Complaint: [redacted] I am rejecting this response because:I recently filed a complaint about this issue on 01/04/2017.....On 01/I put in my first paper copy of a complaint with my hvac unitI informed the property manager that my heater was not workingIt simply was not litThe issue originally started 12/05...Which is the day I signed my leaseMaintenance came on 01/he had to order partsAs of 01/the issue was not resolved so I emailed property manager [redacted] to confirm nothing had been doneThen on 01/ [redacted] wrote me back claiming that the service men could not enter my apartment because there was a dog in my apartmentI dont have a dog and if he was in my apartment he would be included on my lease which one was not addedI also had other issues with a key to my apartment which was resolved almost a month laterSo on 01/I finally got someone to look at the hvac unit...the maintenance man tried to fix it but the age of the unit his options were limitedSo in a email I requested a new unitSo on 01/manager advised that I was getting a new unit on 02/she advised that it will arrive on 02/ [redacted] said it would be installed 02/The new unit eventually was installed02/is when I reported that it was not cooling and that day it reach degrees as the highOn 03/still no resolution the maintenance man came and bc it was raining he said they could not add freon because it had been raining and they would need to go on the rough to add more freonI spoke to [redacted] on the cooling on the hvac unit on 04/She told me someone would come by 05/Its 05/and the high today was degrees....Under Texas law for landlords under section LANDLORD LIABILITY AND TENANT REMEDIES (1) STATES "IF THE TENANT HAS GIVEN THE LANDLORD NOTICE TO REPAIR OR REMEDY A CONDITION BY GIVING THAT NOTICE TO A PERSON TO WHOM OR TO THE PLACE WHERE THE TENANT'S RENT IS NORMALLY PAID (2) THE CONDITION MATERIALLY AFFECTS THE PHYSICAL HEALTH OR SAFETY OF A TENANT.......AFTER GIVEN A WEEK TO CORRECT THE ISSUE THEN I HAVE THE RIGHT TO HAVE MY RENT REDUCE 1-I WANT MY RENT PRORATED FOR THE TIME THAT THIS ISSUE WAS NOT RESOLVED I WANT A CERTIFIED HVAC TECHNICIAN...IF THESE TWO REQUEST ARE NOT MET THEN UNDER (F) OR I MAY TERMINATE MY LEASE WITH NO PENALTIESI SIMPLY WANT A WORKING HVAC THIS HAS BEEN A ON GOING ISSUE SINCE 12/IT IS NOW 05/ALMOST MONTHS Regards, [redacted] ***

I am rejecting this response because:I recently filed a complaint about this issue on 01/04/2017.....On 01/14 I put in my first paper copy of a complaint with my hvac unit. I informed the property manager that my heater was not working. It simply was not lit. The issue originally started 12/05...Which is the day I signed my lease. Maintenance came on 01/16 he had to order parts. As of 01/25 the issue was not resolved so I emailed property manager [redacted] to confirm nothing had been done. Then on 01/26 [redacted] wrote me back claiming that the service men could not enter my apartment because there was a dog in my apartment. I dont have a dog and if he was in my apartment he would be included on my lease which one was not added. I also had other issues with a key to my apartment which was resolved almost a month later. So on 01/27 I finally got someone to look at the hvac unit...the maintenance man tried to fix it but the age of the unit his options were limited. So in a email I requested a new unit. So on 01/30 manager advised that I was getting a new unit on 02/03 she advised that it will arrive on 02/06. [redacted] said it would be installed 02/07. The new unit eventually was installed. 02/19 is when I reported that it was not cooling and that day it reach 80 degrees as the high. On 03/06 still no resolution the maintenance man came and bc it was raining he said they could not add freon because it had been raining and they would need to go on the rough to add more freon. I spoke to [redacted] on the cooling on the hvac unit on 04/16. I SIMPLY WANT A WORKING HVAC THIS HAS BEEN A ON GOING ISSUE SINCE 12/05 IT IS NOW 05/02 ALMOST 5 MONTHS
