The Seller was called because his home was for sale and the listing had expiredIt is very common and practice for Real Estate Agents to call Sellers to see if they are still interested in selling their homeThat Agent specializes in
homes that do not sell the first timeA detailed voicemail message was left for the Seller by the Agent and it was the Seller that called the Agent backThe Seller could have simply not called back or stated he wasn't interestedThe Seller may be mad because his house is not selling, but that is not the fault of the Agent who call him and it certainly is not justification for a formal complaintThe Seller knew the Agent's intentions from the beginning because the Agent stated that in his voicemail to the SellerThe Seller's request was respected and the Agent ended the call, quickly and as requested
I personally have never had a conversation with this Seller and so do not know himIt was one of my Agents that called him

First in foremost our client is the owner of a property and we are hired to work in his best interestThese prospective tenants were on the bubble for approval due to poor credit and a recent foreclosure which would have them out of their current house at the end
of the month of FebruaryThey began searching for a rental property on Feb 10th whereas typical tenants/owners need 30-60days to secure a propertyIt was only because this property was vacant and we pre-approved them on the basis of putting down extra months of rent, plus deposit in order to secure the property for a modate February 20,
In my agents 7+ years of leasing experience, when a prospective tenant is difficult to get ahold of prior to signing a lease, 99.9% of the time they will walk away and valuable marketing time will be wastedIn addition, the lack of communication coupled with the background red flags of payment history, gave the owner and agent pause for concernShe stated that she has poor cell service at her home which the agent has to believe, however, on Feb 10th when the agent text her to send her personal email, she texted back saying she fell asleep on the couch but returned the text within an hourAlso, the agent left multiple voice mail messages stating very clearly that we needed a signed lease or would have to continue marketing the propertyHer lack of response and/or poor service is not our responsibilityThe agent gave the prospect several opportunities to sign and scan the lease and asked her to return calls on several occasionsThe agent did not understand if they were on such a tight time-frame why they were not returning messagesThis is a red flagIt also caused more work and time on the agents part because she had to continue showing and marketing the propertyThere was never a signed, delivered and executed lease and on Februry 18th the owner and agent agreed it was best to return the deposit and cancel any verbal agreementOn February 18, the prospect accepted the cashier's check and signed the cancellation (see attached)Below is a timeline of text/emails and voice messages to the prospect after initial approval:
Sunday 2/14/at 4:16pm-prospect sent text saying she gets off work at 7:and would call agent the next day at 4pm
2/14/at 4:25pm Agent responded that she was babysitting and would send lease later that night and asked what her question was specificallyNo response and no phone call Sunday 2/14/or 2/15/which prospect said she would call by 4pm on 2/15/
Sunday2/14/16: 7:23pm Agent sent lease via email and asked her to sign/scan backNo email confirmation or response from prospect
Monday 2/15/16-Agent still had not heard from prospect since her last text 2/14/at 4:16pm and sent another email and copy of lease and followed up with a text that evening saying we needed a signed/scanned lease or we would have to begin marketing again if not received
Tuesday 2/16/at 7:41am The prospect responded and said she still wanted it and to let her know if we are going to continue showing it b/c she has a limited time to find a propertyAgent responded at 7:42am and said it was still theirs, however, she needed to call agent and we needed a signed lease scanned asap or we would have to move on because agent had to protect owners best interest
Tuesday 2/16/8:53am she asked me to email the lease again and they would sign it after 5pm that evening when they get off work and scan it to agentAgent re-sent the lease and did not hear or see a returned lease or receive any type of communication from the prospect for the rest of 2/16/At 9:22pm on 2/16/Agent sent another text and asked if she received lease and did not receive a response from prospect
Wednesday 2/17/at 8:21am Agent text and asked to please call agent with the status of lease...no responseAgent sent her an additional texts and another voicemail stating I am baffled over the lack of communication and the owner is ready to cancel any agreements via my agents recommendation and to please callNo communication from prospect the entire day of February 17, whereas text messages and a voice mail message were conveyed from my agent to prospect
2/18/at 7:18am Prospect sent a text saying she could meet that evening and agent responded immediately and asked her to call the agent to discuss because the owner was no longer comfortable leasing to herShe finally called and they discussed the scenarios that the owner was no longer comfortable and agent would talk to him and see if there was a chance that he would like to execute a leaseAgent spoke to the owner that afternoon and he said he wanted to move on and continue marketing the propertyThe prospect and agent met at 1:30pm 2/18/and agent delivered a cashier's check reimbursing the depositThe prospect and agent both signed a receipt in which to cancel any agreements and additional money due (see attached)At the time, she chose not to accept a copy of the receipt and on 2/24/emailed agent requesting a copy of the receiptAgent sent her a copy via email on 2/24/
It is in our opinion that ample opportunity was given to this prospect to execute a lease and the circumstances and lack of communication set off too many red flags to move forward
