I'm quite confused at this complaintIt holds little meritWe DID complete the logo, We DID complete the Facebook design, and client was not happy with design since he wanted to include a mortgage calculator (which was not secure, which means it was not allowed to be displayed on Facebook) Client took that as a failure to render service and asked for a refundI explained to the client the situation and I offered him to create him a mobile app for his company, which I did! All proof of work links are provided in this response Our mobile app platform alone costs $997, which is what we charge to new clients based on how many features he received in his appI guess his choice is to not continue with what he agreed to, which is fine, but like our agreement states, he is paying our company for the time invested in design and creation of his custom designed products, which we completed over $worth of work on his account, and didnt charge him $more from what his initial investment was We have a strict no refund policy on the time and effort done on our partTo put this into context, does a lawyer have to refund his client if his client lost their case or was unhappy with the result of the case? NoHe knew upfront what his costs were and that it included any amount of revisions necessary to make him happyWe make it VERY CLEAR! We cannot be held liable for clients who want to work outside the frame of their agreed termsHe did not pay for the $mobile app we created for him, we provided that free of charge in lieu of his Facebook design which he no longer wantedNow he wants a full refund? Looks like another case of a client that cannot appreciate the time and effort done by a custom branding agency and thinks that he can get our work delivered to him free of chargeSorry buddy, it doesnt work that way PROOF OF WORK: Logo design: (Client already said that was provided and he is satisfied) (again we went over budget on this by providing him with a total of different logo designs to try and satisfy this difficult clientHe only paid for a total of different stylesAgain, we did NOT charge the client additional, even though we should have) Facebook Website: (client was unhappy with all revisions, even though this is all we had to work with as far as http://uwlonline.com/ http://brightsideadvertising.com/designs/united.html Mobile App Design: (this was given to the client free of charge, which client FAILED to even mention is his complaint) http://uwl.4yourmobile.com So as you can see, there is sides to this storyThanks for taking the time to review this

