First call I received from the business said, they will not purchased or do service to my car without my agreement to pricing of parts and service. I received one call about the $169 rim, which I agree I declined because it was too much money. The second call said they would look for another rim, never telling me what the price would be. I was told the price of $40 after I already had my sister there with my newly purchased aluminum rim and tire. Was told the only way to not be charged storage fees is if I use the rim ($40) that they said was delivered that day. Never did anyone call me to notify me of them ordering the rim. What was agreed upon was that they would install my aluminum rim and tire, then place the steel rim ($40) with my tire in the back seat once they mounted it. My sister was upset about the prices they were making up and charging, she also mentioned that they were very rude to her. When my sister arrive again, [redacted] rushed her off the property so she didn't notice the rim missing from the back seat until she drove off, there was only my tire in the back seat, they did not give me the rim that they made me pay for to avoid storage fees. I also would like to add, that since I had my sister bring another rim/tire, they would not let her change it, and told her that if she was going to change the tire that they would charge her to tow the car our of their yard, cause she would not be allowed to drive the car out (which their driver drove into the yard, not dropped off by the tow truck). Your driver gave me a tow price of $65, which you changed the next day (no mention of that in the response). I was very comfortable with the tow truck driver as he was very polite and seem to be a trust worthy person, I asked him repeatedly what the price was, cause I didn't want to have any problems when it came time to pick up the car. He was very nice when he talked to me and my sister the night I was towed, so I didn't expect any problems with sending my sister to pick up my car. This business is about making up fees and not good business practices. This is the first and last time I will ever do business with them. I hope they go out of business for handling customers like this.

which the rates and guidlines are established by the local jurisdiction's police department. None of the other towing serivice providers including myself release vehicles on Saturdays, Sundays or Holidays. The complainint indicated she was here on Friday, January [redacted] and could have paid her bill at that time which would have saved her the additional storage fees for the weekend and Monday of the next week. The Complaintaint was rude and beligerant in our office, specificaly toward the estimator who is not invovled with the release of cars. At that time I stepped in and told her if she could lower her voice and that we do not release cars on Saturday. Rather than continue the confrontation with her I walked away. Suprisingly, on Monday a very nice gentleman who indicated he was her husband came in to pay the bill and the car was released without further issue. "i'm paying my wife's bill for the infiniti." To specifically address the requested settlement, January [redacted] is a holiday and relase would not have been possible, and as I indicated previously, the [redacted] had the oppertunity to make arrangements for the payment and release of the vehicle on Friday January [redacted]. Therefore the additional storage is not my responsibliy. Here at Brendan's Autobody we work hard to make everyone happy and make resonable accomidations for all our customers.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:First of all I was never asked where I want my car towed.It was literally taken away from me to Brendan's without my permission.Second, I did go to them on Friday but no one told me that I can pay until that day and get the car on Monday without paying for the weekend.The secretary printed a bill for me right away including the weekend and Monday. When I asked her if I can come back on Saturday she told me to call in the morning and make sure it was okay. Her statement led me to think that there was a chance that I can indeed get my car that day. I spent the whole Friday evening looking for a cash for junk agency/tow truck so we can meet in front of Brendan's and the car can be taken away. Saturday morning I spoke with one of the worker's at Brendan's and he told me usually they do not release cars on weekends but I should come in anyway and something can be arranged with the [redacted]. Both workers did not say it was a policy or a rule that cars are not released on weekends, rather they said something could be done if [redacted] was involved. Saturday morning,and [redacted] new I was there with the towing truck from cash for junk, but he still refused to help me. Correct me if I am wrong but he could have done two things: one let the car be picked up with no confrontation. He knew it takes only a second for a car to be towed. Two he could have said" I understand you have been misled by my staff" and he could have not charged me for Saturday, Sunday and Monday. I have worked for private businesses before and in order for [redacted]s to keep their customers happy they strive to resolve problems in the most peaceful and proper way. [redacted] did not even attempt to resolve the problem. He made every effort to intimidate me,show me who is the boss and that despite of what I said he would do whatever he wanted. Instead of trying to resolve the issue he walked away which is unacceptable for an [redacted] or a businessman to do. That is not a way to deal with customers .On Monday I and my boyfriend(not husband, I am divorced)went back to Brendan's but I was so upset with the staff at the auto business that I did not want to walk in the office again. I waited outside with my children while my boyfriend went inside to pay. I did not want to encounter [redacted] or any of his personnel again. I am aware he is running a business and trying to make money but as I stated in my previous letter I am a single mother of two children who tries to thigh the two ends and for a successful man like him to try to get money out of me instead of trying to help and work with me is very improper and unbusinesslike. I continue insisting that [redacted]'s tow truck driver should have asked me at the scene of the accident where I wanted my car towed.In addition I insist that [redacted] rufunds the $ 100.00 since he did not handle the situation/encounter with me that particular Saturday.He should have acted as a true [redacted]/businessman and approached the situation differently: either release my car which would have taken a minute or not charged me for the next 3 days.of                          the accident where I wanted to have my car towed and [redacted] should have akted more professionally and worked with me in my situation instead of charging me for money I do not have,intimidating and ignoring me.That is not a way a businessman should act.I still believe he needs to fix what he did and refund $100.00.

