Approximately years ago, Mr*** contracted with us, Brennan Landscaping, Incto install a brick patio in the back yard of his new homeMr*** wanted the patio to connect to his houseGenerally, we don't make contact with the home if the paver is above the top course of the
basement block or concrete wallThere are several reasons for this, one being moisture entrapment against the home's siding, if the paver is in contact with the sidingBecause of a desirable mature tree on site and some existing grade issues the height of this patio needed to start above that height to provide for proper pitch and water drainage or simply stated to make sure the patio water drained properlyThere are several good options to accommodate this situation which usually involve a slight separation between the pavers and the homes siding, e.ga recessed garden strip, ect... We explained this concern to Mr***Yet, Mr*** wanted the patio to connect to the house, at the raised elevationMr*** informed us that his siding was a material called "Hardy Plank" and that, according to him, via the manufacturer, "Hardy Plank" was impervious to moisture and would not rotThus, alleviating the moisture concern. Based on his information and approval we installed the patio in contact with the lowest row of his Hardy Plank sidingWe completed the job timely and on budget to his complete satisfactionWe provided him with a year warranty on craftsmanship and materials. Roughly years later in 2015, Mr*** called saying his "Hardy Plank" had signs of rotMr*** and I met on site and discussed options going forward now knowing the "Hardy Plank" representation was erroneousAll of the options discussed involved creating space between the siding and the patio. Mr*** wanted the entire patio ripped out and reinstalled at a new lower elevationThis elevation was now an option because the desired mature tree that caused challenges had since been removed and the yard grading could be alteredHe wanted all of this done at no cost to himThis elevation was not an option at the time of the original installation, mainly because of the existence of the desired mature tree and the inability to alter the grade because of the tree roots.I told Mr*** that I would consider his request.After lengthy thought of many factors including; Company philosophy, customer satisfaction, results of doing nothing, costs, good will, etcNow knowing that the Hardy Plank was not impervious to moisture, as he stated, I decided to undertake his requestI made it clear to Mr*** this decision to assist him was by no means an admission of wrong doing by usRather, the decision was a good will effort to help a customer where we couldI told him that we could start in late fall and the project would take about working weeks, as weather allowed. Communication with Mr***, once the project started, was inconsistent in part because his work brought him to China and he stated that communication by phone would be difficult. The re installation of his patio started in late fall and was interrupted by cold but we returned in early spring and completed the constructionHe then asked us to rework the steps coming out of the house, which we didHe then asked us to make some adjustments to the brick joints, which we didHe then asked us to rework the steps, againWhich we didHe was not able to give feedback daily because of travel but gave reactions as he would return and see the progress. Finally, after lifting up all of the brick, lowering the base, defining the original footprint, reinstalling the brick, installing and reinstalling the steps Mr. *** said he was satisfied with the rework. All of this work, at no cost to him, years after the original installation in which he gave the direction and approval of the height of the patio in relation to his siding. Mr*** asked us to contribute to his carpentry repairI told him I would consider it but by no means did I agree to contributeMr*** then asked us to contribute to the painting of the back of the house. I decided against contributing to his outside costsFor main reasons; 1, I thought we had gone well beyond what is reasonable, 2, I didn't think we were responsible for his problems as he directed the height of the pavers based on erroneous representation of the capabilities of his siding and 3, the preverbal goal post kept getting pushed back as long as we compliedThe scope of the rework continued to grow, as long as we acquiesced. I suggested to Mr***, that he pursue the Manufacturer or the representatives of the Hardy Plank if he thought he was given bad information or if the Hardy Plank did not live up to it's marketed representationI would assume he did that with little effect. Once Mr*** knew I was not contributing to his carpentry, painting or any other costs he threatened to register complaints to various organizationsI stood by my decision that we had certainly done enough, reconstructing a beautiful patio to his stated satisfaction, years after the original installation, at no charge from usI now thought we were being taken advantage of, regardless of his threats.Thank you for your attention,Tim ***Brennan Landscaping, Inc

I response to Mr. [redacted]' complaint. We set as a priority the proper installation techniques for landscape construction. The crew leader for his patio has over 20yrs experience in landscape construction. We refer to our original response, in that, it was accurate and concise. To Summarize, the customer contracted with us approximately 8 years ago to install a brick and stone patio for his recently built home. There was a mature tree in his back yard approximately 20' from the home which introduced a elevation concern for the patio in regards to the tree roots. The home owner said the siding of his new home was impervious to moisture. We discussed the concerns with the elevation and upon his provided information we installed the patio at the height we discussed. We finished, the customer was pleased and we provided him with a 1 yr. warranty for any craftsmanship or material defects 8 years later he called informing us that he was having moisture problems with his siding. Moving forward with the information that his siding was not "impervious to moisture", as he stated, we discussed some options that would remove the brick contact from the home. Removing the entire patio and reinstalling it at a lower elevation starting point was the option that the Homeowner preferred most. With little deliberation, we decided to provide his request at no cost to him. The mature tree that introduced the elevation concern had since been removed, allowing us to lower the starting elevation of the patio at the house. We completed the reconstruction of the patio to the customers satisfaction.  The homeowner then asked us tho contribute to the cost of painting the house and carpentry repair, which we declined. He threatened to complain to the Revdex.com and legal action if we did not acquiesce and we declined.  We completely rebuilt his patio to his satisfaction, 8 years after the original installation and at no cost to the owner. We believe we went beyond a reasonable response for the customer once the problem was brought to our attention. We further decided not to cave in to threats once the reconstruction was completed. We hope the home owner is able to continue to enjoy his beautiful backyard setting.

This contractor was very unresponsive to requests and questions during our landscaping project. He was almost never present during the work to supervise workers, resulting in the project continuing on approximately twice as long as was agreed to. Also, the agreement required Brennan Landscaping to complete overseeding if there was damage during the project, which was never done, even though more than 2 years have passed since completion of major work items. The landscaping project included retaing walls and work to construct stairs on the premises. A number of the retaining wall features and step components are loose and need additional bonding for long term integrity. We request that Brennan Landscaping completes the work immediately to comply with their contractual obligations. Thanks.