[redacted] responds: "I would suggest our mobile app then use [redacted] to drive trafficWe can target the Latino market with specific demographicsI was named "One of the Best" by [redacted] in when they hit million advertisersI can bring my mobile app down from $to only $for Android and $for Apple The rest of your budget we'll put towards adsEvery people we reach would cost you around $1-$so very cost effective to help grow your networkDoes that seem fair?" [redacted] responds: "Ok [redacted] - I think we should talk I can go to your office next Friday mid-morning if that works for you I think you can see the vision, and I've got many ideas I want to do for the Latino Market what [redacted] of [redacted] did with the [redacted] I'm re-starting on a shoe string-but so be it I would rather deal with one of my own and I can see you got talent I'm going for this in middle age -so -failure is not an option." March 9th 2015: [redacted] emails [redacted] about introducing him to [redacted] and this is what was emailed to ***:"Hey ***, I understand [redacted] called you regarding the mobile app I hired her to kinda make sure I'm taking the right steps-and for help in the Latin Grammy's [redacted] products to go in the bag We'll she got back to me and said 'she was impressed with you and your ideas' I knew she would be - because I was impressed with you So - I'm gonna need a website done soon Can you build a cool and easily navigable WS that Pops? I want to stay consistent on the whole presentation -so my thinking is to just let you do it Help me Kick As on this ***-and who knows what good things the future holds- ***" June 12th 2015: [redacted] calls [redacted] and informs him of "great news" which consisted of refunding 100% of the $paid to [redacted] for building the mobile app and holding the price [redacted] paid for year should he decide to keep the app at a later date [redacted] informed [redacted] that there is a strict no refund policy on work completed [redacted] then offered to allocate the $paid toward a different service that [redacted] providesWhich could be a video commercial, [redacted] Sales Funnel, or website design [redacted] then explains why the mobile app will be the best tool for their business at it combines everything they are doing online in place and allows communication at 95% open rates within secondsNone of his other products offer that [redacted] then asks to see the app as she has not even looked at what was put together by [redacted] for the [redacted] brandThis is the email that was then sent to [redacted] on June 12th: "Hi [redacted] & ***, here is the preview design of the [redacted] app to test featuresPreview your app by downloading the "Preview Your App" mobile app for your smartphone: USE ANY OF THE FOLLOWING LINKS TO PREVIEW YOUR APP: Desktop/Lap www[redacted] Apple Smartphone:www.tinyurl.com/ [redacted] Android Smartphone: www.tinyurl.com/ [redacted] Once you have downloaded the mobile app, use the app code to preview your design: [redacted] (no password) Get in touch with me directly if you have any questions about the preview processYou can also start your app training at our website: Initial Training: http://www.customonlinebranding.com/#!app- [redacted] Premium App Training & Marketing: http://www.customonlinebranding.com [redacted] (password: premium) ***, as far as your request for a refund, unfortunately, that cannot happenLike we discussed, I am able to offer a credit of the cost towards another service if need be, which I don't think you should since the app is the most powerful tool he can have for his business todayYour offer of a refund and to hold the pricing for a year is not something I would consider "good news" by what we've setup for ***Being that [redacted] knows we discounted our app pricing heavily to bring him on initially He told me his total budget, and I didn't want him to commit everything he had to this technology so I brought him in at just over cost As someone of your caliber, ***, I'm sure you researched our site and saw the cost of getting our app is a lot higher than what [redacted] has paid us Unfortunately, everyone who worked on the account has already been paid and I can't ask them to work for free When we met with ***, he gave us a total breakdown of how he wanted the business to be brandedI was notified of your involvement with the brand officially on May 8th, far after we got everything put together and the work was done on his accountAs you can see from the attachment, we've been working on his stuff since February so to come in months after the fact, then ask for a refund because you decided to re-brand him, unfortunately, that's not my doing and you'll have to bite the bullet on that one Like I've said since day 1, I can help him get this off the ground in any means we can provideI just can't force my team to not get paid for the work that's already been done Look forward to hearing from you soon." [redacted] then proceeds to say they do not need it and requests a refund again but that we can keep $for the work we didHere is ***'s response: "As I've mentioned numerous times, any refund will be in the form of credit towards another serviceEverything we received from [redacted] when we started gave us the impression you had a business model tied down Now that you've come into the picture and changed everything, the best we can do is update to the branding you wish to haveWe cannot refund over 80% of the cost because you came on board and want to revamp the entire brand When [redacted] came to us, he was very specific on how he wanted to proceed which we followedComing in months after is out of my control and not my issue to take the loss onI'm sure you understand By the way, we don't build templatesWe build apps:)" Then the response is to let [redacted] keep $of the $paid and refund $Here is the response by [redacted] on June 15th: "Here's the thing ***You came into my office with tons of productYou then sent me separate emails on Feb 13th with multiple streams of content including your "Biz-Plan-Pt.1" that outlined where you saw your business heading You provided more content than most of my clients who come on board so to say you didn't have a business plan in place is kind of misleading You then sent me this email on the 18th: "***--as I said before - presentation is everything to me - because it will be backed by quality I want you to help me brand this in the best light for 'our...and all people-aka-potential customers' How many pages do you think is appropriate? I listened to your interviews on your page-and suffice it to say - I am Very Impressed with you, for being such a young ManYou are the Real DealI'm going to put my total trust and confidence in you and your counsel I looked and prayed far and wide for the Right person and company to help me-and I Know I found it in [redacted] *** Thanks and God Bless You...which he obviously hasWe'll meet again in the next 2-weeks to discuss." Then on March 9th, I received this after many back and forth conversations about starting an ADDITIONAL project on top of the app: "Hey ***, I understand [redacted] called you regarding the mobile app I hired her to kinda make sure I'm taking the right steps-and for help in the Latin Grammy's [redacted] products to go in the bag We'll she got back to me and said 'she was impressed with you and your ideas' I knew she would be - because I was impressed with you So - I'm gonna need a website done soon Can you build a cool and easily navigable WS that Pops? I want to stay consistent on the whole presentation -so my thinking is to just let you do it Help me Kick As on this ***-and who knows what good things the future holds- *** " 30% of the balance paid doesn't even cover the cost of productionLike I've said many times, we discounted our retail pricing heavily in the hopes of working with a brand I liked and knowing the $monthly fee would offset the lost revenue in the long run I believed in you, you believed in meSeems that [redacted] got in the middle and now everything's changed If anyone needs to come out of pocket to fix your situation, it's herI'm not going to refund any amount, as the initial design has been completed and everyone who worked on your account has already been paid Even a 10% refund would put me in the redI discounted my app to basically cost to bring you on board as a clientI gave you the best deal you could get from my company since you were working directly with me and not one of my agents You'll just need to wait until you see value in this technology I guess so we can move forwardOther than that, you're app is ready for submission or revisionsBut no refunds will be givenThat's final June 15th that same day, [redacted] replies asking to see what the app can do and wants to review the preview link that was put together again [redacted] resends the link and after review, here is what [redacted] responds with on June 15th: "Ok *** I'll keep the app I am just not going to be able to activate right now So - is that good? Sorry about [redacted] and you not hitting it off I have decided to put some resources into the Brand Architecture I need to determine Exactly what the brand stands forI got to get this part right With the app - I put the cart before the horse - unless you can convince me otherwise. Here's a hypothetical situation: If I was to start a 'crowdfunding reward campaign' - how would your services help drive potential crowd funders to my page?" ***'s response a couple minutes later: "I could help in thatWe got one of our apps funded that wayUse a service like [redacted] and you can start generating donations today!***'s response that same day:"Ok -- My gut says you could probably deliverI hired [redacted] to help me develop the Brand She has many years in building new apparel brands She Knows what she is doing - believe me I'm too old to [redacted] this up now, she sees the promise of [redacted] and has also reduced her rates to help me out I'm going to go thru my meager budget soI have no choice but to attempt a crowdfunding campaign I have good products for rewards - once they get it in there hands.Ok--so give me an idea of the costs to do this If you were me on a limited budget - how & what you do it? If I get some quantifiable traction - I want to bring in investors - even the right equity partners when the time is right How I can do this on the relative cheap?" ***'s response: "Crowd funding doesn't cost anythingJust setup the page for free and invite people Go to [redacted] and sign upFill in the blanks and send me the link once you've done itI'll review it to give it tweeks to start promoting I can push it to my network since you're my client." ***'s response: "Ok--I see Would buying targeted fb ads - also be a wis that prohibited to solicit crowdfunding on fb? I want to do this so I could attend The Latin Grammy's gift-program in LV in person this fall It's grand(sponsorship fee) plus pieces of product-and days of expenses - so about grand to be on site, scmooze with the celebs, and even place any photographs taken in the websiteI'm doing designs of capz right now, and a custom [redacted] /short I work full time - so I do my best to juggle my time Put that app on hold for nowSo no harm - no foul." ***'s response: "Don't do adsFind networks that will share your cause for freeI'll make some calls once it's all setupI've got a big network to tap into" ***'s response: "Ok - sounds good I'll let you know when I'm ready Thanks" At that point, [redacted] put ***'s account on hold until he heard from them on what they want to do next October 8th 2015: [redacted] starts sending [redacted] requests for allocating the funds towards an e-Commerce [redacted] Funnel and sending additional content via emailThen the 9th, [redacted] sends this email to [redacted] directly: "Hello [redacted] Per the voicemail I just left you, we are ready to take you up on your offer to reallocate the $credit still on your books from [redacted] , from phone app development to [redacted] commerce developmentThe page is established and needs to be optimized for e-commerceI have written to you before about your offer to shift the credit from one use to another, and after months have passed, I have received no response (although for some reason you asked if you could [redacted] with me)We are on a very tight time constraint so I will need a response from you before EOB today, Friday October 9, Failure to respond will result in my client taking aggressive legal action towards your company to recover the value of the open credit and what your lack of business integrity has cost the company in time and lost revenueBefore you tell me that you sent us the app, let me remind you that what you sent me was a templateYou put no time or effort (except to plug in the name) and its disingenuous to think that you can fool me into thinking that you put any effort into the creation of the app [redacted] may be new to business, but as you noticed from my [redacted] page, this isn't my first rodeoTo quote [redacted] ***...right now you are "pissing on my shoes and telling me its rainingI know the differenceAnd I wear really nice shoes We can work with you going forward, as long as you step up here and show us, and by extension, the Latino Business community, that you and your business represents with Pride and IntegrityYou have the power to make the choice that best suits your business' long-term goalsIts all your choice, *** It is my sincere hope that you choose well, put this discord in the rear view mirror and hit the open road together [redacted] ***santa fe, nm usa [redacted] ***'s response: "If you would like for me to go out of my way to extend an offer of crediting the app cost toward another service, please stop discrediting the work I've done [redacted] paid for a $app, do you really think he's going to get $30,value for that? The cost he paid went to graphic design, and the ability to use my platform for his mobile app If you would like to "put this discord in the rear view mirror and hit the open road together", you might want to show a little respect and not try to threaten me with legal action which you have no basis forHe has a signed contract on what he received, which he didIt's not our fault he brings in a hostile business partner that just thinks she can badger her way to making people do what she wantsI've already outlined what I will do and when you guys can come to an agreement on what you want to do, let me knowOtherwise, stop bugging me with your annoying insults." After sending this email response, [redacted] didn't hear anything back until this Revdex.com complaint was filed, saying [redacted] stole their money, ignored their requests for a refund, blocked their emails, and acted like a "thug" as they describedAs you can see above, [redacted] has only asked to be treated with respect if they want him to go out of his way to do something that is not in his written and agreed to contractInstead of acting professionally, [redacted] threatens [redacted] with legal action if he doesn't respond by end of business day bowing to her commandsThen, when [redacted] agrees to honor a special offer he gave months ago which [redacted] already declined to accept by saying he would keep the app, she decides to try and defame his character and lie about the way the conversation happenedAll communications are documented and as you can see, [redacted] has been nothing but accommodating to the needs of this very irrational client Now she wants to say that [redacted] is threatening them? All he is doing his protecting his brand from defamation and said he would file a cease and desist if they should continue to spread lies about the way [redacted] conducts business [redacted] did not go to a public forum and try to shame the [redacted] brand [redacted] and [redacted] were the ones who decided to take their disagreements to a public forum and try to paint [redacted] in a way that he obviously is not a part ofThe proof of work was delivered in a previous response along with many emails of the correspondence back and forth This is the email [redacted] sent directly to [redacted] once he was informed of the Revdex.com complaint filed against him:"I would really look into what your hired "professional" is saying about me in a public forum [redacted] is blatantly lying about me and my company saying that I am not honoring my side of my agreement and that I did no work, no effort, blocked her email, etc She has also lied about her request for a credit toward servicesI offered that as a remedy to what she thought brought no value to your company since we cannot offer a refund on work completed Her offer was a refund and to hold the pricing for a year while you guys figured out how to position the brandShe is lying a very high degree which is going to put your company and self a very bad position I have many emails from you saying you are going to keep the app (June 15th) after [redacted] asked for a refund (June 12th) and that you are going to "put it on hold" and will let me know when you are ready to proceed I have already contacted my attorney since she decided to put these lies into a public forum which cannot be removedI have an appointment with him later today to discuss all available optionsI'm really disappointed that it has come to this point but since you have authorized her to speak on your behalf, you are going to be liable just as much as she isI have everything in writing from start to finish so she really needs to check her verbiage on what she has accused me of I'd suggest getting in touch with her and finding a remedy to this situation very quicklyI've been nothing but helpful and a resource for you throughout our relationship and since you brought on this lady, she has brought nothing but problems Look forward to hearing from you very soonReply to this email with any questions." As you can see, [redacted] is very professional in his response and just wanted some clear answers on why [redacted] went to a public forum and lied about ***'s actionsShould they want to respond, please respond with facts, as [redacted] has Attached you will find the entire conversation in writing from June 12th on when the request for refund was made along with [redacted] saying he will keep the app and he will let me [redacted] know once he is ready to move forward with it You will also find attached the conversation from Friday, Oct 9th in which [redacted] responds to ***'s threats and receives no responseAnd lastly, you'll find attached the entire conversation from October 15th where [redacted] explains the Defamation of Character he is going to pursue should [redacted] & [redacted] not admit they liedShould you need anymore hard evidence, please advise I'll consider this case closed until further notice

