RE: Complaint ID # [redacted] Better Business Bureau: Brightbilt Landscapes LLC would like to apologize for being past due in responding to the above complaintOn Monday, August 8th 2016, Brightbilt Landscapes LLC sent an e-mail to the client to whom filed the complaint, requesting them to revise the complaint to insure accuracyUnfortunately the client failed in responding to the e-mail and reaching out to you to revise the complaint to insure accuracyThis is what has led to Brightbilt Landscapes LLC being past due in the response to the complaintTo make things more accurate and objective, the response to the complaint is belowIn the clients e-mail back on Tuesday, June 14th (when the client agreed to terms), the client said "call me when you have a better idea of wrap up time and I will arrange to meet you to do a walk through, sign off and payment"On Wednesday, June 15th upon completion of the work (contract), the client did do a walk through, the Brightbilt Landscapes LLC crew took care of some minor loose ends, the client then did sign off and remitted paymentThe client's cancelled check is proof that the above steps were taken, that the client was satisfied with the work and that Brightbilt Landscapes LLC fulfilled its written contractual obligations at the end of business on Wednesday, June 15th During the walk through Brightbilt Landscapes LLC did offer a nicety, to go above and beyond the contract by offering a complementary (free) service to the client within two to four weeks before starting an ongoing routine maintenance regimenThe written contract that was agreed to by Brightbilt Landscapes LLC and the client was very clear that it was a one time, initial service and ongoing routine maintenance (follow up) was not covered within the $The client recognized that it would need to be maintained after the one time, initial service within her e-mail reply on Tuesday, June 14th The reason why Brightbilt Landscapes LLC turned apprehensive and hesitant in following through with the offer of the complementary service is because the client chose to act in a non-constructive, undue and hostile manner towards Brightbilt Landscapes LLCThis is why Brightbilt Landscapes LLC became defensiveOn Monday, June 20th at 4:37PM and Friday, July 1St at 5:33PM by phone the client chose to employ insinuation, innuendo and levy accusations against Brightbilt Landscapes LLCIf a landscape contractor is offering a complementary service, to go above and beyond, it is counterproductive for a client to act in such a manner as described aboveAs for the aspen tree, the Bernalillo County Horticulture Extension Agent (Mr [redacted] ***) is the true "expert opinion" in this matter, not a competing companyAn Extension Agent has 4-years of college education in a degree field related to horticulture, botany or agricultureExtension Agents are third party, in having no stake or profit interest in the matterA competing company does have a stake, profit interest and conflict of interest in the matterIn an e-mail from the Extension Agent on Thursday, July 21st 2016, the local Extension Agent spoke of several environmental issues that can degrade an aspen tree's health, outside of the Wednesday, June 15th servicingA picture sent by the client on Monday, July 181" vindicates Brightbilt Landscapes LLC from being 100% at fault for the degradation of the aspen treeIn the picture there is evidence of a canker on one of the leaders (trunks)Also if any of the spraying that had been done, adversely affected the tree, it would affect the bottom first and then moved toward the topThe low small middle leader of the tree in the picture is green and healthyHad herbicide been the cause, this green (health) would have been brown (unhealthy)So with all of this said, no one in an objective, reasonable mindset can find Brightbilt Landscapes LLC 100% guilty for the aspen treeSince the client filed the complaint, the client and Mr [redacted] have metIn a voicemail from Mr [redacted] on Thursday, August 4th 2016, the Bernalillo County Horticulture Extension Agent said that Brightbilt Landscapes LLC was "in the clear" when it comes to the aspen treeIt was Mr***'s opinion that the tree was "deep planted" and wasn't getting the water that it preferredSo in essence, the clients should go after the landscape contractor who originally planted the aspens for deep planting them and for recommending a species that would struggle within the environment at the client's propertyWith this said, the clients do share some responsibility in this to insure that the plants (such as the aspen trees) within their landscape are getting a sufficient amount of waterThe clients are wanting something for nothing and have employed counterproductive tactics to attempt to get something as described aboveIn closing, until the client revises the complaint to be accurate and objectiveBrightbilt Landscapes LLC recommends that the Revdex.com not publish the details of the complaint and simply closes the complaint administrativelyThank you for your consideration into this matter! *** *** [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the responseIf the consumer does not provide a reason the complaint will be closed Answered] This is now a "he said, she said" situation MrB*** is now interpreting his contract, walk thru, conversations, emails and most importantly the visit from the tree expert to be to his advantage In that visit, Mr*** could not conclusively determine the cause of the tree dying He admitted it could be from weed killer spraying onto leaves Due to that, I will not be pursuing MrB*** legally for replacement of the tree I fault myself for not prorating the check I wrote, but I took him at his word and believed he was being honest when he said he would return to spray the weeds Additionally, I took him at his word (and from what he put in writing in an email) that he would pay for another landscaper to come and finish the spraying I even had the other landscaper come to my home and do a walk thru! I believed these to be a verbal contract/addendum to the agreement The only way to get that enforced is to go to small claims court and supeona the two employees and other landscaper At this point, I am writing off my loss and hoping to help protect other unaware and trusting consumers.I DEMAND that all communications on my complaint stay online as, "Buyer Beware" with this contractor In addition to having a witness, anyone doing business with this company and MrB*** needs to video and audio tape every conversation, visit, etcso he cannot wrangle out of a contract and his responsibilities.Also, I refused to have any other personal contact with MrB***, as I found him incredibly unstable and feared to be around him alone Due to this, I asked that all communication be via email In one of his last emails he stated he drove by my home and "all looked good" To look at our lot, he would have had to trespass on the neighbors property and walk along our fence. I find that very unnervingSo I have blocked any emails from him coming to my account and have reset my security system and cameras accordingly
