In response to these “Facts” that you have stated: If Breithaupt Auto had [redacted] in Warminster, PA inspect the truck - they would have had a documentation of the preexisting issuesHaving a mechanic inspect the vehicle should have revealed the leaking rear main engine seal, that is a very apparent issue to a trained mechanic once it is on a lift, it is very obviousIt would also have been clear that the engine oil coolant lines were leaking as well as the transmission linesSame goes for the transfer case output shaft sealIt was clear that there was some work done to the vehicle previous to us buying it as there were new break lines put in (incorrectly but not to the point of function or safety concern)When the truck was lifted by my mechanic and I, all of these things were pointed out within minutesVery obvious to any mechanicAlso, passing inspection does not require a mechanic to drive the vehicle while scanning the transmission function, nor does it allow the mechanic to drive the vehicle long enough for the shifting problem to arise as the problem would only present itself after some time driving at highway speeds to allow the transmission to warm upIf Breithaupt Auto drove the vehicle back from the auction the problem would have clearly presented itselfThe reason that I did not contact Breithaupt Auto before having the vehicle for five days was because we made an appointment with my mechanic as soon as we could, but it was purchased on aFriday and the garage is closed on the weekend and they were booked Monday and TuesdayIf I had been able to get the vehicle to my mechanic on Friday, I would have given Breithaupt Auto a call immediately and returned the truckAs far as the warranty, yes, Breithaupt Auto Sales purchased a warranty through PWI, which turned out to be a one- time credit of $1,toward engine, transmission, or driveline problemsDeceiving customers may work in the short-run, but in the long-run it will lead to reputation damage and deteriorating customer retentionCompanies need to ensure that they are not misrepresenting the “facts” and have some sense of ethical responsibility

[redacted] has accused Breithaupt Auto Sales of fraud, robbery, unethical and illegal practices, and that we advised her to resell the vehicle without disclosing that something was wrong with it.? All are said statements by her are untrue and that is exactly why we will not be resolving her? concerns monetarily Fact:? Breithaupt Auto Sales purchased the [redacted] from an auto auction in PA.? By Pennsylvania state law the vehicle if the vehicle had a bad transmission at the time of purchase, Breithaupt Auto Sales would have been able to take the vehicle back for a full refund Fact:? Breithaupt Auto Sales is owned by Jerry B [redacted] .? He has been buying and selling vehicles in Pennsylvania for over years.? He personally drove this truck for over miles before the customer took delivery.? He noticed no problems with the shifting of the transmission.? If he had, he would have fixed it prior to delivery or disclosed it to the customer Fact:? The vehicle was sold as is according to the FTC guidelines.? The customer signed off to the fact that the “motor vehicle is sold “AS IS” without any warranty either expressed or implied.? The purchaser will bear the entire expense of repairing or correcting any defect that presently exists or may occur in the vehicle.” Fact:? Breithaupt Auto Sales purchased a warranty through [redacted] at no additional cost to the customer.? The warranty covers up to $1,in engine, transmission, or driveline problems and is in effect for six months or 6,miles, whichever comes first Fact:? Pennsylvania law states that every vehicle offered for sale must be roadworthyIt is also illegal for a dealer to sell a car without informing the customer of the following problems if the seller knows or should know that they exist:? a cracked or twisted frame, a cracked engine block or head, bad transmission, bad differential, flood damage, or the car won't pass state inspection.? Breithaupt Auto Sales did not know of any problems with this vehicle.? We also had the vehicle checked at [redacted] in Warminster, PA.? They passed the vehicle and put new PA state inspection and emission stickers on it Fact:? The customer was upset because we would not let them return the vehicle for a full refund five days after having the vehicle.? We explained to the customer that purchasing a vehicle isn’t like purchasing a sweater from [redacted] .? You can’t return a vehicle five days later for a full refund.? Especially since the title was already executed and assigned from a PA title to a NJ address.? While we did state to the customer that it was their right to resell the vehicle.? customer of the following problems if the seller knows or should know that they
exist: a cracked or twisted frame, a cracked
engine block or head, bad transmission, bad differential, flood damage, or the car
won't pass state inspection. Breithaupt
Auto Sales did not know of any problems with this vehicle. We also had the vehicle checked at * ** * *** *** in Warminster, PA. They
passed the vehicle and put new PA state inspection and emission stickers on it

The customer was upset because we would not let them return the vehicle
for a full refund five days after having the vehicle. We explained to the customer that purchasing
a vehicle isn’t like purchasing a sweater from ***. You can’t return a vehicle five days later for
a full refund. Especially since the
title was already executed and assigned from a PA title to a NJ address. While we did state to the customer that it
was their right to resell the vehicle.
We never told the customer to knowingly withhold prior defects when
reselling the vehicle
Fact:
The FTC buyers guide was clearly affixed to the vehicle and a copy was
given to the customer at the time of delivery.
The FTC even suggests that the purchaser “ask
to have the car inspected by an independent mechanic before they buy” the
vehicle. It has
always been our policy to allow customers to have a local mechanic check out
the vehicle prior to delivery if the customer wishes. *** *** made no such request
In conclusion, not one of *** ***’s accusations regarding Breithaupt Auto Sales is true. While we empathize with the customer concerns