This is an unrelated customer to BrightsideThey are through a different companyI will outline what is going on with this client either wayYes, she paid up front for our services totaling $She paid for a logo design, website design, and app designThe 1st thing to be completed is the logo design which we delivered many different examples for her to choose fromShe liked many but wanted changes which we obligedShe then sent us a picture of her business card she took from her phone and asked us to incorporate that into her logo She signed up with us on 11/18/and her 1st delivery of our work was on 11/22/with different logo designs to choose from On 12/16/14, she decided to respond to our emails and contact saying she was finishing up school for the past month and was now ready to move forwardThat email never made it to my inbox as it was sent to spam which I informed her on January 8th when she emailed me again on the 7th looking for an update I told her I would have an update to her design shortly but week later she decided to cancel and ask for a full refund of servicesOur outlined agreed to terms specifically states we cannot start on any other services outside of logo design until the logo is finished She has stated she has contacted us multiple times and we ignore herThat is untrueI've responded many times sharing with her my difficulties in completing her project without the necessary items we need from her Kind of ironic how someone who fails to send us the required information we outlined from day 1, along with ignoring us for a month while she was in school, now asks for a refund because she cant follow instructions We just contacted her days ago and asked what we could do to fix the situation(see attached "proof of contact 2-9-15") She's not entitled to a refund as we have performed exactly to our agreed upon termsI'm willing to work with her to resolve it but she needs to stop spreading lies and just call meI can only work with people who want to be worked withMy team has already been paid and we've put in many hours of work on her project and for her to say we did nothing is very insultingThanks for your time in reviewing this matter

