I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
First the weather was not the reason for the delay - Mr. K[redacted] said he was having trouble getting ties out of Indiana. He was the one that said the weather was not going to be a factor - I wanted to get more estimates & wait until spring to start the job. We did sign the contract for $8860.00 & gave him a check for $4430.00.  He got the first payment & was ready to start the job asap.   About two weeks passed before his crew came & I asked them about the tie problem & they all (3) said that he buys his ties from [redacted] for $9 or $10 apiece. why Mr. K[redacted] was saying Indiana I do not  know.
       Mr. K[redacted]  was dealing with the [redacted] Twp. & his  engineering  firm. He called us about three weeks after he received the first payment & said he was very sorry but the Twp. said that the tie  wall would have to be built in two sections plus the engineers stamp was $1000.00. With the extra ties & the cost of the engineer he would sadly need $3500.00 more to cover the labor, tie & engineers fee. Our [redacted] Twp. building inspector had zero knowledge of the wall being built as Mr. K[redacted] is saying. I've spoken to him personally & he would be more than happy to talk to you about Mr. K[redacted]. The fact is Mr. K[redacted] told us that all was taken care of at the Twp. office -- He did not even have the building permit until 4/29/16. The reason he got it then was because I called over to his office to complain about his work & was  told he did not have a permit to do anything at all -  let alone dig. I told his workers & then he did get the permit.          Next Mr. K[redacted] states that the original contract was for $12,360.00.   I'm sure he has the original contract for $8860.00 as I do. The contract he his misrepresenting as the original is the one that he signed in front of a notary with the extra $3500.00 increase due to the $1000.00 engineers fee labor & more ties.  Again he should have the contract for the increase that he signed stating all the work that he was to do. This was signed by him & notarized.  (1) My storm drains were dug out & are not working! (2) His workers cut down the tree,  they all said Mr. K[redacted] was back on there pay so they have  me a price to cut the tree down & I agreed.  (3) Again  this fence  was his idea the [redacted] building inspector has NO knowledge of a fence!(4) The contract with the increase has all that is to be done -- I will gladly fax it to you. By the way signed & initialed by him-- WILL HAUL ALL DIRT FROM DRIVEWAY TO  REAR OF PROPERTY. (5) I SEE KNOW REASON TO GO ON. MR. k[redacted]  HAS BEEN IN BUSINESS FOR SOME TIME - HE KNOWS EXACTLY WHAT HE HIS DOING - BUT NOT THIS TIME - SOMEONE MUST BUT A STOP TO HIS BUSINESS PRACTICES!!!                                  ...

was a factor in the length of time for the job, Keith K[redacted] Construction was only contracted to build one wall for Mr. [redacted]. After dealing with [redacted] Township and our engineering firm, they requested that a second tier be placed below the top of the wall for added upper wall strength. This was decided because they did not want one wall to be too high and unstable.Naturally, to add a second wall that was twice the size of the upper wall, additional costs were going to be incurred. The additional wall is three times the size of the upper wall. Mr. [redacted] wanted this done for the original wall price. Actual job price should have been $23,000. Original contract price was $12,360 and so far we have only been paid $11,160. He advised he had no more money to give us, but yet they had a very large tree removed.We will go back out for the cost of $4,200.With regards to the driveway, the three concrete pads were split in half due to the faulty wall. We jacked up the pads in order to repair them. We also attached a split wall fence on the top wall. All of Mr. [redacted]'s storm drains are connected. His old ones were bad.In conclusion, there was no mention of two walls in the original contract. The job changed. Nothing about a fence on top and no mention of machinery time to fill in his two ponds with dirt up in the back. So you see, the contract changed. There were many extras. When trying to reason with Mr. [redacted], his ' voice overpowered you because he was still trying to squeeze us for the original price. People say go ahead and do it for the extras, sometimes they pay and sometimes they don't. It is not always the contractors fault.Keith K[redacted] Construction has been in business since 1972. We are reputable, insured and PA licensed. We also pay our crew, I have no idea where Mr. [redacted] came up with That.