young man & im going to leave my car at your shop for the repairs. he said that is great you will not be disappointed. when [redacted] got to the shop she signed authoization to repair her car & we explained we would get her car back to her in preloss condition if it wasnt totaled. [redacted] has been very agressive at steering there insurers to there shops. a shop called & said they wanted to pickup [redacted]s car. christine who took the call imformed the shop that [redacted]s car was in the shop torn down & that she had signed the autorization to repair. [redacted] came in the next day & said she wanted to move her car to a shop that she used before. I said ok which shop? she said I dont need to know that, when in fact I do cause when you sign a release it has to say who we are releasing it too. . we do free estimate yes on visable damage only. the taking the car apart to blueprint the repairs is not a estimate it is part of the repair.. we do not work on cars without a repair authorization. the repair authorization was signed & a complete parts list was made along with inventoring all parts disassembled.the car was towed in the shop from the yard. then towed out of the shop cause it couldn't be driven. if the car remained here & repaired or totaled statefarm would pay all charges. but because [redacted] decided to move the car to another shop [redacted] said they would only pay for towing & storage.not for the tare down.this is how this became a issue.so the car sits here collecting storage every day & I very nicely explained this to [redacted]. if you want to move it do it now!

Review: On March *, 2015 @ 6pm, my car brakes locked up and I slid on to side walk on the corner of Saw Mill road. County officer stopped and asked if I needed help? I told him No, and that I might need a tow truck. He told me he'd call one and to wait. Brendan's Auto Body (BAB) arrived and told me they would charge me $65 for towing to BAB shop. Next day I was called and told, they found a new steel rim for $169, I told them that was too high and to find a good used rim. I was told it could take a day. I told them to let me know on the price. I found and paid for a used rim and tire for $55. When I went to pick up my car, I was told that they ordered a used rim for $40, I told them to cancel it, as it had yet to arrive. They then told me that I owed them $169, for towing and storage fees. I asked them why, they said $100 for towing, and $25 a day for storage with taxes. But was told they will not charge me for storage if I took the used rim they ordered, mound and install charges with taxes $165.... They would not honor the $65 price their tow truck driver told me and they added more charges I was not notified of. So we agreed for them to install the rim and tire I had purchased and delivered to them, and also take the rim I purchased from them. When I went to pick up my car and rim . They only installed the rim and tire I brought with me and then put my tire in my back seat, when I asked what happened to my rim, they said they didn't agree to that......Desired Settlement: I want them to honor the price their tow truck driver gave me, and I want the used rim they said was ordered and I paid for.

The business has responded. Please see below:On March *, 2015, [redacted] got a flat tire. He changed his own tire, but the spare was flat as well. We towed him back to our shop. [redacted] took the damaged rim & tire home with him that night. The next morning [redacted] was called about us finding him a rim and tire. A refurbished steel rim from empire auto parts was found for $169.00. [redacted] said he didnt want to spend that much. He was told that we could find him a used rim for the next day for $40 and that we would find the cheapest tire. [redacted] said that was fine. That night at closing time, a woman and a man who were acquaintances with [redacted] showed up wanting to pay the tow & take the car. They had found an aluminum rim with a bald tire. We were not informed to cancel the order for the rim or the tire. We explained that if we do not do the repairs, they will be charged for storage for every calendar day the car was here. The woman started getting loud and upset about the charges. She went outside to smoke a cigarette and during that time we discussed with the gentleman that we would take the tire from the damaged rim and put it on the recently purchased rim that they provided mounted, balanced & installed for 65 dollars plus the 100.00 tow. The total was 165 plus tax. He agreed and paid in full that night. Both sets of rims and tires were left here that night to be dismounted, mounted and installed the next morning. The woman came in the next day without the man who understood what we were doing. She came & said where is my car very hastily. Being as polite as possible we gave her the keys and said right this way and took her outside. She left & came back & asked where is the steel rim I paid for. We tried to explain to her that the steel rim is not what was agreed upon. Before we could even complete a sentence, she said forget it, it doesn't matter and stormed out without us even being able to talk to h er or even try and make the situation better. The complaintant [redacted] never called to cancel the original order and never came down to speak with us. We went above and beyond by trying to find a rim, ordering a tire, mounting and dismounting, balancing, and installing the tire on the vehicle for $165.00 plus tax.