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
First off, the business, ***, states that they did complete the facebook page design This is false If you go to the link you'll see that the form field is blank, does not work *** was never able to make this work and it is the entire purpose of the page to allow potential clients to enter their contact information and qualifying information to capture a lead Second, I requested that our company's licensing information be displayed at the bottom which it is not Third, the facebook page linked to in ***'s response is basically a snapshot of the company website as it appeared at the time we contracted with Brightside for this service which was not the agreed upon service for which we contracted Why would we pay another company to basically copy our work into facebook when it would be so easy for us to do so ourselves? We paid Brightside and *** to create something original which they did not
Second, *** claims that we requested a calculator to be in the facebook page which is false We made no such request
Third, *** claims that he explained the situation to us which is false, I had to post complaints on several of ***'s facebook page advertisements before he'd even respond to me, he was ignoring my phone calls, ignoring my voicemails, ignoring my email messages, and ignoring my text messages for several days Only after I made my discontent known on his facebook page did he respond
Fourth, *** claims that he offered to provide a free mobile app to us which is false It was not free, it was to make up for his failure to provide the originally contracted for service/product Why else would he offer a free product if he didn't owe us something? We paid for a service which we did not receive and he attempted to placate our requests by offering a different product because he was unable to provide the first product we paid for ***'s attempt to claim that he went above and beyond the terms of the contract are easily discredited by this assertion of his alone
Fifth, ***'s analogy of his service being like that of an attorney is absurd Attorneys provide a service of work product that has intrinsic value by providing legal expertise to a client in the form of analysis of a legal situation, representation of the client in legal matters, and legal defense of the client or providing legal remedy for situations when some other party violates the client's legal rights in some way *** has not provided any service from which we can benefit, his contract is for a product, not his time invested into providing such product Further, whether or not his contract allows for a refund is immaterial because a legal contract in the United States requires that a product or service is provided for adequate consideration We provided the adequate consideration monetarily but *** and Brightside did not provide the product or service His time invested has no value to us because we have nothing to show for it
Sixth, *** asserts that we requested and required services or products outside the frame of the terms of the contract which is false We only required the products for which we contracted Those products were a company logo which we received, a facebook page which we did not receive, and a commercial video which we did not receive *** then offered a mobile app in lieu of the facebook page and video because he was unable to provide the former ***'s claim that neither he nor his company can be held liable for products for which they were paid to provide is false, they can indeed be held liable and they will be held liable if we cannot resolve this outside of court
Seventh, *** claims we are trying to obtain his product free of charge which is false We have already paid for it
Eighth, *** claims they provided different logo designs which is out of context They did provide multiple designs yes but only because the first of them appeared as though my year old daughter had designed them rather than a graphic designer
Ninth, ***'s link to the facebook page design clearly shows that the page was never completed, the forms field is blank/grayed out and the licensing information at the bottom of the page is cut off severely
Tenth, ***'s link to the mobile app design will show that the mobile app does not work which is the probable reason that it was rejected from the AppStore rather than claiming that it was not secure as he did When you click on the "Calculator" tab it causes your web browser to download an excel spreadsheet that is supposed to be a calculator but the fields are all locked and cannot be altered This app clearly does not work as intended and thus is defective and we refuse to accept a defective product
There are indeed multiple sides to any story but *** has not provided a clear depiction to this situation He has provided no proof of work because what he did provide is clearly defective and not something anybody would willingly pay for Again we are requesting a full refund in the form of a check or money order mailed to the address in Fullerton we provided to Brightside/*** The fact that we've had to resort to using the Revdex.com to resolve this suggests a severe lack of customer service on Brightside's and ***'s part in this situation I highly recommend anyone thinking of working with this company to look elsewhere for your needed services
Regards,
*** ***

