After a chapter 13 payment plan is completed, the chapter 13 trustee and the court must review several documents before processing a discharge. First, the trustee has to perceive that the payments are complete, and send to us a notice of completed plan. That was done 4/14/16, not February. Although...
Mr. [redacted] made his last payment in February, the trustee has to disburse that payment, and do an initial accounting. As Mr. [redacted] indicated, we needed to get the certificate from his post-filing debtor education class filed, and that is complete. We also had to file a verification and request for discharge. That is the document that has delayed us. Creditors who may be entitled to special treatment as payees of domestic support are required to be listed on the verification and request for discharge. In Mr. [redacted]' case, there was a contingent domestic support creditor listed, but our verification and request quite correctly listed that there are no, actual, domestic support creditors. The trustee had some questions about that, we have answered their questions, and they have agreed that the case can be processed after 7/14/16 (their deadline to object to the verification and request). Both [redacted], and you, can rest assured that we are on top of this matter and are expediently resolving the trustee's questions. We communicated with our clients regarding the status on 3/15/16, 6/22/16 and 7/7/16.