The business has responded. Please see below:The tow truck driver did not discuss a price with [redacted] when he was towed to the shop that night. The only charge that is $65 is called a service call which is to change a flat tire, a lockout, gas delivery or a jump start. Since the tire had already been changed, there would obviously be no $65 charge. For the area we tow on the [redacted], the flat rate is $100. I am sorry if there was a misunderstanding about the tow rate. The situation with the rim was [redacted] told us to find a cheap rim and tire. That was our instructions so that he could get the car out of here and back home. If [redacted] wanted the rim that day, the cheapest that could be found was a reconditioned steel wheel from Empire Auto Parts for $169.33. [redacted] was informed over the phone and told us that this was too expensive. He was then told that we would search for a rim at an automotive recycle yard for the next day. He asked if we would receive it that day and was told no it would be for the next day. [redacted] told us to see what we could do to have it done for the next day. Going off our original instructions and the conversation with [redacted], we were still led to believe we were finding him a rim and tire. Late in the afternoon two friends of [redacted] came by with the intentions of paying the charges and taking the vehicle. They showed up with a rim and tire. We were never informed to stop searching and/or stop ordering a rim and tire. Time was spent trying to find a rim for that day and the next. When I informed the two friends that I had ordered a rim and tire they did not seem to care because they had a rim a tire in their hands. We explained to them that if they were to change their own tire, they would be charged for the tow as well as two days storage and if we changed the tire (take in the job) there would be no charge for storage and still the tow fee. When the young lady started to get loud and disrespectful we informed her that per our policy there could be a $75 pull out fee from the yard as it is labeled straight when you walk in so the rate we were giving her was giving them a break. She went outside and the terms of what was supposed to be done was discussed with the gentleman. The deal was that we would take the tire off of rim A( the cracked rim), take the tire off rim B (the new rim) and put the tire from rim A onto the rim B because the tire had more tread and was better quality. We were to balance it and install it as well. Our standard rates for mounting and balancing wheels is $30. Also, our charge to change a flat tire is $65. The bill was $165 including the tow. The bill was a very fair price for what we did. As far as contacting [redacted] with further charges, the two friends that were sent acted as his representatives so we discussed the terms with them in the hopes they would relay the message since he did not come. Sorry for the misunderstanding and we are sorry our service was not up to your standards.

As per your first response, your representative is your driver. He stated what the cost would be at the time of the tow. The drive did help me out by towing my car to the shop, I do appreciate that. I didn't like to be bullied by this company to either take what they felt was a good deal or pay more money, which both benefits them. Again, I started this complaint to show unfair business practices. All I wanted was for them to honor the drivers price given at the time of tow. If you take all that was said and done, I only wanted to pay for what was told to me by their tow driver. There is no list of services on the tow truck, nor did he provide me with a list at the time of towing, so you can make up prices for anything as far as that goes. If you help people by standing by your representatives, then you give good customer service, that's all I ever wanted.

Review: I was involved in a car crash on 12/**/14.It was a shocking and scary experience. My car was towed away without any one asking me where I wanted it towed or if I had anyone in particular that I wanted to use.I am assuming Brendan's Autobody works hand in hand with the police department because they were called and my car was taken to their storage area. I could not pick it up the next day because it was January [redacted] but I went there on Friday and was told I am being charged $25.00 dollars daily. Before I left [redacted]'s office I asked if I can come back tomorrow so the car can be picked up.I was told to call in the morning and double check. Saturday morning I called the office and was informed usually cars are not released on weekends but something can be arranged. Hearing above I called someone from cash for junk and asked for them to meet me there. When I went to [redacted]'s the [redacted] of the establishment was very disrespectful and kept saying he will not release my car. Stated he did not have staff which was a lie because there were at least 10 people in the office. One of them said he can get my car out but was afraid he would get fired. I explained to [redacted] that I am a single mother and can not afford to be charged for 2 additional days when I can get everything taken care of today. He kept insisting he is not going to do it and will charge me for the 1 st even though it was a holiday and for Saturday, Sunday and Monday even though I was trying to pick up my car today. [redacted] was very disrespectful, arrogant and acted in a discriminative manner. When I said he should not charge me for today, Sunday and Monday then, he sarcastically said :"Then I am not giving you your car." I proceeded to explain that I work every day from 9 am to 6 pm and today is the only day I can pick up the car. No one seemed to care and ignored what I had to say.I am very disappointed with the terrible treatment/service that I received this morning and believe the [redacted] should be reprimanded.Desired Settlement: I would like to be refunded for storage fee for January [redacted] and [redacted].Total of $100.00.