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.Business has only proposed the following action:
"From: *** *** - Custom Online Branding
To: *** *** Cc: Date: Thu, Oct 12:51:-0700Subject: Re: Defamation Of CharacterI believe you started this to begin withI never went on a public forum and lied about you and your brand.
Just admit you lied and we can put this to bedI already agreed to allocate the funds multiple timesThe last email I sent was figure out what you want to do and let me knowThe next time I hear from you is a complaint from the Revdex.com saying I wasn't going to honor it.
That's a lie and you know itI have to protect my ESTABLISHED brand and when someone defames my character with lies, you expect me to just let it go? I'm sure when you finally establish your brand, you'll understand why I'm passionate about keeping it from defamation.
I work with some of the biggest leaders in business from around the worldI have no problems from anyone except youYour COO can't seem to understand the value of having your mobile app but she came in months after the work was done and just wants to put it in another product that provides a tenth of the value.
If this is your business plan, I really worry for your brand in the future. "
I can't force you to do anything, but I will defend my brand from liarsJust admit you were lying and I'll put this to bed."
That sounds like extortion, does't it? "Tell them YOU lied and I won't do anything bad".
His responses are disingenuous at best and pure fabrication at the leastYes, he made the offerThe issue is that he has not, after repeated requests, told us what we can expect for our moneyAdditionally, he has threatened us, and in the quote above, is telling us that we should tell you, the Revdex.com, that we lied, and only then will he work with usAt this point, neither my client nor I trust this man to deliver anythingHis threatening approach is far from professionalHis actions reveal a very immature young man who is full of himselfthats fineHe should just refund my client the money since his language and actions show him to be petulant and unpredictableHis inability to simply tell us what we would get and rather offer something that will cost us more without any other information is an old sales tactic to up sell the clientUnacceptableFurther, he threatens to do real damage to the fledgling brand and my reputation online.
Acting on behalf of my client, I repeatedly asked the business owner what we could expect for the disputed amount of $The business never repliedWhen the business did reply it was with the email he attached to his response, telling me not to expect $30,worth of work for the $At no time did I make a demand (other than to communicate) and certainly had no expectations of getting more than the business was paidThe owner took things very personally, threatening to do online damage, calling me a liar and generally impugning my business acumen and abilitiesAs a seasoned professional, I take umbrage to his threats and denigrating language.
After many requests to the business asking what we could expect and receiving no response, I gave the business one last time to respond to the question :what can we expect for the $700.00? Still no responseThen I gave the business a deadline and a consequence to failing to respond in a timely manner, typical business protocol especially when working with recalcitrant vendorsAt that point, it clearly appeared that the business had no intention of honoring their offer.
I told the business that I required an answer by End Of Business or I would be reporting this case to the Revdex.comI received no reply, so I filed this complaint.
My client asked me to include this from him:
"after several malicious email exchanges between *** and I, I have decided I can not and will not conduct business with this man. I have been conciliatory and cordial to the point of appeasing him in every manner possible. I have never dealt with a business or individual that is so anti-customer. I am willing to go away and pretend that our paths have never crossed. He does not exist to me-and I do not exist to him. There will never be any more conversation on the topic if he simply does the right thing and refund my entire pre-paid amount of $714.00. I simply do Not trust him as someone I would have to share business information with. I have bent over backwards to try to work a deal-and now realize the best option for both of us is to go our separate ways."
I am personally offended that this year old thinks he has the right to demand respect after acting in such a disrespectful way, impugning my business acumen and threatening both the company, my partner and I.
Bottom line, we do not think this business can be trusted with any proprietary information, based on his threats and LACK of action, as noted in the many email exchangesWe will not work with him and desire a full refundWe do not want a fightWe just want to end this relationshipMy client even offered a "kill fee" for any inconvenienceBusiness refused. They have gone way beyond the scope of a business interaction*** * *** requests a full refund with the understanding that no on-line degradation, complication, or trashing of the business or the persons behind it take place

