case in questionThe concerns that the guest brought to light did not transpire as describedUpon check in, the room was rented to a single personAn agreement was signed by the guest that $deposit would be retained and swiftly returned with the understanding that there would be no additional people in the roomAdditionally it states that any noise made by a guest would not exceed a level that disturbed other registered guestsThe first night the guest stayed, the front desk received calls from each room adjacent to her that there was a great deal of noise coming from her roomSecurity was dispatched and found that there were at least four people occupying the roomOver the course of the evening we received additional calls regarding the room of this guest and found the same thing each timeOur hotel was built in the early 1970s and is composed of thick concrete constructionUnlike newer hotels with wood framed construction, it requires a great deal of noise to disturb those in their rooms from adjacent rooms or outsideIt is our ruling that we are justified in our decision retain this depositThe level of noise created by this guest during their first night resulted in lost revenue by having their neighbors leave before their scheduled departureAdditionally, at least an additional people occupied this room during her three-day stay also resulting in lost revenueThe policy she signed is attached and was clearly explained to her during check inShe was never denied a copy for her own recordsShould you have any questions or need any additional information please feel free to contact me anytimeThank you for your review of this matterDalia *C***
