Hi ***, I meant to send this out earlier, but I needed to verify a couple of things Attached are the *** *** documents for their back yard project in April-May As you can see we closed this file on or about June 9th, We were paid in full and all work was
complete, with exception of some touch up on the paint Approximately weeks later there was a very large down pour of Rain, and the ***'s called with concerns to settling below the concrete Upon inspection, we realized the back fill around the house had settled 4-6", along with the French drain, not installed correctly, was the cause of the damageI informed the ***'s this is not our error, but the home builder back fill and French drains not installed correctly I then contacted *** at *** tech ***, a professional company who has seen many of these issuesAfter we met and reviewed the project, they determined they could pump in a poly foam to fill the voids created by the down pour I then forwarded this info to the ***'s, and scheduled the repairI also did inform the ***'s that this was not my issue, and they would need to contact the builder *** ***, for coverage *** informed me that the builder would pay for the repairs, and to move ahead, which we did Several weeks after the repair *** tech called for payment, and informed be that even though this was not Briar Street Builders issue, I would need to pay the invoice, and go back to *** *** for the repayment In the early fall I met with *** ***, ***' *** ***, and we agreed to repair (2) sections of the sidewalk, as it was a very small area and we wanted our customer to be satisfied This is our busy time, so the repairs were not able to be completed for about 6-weeksIn that time the ***'s small repair went from (2) small sections, to the walk way down the whole east and south side of the homeThis I was unaware of, as I had turned the repairs over to ** *** After much difficulty and weather delays, ** agreed to and did complete the repairsIt was getting along into the cold months, and the color of the new concrete was not an exact matchWe all agreed that in the spring we would have a coloration expert complete the coloration repair, along with a few additional repairs needed The spring came and I repaired all of the items requested, and even replaced the sprinkler valve which was not our issue, as it had frozenThe owners paid for the part and we installed it ***' *** *** had retained a coloration expert to repair the color, and the hair line cracks in the slabThis company is very busy and does their best to keep schedules, but did have a prior commitment come up and needed to delay the repair At this point the ***'s became very abusive, and demanded the whole slab be replaced or they would sueThey persisted over several days with demining voice mails, texts, and emails threating a law suite if we did not comply with their demandsI was on a family vacation, and they still could not wait from Thursday until Sunday when the coloration professionals could show up and complete the repairs to the slab(This was fathers days weekend 2016, and we had originally only agreed to a small repair) At this point, not wanting to go through a lengthily litigation, we under duress and very much stress and pressure agreed to their demands, all the while not feeling responsible Due to the relentless harassment form both of the ***'s, we agreedWe tore out the existing slab, (which was good in every way except the colors) and set up to pour a new complete slab and sidewalk. ***' & I met with *** *** the night before, at which time I voiced my concerns to the weather forecast, with temps at degrees before noon, and explained we could loos the slabto this *** just shrugged his shoulders, and ***' said were doing it The next day, as one might guess they lost the stamping consistency due to the extreme heat.......*** *** called me and asked if I could stop over and see what we could do I did meet with *** ***, and informed her we should be able to bring the concrete coloration experts in, they could fix this I set this up with ***', and had them scheduled for the upcoming Sunday at am *** *** was out of town and returned on Saturday, he called myself and ***' and once again went into his harassment, defamation of our qualifications, and again threated to sue, if we were not there by 10am on Sunday, knowing fully well we had set up for am After listening to him rant for 10-min, I aggressively replied, the reason the slab went south, is we should have waited day for cooler weather, but you would not have anything to do with that, again he reiterated, 10am Sunday or we Sue!!!! That is the last conversation we have had The ***'s did not sue but rather went to the Revdex.com with their complaintWe may have made some errors, but through all of this we really only wanted the customer to be satisfied I have been in this industry for 30+ years, along with ***', We have worked together for years, and yes have had some issues, but always have resolved themWe have worked together on over projects, and never have met anyone like thisWe always do our best to satisfy the customer, but this seams unlikely at this time At this point it appears we will have no other option other than litigation, only we will be going after the truly guilty party *** *** Please feel free to contact me with any additional information Sincerely, *** *** Briar Street Builders, LLC S Broadway #Littleton, CO 303-912-

I am rejecting this response because everything we have stated is true. The contractor has not contacted us to rectify this situation and it has been going on for over 15 months. We are done with going back and forth and I expect a financial restitution for work not completed. I do not want to deal with him any further. Any of his quality workers no longer are employed by him and I do not trust that he will get this job completed.

We have completed multiple projects with this customer, and all have been outstanding. As you can see by the photos attached the project is complete and outstanding......but due to a supplier issue with the correct doors, we arrived at this point. The cabinets doors they are referring...

to were sent to us by IKEA, and they had the wrong detail, which no one even noticed for 2-3 weeks after installation. They were order correctly, as I have shown the customer with the paper work, but were shipped incorrectly.  I have made multiple trips to IKEA and have gotten nothing more than the run around. They would tell me the doors are discontinued, and to stop in every 4-6 weeks as they were expecting a shipment of returns, and they would be able to swap them out. After 6 months of this run around I reached out to a custom door manufacturer, and had them make new doors. The problem we have run into is they cannot exact match the detail around the doors, and I have spent hundreds to this point attempting to resolve this. The only solution I have remaining is to remove 1 of the doors they want us to match and physically deliver it to the door manufacturer. They will then organize a proto type drawing as close as possible to the door, which the owners may review and approve. This will involve them having a door missing for a short time period, on 2 occasions. One time to match the door with manufacturing, and one time to match the paint scheme. At this time this is the only avenue I have to attempt resolving this mismatched door. I am willing to contact the owner's and set this up if it is acceptable. Yes unfortunately I have been out of touch a lot the last 6 months dealing with an ailing family member. This has consumed mush of my time, and it is not the way I am typically, but it has caused me to not be available as quickly as I have in the past. I have never threated to put a lien on anyone's property, we only provide lien releases as a courtesy to all of our customers, so they are assured there will never be a lien. As for any additional warranty repairs I will contact the owner and set up a schedule to complete any remaining repairs.I have also submitted a claim to IKEA'S customer service, and will forward any information I receive, as soon as I receive it.

I am rejecting this response due to breach of contract and continued delays.  It has now been 17 months since we contracted (4/9/15) and took them 2 months to respond to a Revdex.com complaint (filed 7/9/16). The outstanding issues regarding the Concrete, Landscaping and Fence have no relation to [redacted]. Also, we are not going to wait for a pointless and lengthy litigation between Briar Street Builders and [redacted]. Briar Street Builders has had ample time to resolve the outstanding issues, but has continued to delay at every opportunity.  There will be no resolution through the Revdex.com channel.
Sincerely,
[redacted]