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. I never said I would not honor the agreement I offered. This client has no basis for this complaint. She threatens me with legal action which she has no basis for and then I respond with telling her if she wants me to go out of my way to give a client more than what they paid for, then show respect,...

which I guess instead of doing, she files a complaint.  I've attached screenshots as proof of work completed.  My clients are currently paying me up to $3000 for our app project in which I gave her client a substantial discount to allow him to save the rest of his investment for marketing & advertising. She is bold faced lying to say I did not respond to her requests and that I somehow blocked her email. I've yet to hear a response since after this email exchange below that I've copied and pasted:
As for her $30,000 claim, just read below and you'll see how delusional she is sounding.
Here is here email she sent me on Oct 9th 2015:
Hello [redacted]
Per the voicemail I just left you, we are ready to take you up on your offer to reallocate the $700.00 credit still on your books from [redacted] from phone app development to [redacted] commerce development. The page is established and needs to be optimized for e-commerce.
I have written to you before about your offer to shift the credit from one use to another, and after months have passed, I have received no response (although for some reason you asked if you could [redacted] with me).
We are on a very tight time constraint so I will need a response from you before EOB today, Friday October 9, 2015.
Failure to respond will result in my client taking aggressive legal action towards your company to recover the value of the open credit and what your lack of business integrity has cost the company in time and lost revenue.
Before you tell me that you sent us the app, let me remind you that what you sent me was a template. You put no time or effort (except to plug in the name) and its disingenuous to think that you can fool me into thinking that you put any effort into the creation of the app. [redacted] may be new to business, but as you noticed from my [redacted] page, this isn't my first rodeo. To quote [redacted]...right now you are "pissing on my shoes and telling me its raining. I know the difference. And I wear really nice shoes.
We can work with you going forward, as long as you step up here and show us, and by extension, the Latino Business community, that you and your business represents with Pride and Integrity.
You have the power to make the choice that best suits your business' long-term goals. Its all your choice, [redacted].
It is my sincere hope that you choose well, put this discord in the rear view mirror and hit the open road together...

________________________________________________________________________________... /> Here is my response that I sent them that same day:
If you would like for me to go out of my way to extend an offer of crediting the app cost toward another service, please stop discrediting the work I've done. [redacted] paid for a $700 app, do you really think he's going to get $30,000 value for that? The cost he paid went to graphic design, and the ability to use my platform for his mobile app.
If you would like to "put this discord in the rear view mirror and hit the open road together", you might want to show a little respect and not try to threaten me with legal action which you have no basis for. He has a signed contract on what he received, which he did. It's not our fault he brings in a hostile business partner that just thinks she can badger her way to making people do what she wants. I've already outlined what I will do and when you guys can come to an agreement on what you want to do, let me know. Otherwise, stop bugging me with your annoying insults.

Here is the way to preview the app we built them: .
Hi [redacted] & [redacted], here is the preview design of the [redacted] app to test features.
Preview your app by downloading the "Preview Your App" mobile app for your smartphone:
USE ANY OF THE FOLLOWING LINKS TO PREVIEW YOUR APP:
Desktop/Laptop: [redacted]
Apple Smartphone:www.tinyurl.com/[redacted]
Android Smartphone: www.tinyurl.com/[redacted]
Once you have downloaded the mobile app, use the app code to preview your design: [redacted] (no password)
Get in touch with me directly if you have any questions about the preview process.
________________________________________________________________________________... /> As you can obviously see, these graphics were custom made as the client did not create any of these included graphics along with adding in many native app features for the app to have functionality. I've attached screenshots as proof of work completed!

Not sure what design you are referring to but this is the link to the website we have designed:
sans-serif;">
[redacted]
We built you a 16 page website for less than $2000.
You also agreed to a $78 monthly service fee which you have not paid for over a year. Just 1 year of your contractually agreed to service payment of $78 comes to $936.
We can only deliver the work the client asks for. I have no requests on file for design changes from the last delivery made. Reply to this email so whatever changes needed can be done.
As you can see, a lot of work was done on your account and we have never charged you additional or sent you threatening letters to request payment. Once you stop paying your monthly service fee, monthly service stops.
You agreed on page 2 of the service agreement signed on 2-18-13 that if you were not an active client on the monthly service fee that no design work will be done without an hourly rate paid to our design team. Also, no additional live support would be provided as well. It states very clearly that any work needed to be done would be reviewed by our team for a flat rate cost.
I am willing to waive 10 hours of work on your account to complete what you need done. That is the best I can do. We did the work you requested and you are not happy with the design. Your option is to either reply to this email with your requests, or use the design to find another web designer to recreate the site from scratch.

Direct: [redacted]

This is why everything we do is documented. I've attached a chronological outline of conversations with [redacted] via email and text throughout this "journey" with him. As you will see, all work paid for was delivered in a timely fashion. I will respond inline with each of the accusations and you can see the outline for yourself at http://www.brightsideadvertising.com/[redacted].pdf

In that PDF, it will show screenshots of conversations and proof of delivery with the date delivered. Logos were delivered 3 days after payment cleared. Facebook Website design was delivered 9 days later with responses from [redacted] and his laundry list of changes AFTER payment and work delivered. None of these requests were made up front before agreed terms were outlined and the work was started and paid for.