I am in receipt of the January **, 2015 response from the complainant and I the following responses:Responding to first statement in regard to the customer not knowing where the car was being taken from the accident scene. In conferencing with both of the tow truck drivers that were on the scene [redacted] was asked if she had a destination to bring the car, she replied "no". [redacted] was asked by the tow truck driver if she needed a ride home, she replied "no" that she had a ride coming. The driver then gave her a business card and let her know where the car was going and then helped her with her belongings out of the car to the sidewalk where she was waiting for her ride. Second, [redacted] claimed that she came to the office on Friday (the day after New Years Day). She did not come on Friday, nor did she call. If she called she could have been able to pick the car up on Friday and pay her bill. She called Saturday spoke to an employee and was instructed that the yard was not open to release cars on Saturday or Sunday. She came to the office anyway with a tow truck from a junk yard.Despite being told that the car could not be released on Saturday she came to the office and caused a scene as previously stated. There were opportunities for [redacted] to locate a salvage company on Friday, ask us for a recommended salvage company or simply pay the bill and have us tow the car someplace on Friday. We could not accommodate her request for Saturday, staff just isn't available to work on Saturdays or Sundays.The information provided at the scene to [redacted] is the same information that is provided to customers each and every time that a car is towed from an accident scene. Customers are given our contact information, hours of service and always offered a ride home no matter where they live. If a customer has another destination of choice we accommodate their requests. In consideration that [redacted] may be a struggling parent with children, if the $100 will help her family we will gladly refund the amount to her. We do not want to hurt anyone in these difficult economic times. Giving back to the community is something we pride our self in and are locally recognized for.Please contact my office to receive the refund.

Review: On 2/*/15 I was involved in a car accident on the [redacted] (near Irvington/Tarrytown). The [redacted] called a tow truck . Brendan's Auto Body responded and towed me to their location. I arrived to Brendan's at about 9 am and was there until about 9:30 am. Before leaving, I signed a form authorizing them to do the repairs. A few minutes after I left, I spoke to a [redacted] agent who informed me that I could have the repairs done at Brendan's or anywhere that I wanted. I informed [redacted] that I wanted to switch auto body shops. [redacted] contact Brendan's on 2/*/15 at about 12 noon and informed them that I wanted the car repairs done at a different shop and they would come and two the vehicle. The person at Brendan's told the [redacted] agent that I had to come in and sign a form before they could release the vehicle. I called [redacted] on Tuesday morning and was told and requested that she fax me the form so that I can sign it and fax it back to her. [redacted] stated that they only take original signatures and that I would have to come in. I came in on Tuesday, 2/**/15 at about 12:30 pm and signed the form. Once I arrived to sign the form, [redacted], at first would not give me the form to sign. [redacted] then came out and tried to talk me out of moving the car. I insisted on signing the form and then the form was given to me. I also left a copy of my driver's license. Before leaving I asked if there was anything else and would me car be allowed to be towed. I was told that there was nothing else and my car would be released. On 2/** the tow company again tried to get the car towed. Brendan's would not release the car. I called Brendan's again and went by Brendan's again on 2/** and inquired as to why they were not releasing my car. Brendan's was informed before they did anything to the car that the car repairs were being done at another shop. This shop is unscrupulous. They are trying to bill me for work that they did not do. Every time I talk with them, the story changes. The business card states that they give free estimates. So, if they breakdown the car, and provide an estimate, that should be free anyway. There is a even a discrepancy of the cost in the invoice that they gave me.Desired Settlement: Brendan's is billing me anywhere between $1,400 and $1,600. I just want this fee waived and my car to be released to the auto body shop of my choice. Please help. I do not owe them any money.

Please see below: [redacted] was towed by our driver [redacted], [redacted] ask [redacted] if she had a shop that she uses & she said no ,I never been in a accident.so he towed her car to our shop after the accident . she stated to [redacted] you are a very nice young man & im going to leave my car at your shop for the repairs. he said that is great you will not be disappointed. when [redacted] got to the shop she signed authoization to repair her car & we explained we would get her car back to her in preloss condition if it wasnt totaled. [redacted] has been very agressive at steering there insurers to there shops. a shop called & said they wanted to pickup [redacted]s car. christine who took the call imformed the shop that [redacted]s car was in the shop torn down & that she had signed the autorization to repair. [redacted] came in the next day & said she wanted to move her car to a shop that she used before. I said ok which shop? she said I dont need to know that, when in fact I do cause when you sign a release it has to say who we are releasing it too. . we do free estimate yes on visable damage only. the taking the car apart to blueprint the repairs is not a estimate it is part of the repair.. we do not work on cars without a repair authorization. the repair authorization was signed & a complete parts list was made along with inventoring all parts disassembled.the car was towed in the shop from the yard. then towed out of the shop cause it couldn't be driven. if the car remained here & repaired or totaled statefarm would pay all charges. but because [redacted] decided to move the car to another shop [redacted] said they would only pay for towing & storage.not for the tare down.this is how this became a issue.so the car sits here collecting storage every day & I very nicely explained this to [redacted]. if you want to move it do it now!
