am a 31 year old professional with a very good job and financial stable. I like where I live at Breeze wood apartments. The location is good for me but not for many who travel down 95. For the price the apartment is almost worth it. The major problem I have is with the management and “[redacted]”. I had a problem when I first moved in when I switched the electric over into my name and somehow it changed back over to [redacted]. I called the corporate office when I received a letter stating that I had no clue what was going on. I was treated like a super low class citizen when I explained my side of the story. The electric company messed up and switched it back over for some odd reason and [redacted] wanted to fine me for that. By the end of things I got the electric company to three way call with [redacted] and settled everything out and the electric company took responsibility for the mistake. [redacted] treated me like I could not pay my bill and looking for a excuse to get out of it. I was even told “ I have heard this one before “. A few months have gone by and now I am back in the same situation. My rent is late. I get a letter on my door stating that If I don’t pay my rent plus and extra $284.00 in fees that they will evict me from the apartment plus add on $364.75 in attorney’s fees. My mind is blown I sent the check on the 25th and it is now the 7th when I’m getting this letter. I am writing this on the 12th of the same month and it still has not been deposited into my bank account. The letter has no contact information but just a bunch of information about any items left in premises will be disposed of in the twenty-four (24) period. I am very confused about this situation and go to the office and ask them what is going on. The office personnel were not much help but told me that my check processed on the 8th and I need to set up online payment. I am still a little old school and security reasons I still send checks. I explained that I do not want to or ever will set up an online payment with them and want to know why it takes 14 days for my check to process even though it has not shown up in my bank account. The office explained that the mail system was to blame. The mail is your choice and should pay online. (Little side note. I send things through the mail to help the [redacted] out with their shortage and it give people jobs at the location to work in mailrooms and open mail for processing). After doing some research on the situation I ran into people with the same problem. Granted I read everyone’s review as if they were just trying to get out of paying but everyone had one thing in common, the office staff messed up on a lot of things and took their money or that there checks were late or missing because of errors. The mutual sense seems to be that [redacted] is making payments late so they can charge late fees. I understand now why they do not take checks in the office. The apartment gallery is trying to make an extra $284.00 off of me to pay late fees and lose a good paying tenant at the same time. Just off of my experience with the office personnel you could make your own judgment. I rate [redacted] at a 1 and the building itself a 2 out of 5. All of my neighbors are great and everyone respects each other. It’s just sad when you get no respect from the company that you invest into.