1. Client claims: "the facebook page linked to in [redacted]'s response is basically a snapshot of the company website as it appeared at the time we contracted with Brightside for this service which was not the agreed upon service for which we contracted."
See: http://www.brightsideadvertising.com/[redacted].pdf (no where in the agreement does is state what design requests he is paying for. Nothing is stated on aspect of design other than a single page design. Our normal process is to mimic the design of the website to include within Facebook. Most companies want to keep the branding similar from website to social media. As you can see in the agreement, the aspect of the program is not focused on the design but rather an all inclusive package which included my valuable training and coaching which the client took no part in. He could have easily made multiple times his money back by actually using the product or listening to my advice.)

Client wanted to a have a full scale survey included within Facebook which was not possible because of Facebook SSL requirements. I told him it would need to be basic. I fixed the issue and tried to deliver it to him but he just requested a refund at that point. We do not do multiple revisions, over deliver on logos, and then just give the client all his money back because he cant get what he wants. ( He paid for 1 logo design and as you can see, we delivered 24 HIGH QUALITY logos).

See the work for yourself and determine if his 9 year old daughter creates the same quality. We pride ourselves on our quality and we have dozens of 5 star testimonials that back that up on our website.

"Second, [redacted] claims that we requested a calculator to be in the facebook page which is false.  We made no such request."
See: http://www.brightsideadvertising.com/[redacted].pdf (4-29-14 on page 3)

"Third, [redacted] claims that he explained the situation to us which is false, I had to post complaints on several of [redacted]'s facebook page advertisements before he'd even respond to me, he was ignoring my phone calls, ignoring my voicemails, ignoring my email messages, and ignoring my text messages for several days.  Only after I made my discontent known on his facebook page did he respond."
We have set guidelines on revision requests which are to be emailed to [email protected] which he did not follow. I am the founder & CEO of the company. I am not at the beck and call of any one client 24 hours a day. On multiple occasions, I'd wake up at 7:30am in the morning with 2-3 missed calls and texts from [redacted]. Repeated texts over and over again like I was his recent x-girlfriend or something. I manage hundreds of clients within our brand and the client can't seem to understand the process of web design. He is not our only client and as it states in the agreement he signed, all requests for changes are to be sent to our design team, not the cell phone of the CEO of the company.

Fourth, [redacted] claims that he offered to provide a free mobile app to us which is false.  It was not free, it was to make up for his failure to provide the originally contracted for service/product.  Why else would he offer a free product if he didn't owe us something?  We paid for a service which we did not receive and he attempted to placate our requests by offering a different product because he was unable to provide the first product we paid for.  [redacted]'s attempt to claim that he went above and beyond the terms of the contract are easily discredited by this assertion of his alone.
See: http://www.brightsideadvertising.com/[redacted].pdf
Rather than just ignore the client and move on, I tried to satisfy the client by coming out of pocket myself to create a mobile app for his business. He couldnt grasp that I could not make his Facebook design work with Facebook's new guidelines. We cannot control what Facebook allows to display on it's website. If it is not secure, meaning the hosted application does not start with an HTTPS, then it does NOT display. He cant understand that. We are at no way required to refund him since including the application he asked to add in April 2014. (started contract 1/21/14)
Instead of just letting him stay unhappy, I offered to give him a mobile app in lieu of the Facebook design and commercial (my retail pricing on mobile apps are $997 for the amount of features included). He agreed. I created the mobile app and he never gave me an ok to submit to app stores. We dont submit to app stores without client request. He asked for his contact information to be added which is was and I never heard from him again until this Revdex.com complaint.

Fifth, [redacted]'s analogy of his service being like that of an attorney is absurd.  Attorneys provide a service of work product that has intrinsic value by providing legal expertise to a client in the form of analysis of a legal situation, representation of the client in legal matters, and legal defense of the client or providing legal remedy for situations when some other party violates the client's legal rights in some way.  [redacted] has not provided any service from which we can benefit, his contract is for a product, not his time invested into providing such product.  Further, whether or not his contract allows for a refund is immaterial because a legal contract in the United States requires that a product or service is provided for adequate consideration.  We provided the adequate consideration monetarily but [redacted] and Brightside did not provide the product or service.  His time invested has no value to us because we have nothing to show for it.
See: http://www.brightsideadvertising.com/[redacted].pdf  <-- ALL PROOF OF WORK INCLUDED

Sixth, [redacted] asserts that we requested and required services or products outside the frame of the terms of the contract which is false.  We only required the products for which we contracted.  Those products were a company logo which we received, a facebook page which we did not receive, and a commercial video which we did not receive.  [redacted] then offered a mobile app in lieu of the facebook page and video because he was unable to provide the former.  [redacted]'s claim that neither he nor his company can be held liable for products for which they were paid to provide is false, they can indeed be held liable and they will be held liable if we cannot resolve this outside of court.
See: http://www.brightsideadvertising.com/[redacted].pdf

Seventh, [redacted] claims we are trying to obtain his product free of charge which is false.  We have already paid for it.

You keep requesting a refund. How do you not want it free of charge. You are still using the Logo we made you everywhere online and you can still use anything have delivered. It's all hosted on the web. I did not remove anything online.

Eighth, [redacted] claims they provided 24 different logo designs which is out of context.  They did provide multiple designs yes but only because the first 19 of them appeared as though my 9 year old daughter had designed them rather than a graphic designer.

See: http://www.brightsideadvertising.com/[redacted].pdf  (see for yourself the quality)

Ninth, [redacted]'s link to the facebook page design clearly shows that the page was never completed, the forms field is blank/grayed out and the licensing information at the bottom of the page is cut off severely.

This is to prove how it would look on Facebook with his requests. As you can see, the design doesnt show the lead capture box he wants to include. He doesnt listen.

Tenth, [redacted]'s link to the mobile app design will show that the mobile app does not work which is the probable reason that it was rejected from the AppStore rather than claiming that it was not secure as he did.  When you click on the "Calculator" tab it causes your web browser to download an excel spreadsheet that is supposed to be a calculator but the fields are all locked and cannot be altered.  This app clearly does not work as intended and thus is defective and we refuse to accept a defective product.

1st of all, the mortgage calculator is HIS calculator he wanted included. He wants to have this calculator so bad but all it is, is an excel sheet. Maybe someone can help this guy and explain to him that's not a calculator.

This app was also never submitted to app stores. We need a confirmation of acceptance from client before we submit to live viewing. This is obvious with any business. Rather than give an ok on design, he contacted Revdex.com for a refund when I told him no after he requested another refund shortly after finishing the app. This is why we accuse him of wanting our services for free. We do the work, he wants a refund.

There are indeed multiple sides to any story but [redacted] has not provided a clear depiction to this situation.  He has provided no proof of work because what he did provide is clearly defective and not something anybody would willingly pay for.  Again we are requesting a full refund in the form of a check or money order mailed to the address in Fullerton we provided to Brightside/[redacted].  The fact that we've had to resort to using the Revdex.com to resolve this suggests a severe lack of customer service on Brightside's and [redacted]'s part in this situation.  I highly recommend anyone thinking of working with this company to look elsewhere for your needed services.
See: http://www.brightsideadvertising.com/[redacted].pdf
This is why we document everything we do. We have nothing to hide and everything to show. I can understand his frustration of not getting what he wanted but he should have been more up front with his needs rather than just telling us he wants more clients from Facebook and paying us and agreeing to term. As you can see from the agreement, he didnt even know what kind of video he wanted. It said TBD (to be determined). The only requirements was it was to be a single page design. Nothing else was outlined before we were paid and terms were agreed to.

We delivered everything in order of the way we do things. When a client is not satisfied with a certain aspect of design, we make revisions. We did 3 revisions and then also over delivered on logo design and tried to make client happy as best we could.

No where in the agreement did it state I was to respond to all calls, texts, emails, Facebook posts, private messages, etc. within a 1 hour period like he would like. When clients don't follow what's in writing, things like this happen. All correspondence is to be by email to my design team. Not my cell phone. My team worked hard to try and make this client satisfied. They deserve to get paid for their efforts.

I wonder if in his business if someone got a loan from him, signed the documents, and then decided to change the terms of his loan AFTER all the time and work was delivered, would he be issuing a refund?

My team did the work that was agreed upon, and expressed to him what was not possible on Facebook. There's nothing we can do at that point if the client doesn't listen. We have hundreds of clients that can understand how business is done. This client is just another one who wants it his way but has no understanding of the process.

As we told him before, refer to his agreement. Since this is a public forum, I suggest anyone reading this to refer to what is in writing rather than an opinion of either party:

See: http://www.brightsideadvertising.com/[redacted].pdf

This is an unrelated customer to Brightside. They are through a different company. I will outline what is going on with this client either way. Yes, she paid up front for our services totaling $1680. She paid for a logo design, website design, and app design. The 1st thing to be completed is the...

logo design which we delivered many different examples for her to choose from. She liked many but wanted changes which we obliged. She then sent us a picture of her business card she took from her phone and asked us to incorporate that into her logo.
She signed up with us on 11/18/14 and her 1st delivery of our work was on 11/22/14 with 4 different logo designs to choose from.  On 12/16/14, she decided to respond to our emails and contact saying she was finishing up school for the past month and was now ready to move forward. That email never made it to my inbox as it was sent to spam which I informed her on January 8th when she emailed me again on the 7th looking for an update.
I told her I would have an update to her design shortly but 1 week later she decided to cancel and ask for a full refund of services. Our outlined agreed to terms specifically states we cannot start on any other services outside of logo design until the logo is finished.
She has stated she has contacted us multiple times and we ignore her. That is untrue. I've responded many times sharing with her my difficulties in completing her project without the necessary items we need from her.
Kind of ironic how someone who fails to send us the required information we outlined from day 1, along with ignoring us for a month while she was in school, now asks for a refund because she cant follow instructions.
We just contacted her 2 days ago and asked what we could do to fix the situation. (see attached "proof of contact 2-9-15")
She's not entitled to a refund as we have performed exactly to our agreed upon terms. I'm willing to work with her to resolve it but she needs to stop spreading lies and just call me. I can only work with people who want to be worked with. My team has already been paid and we've put in many hours of work on her project and for her to say we did nothing is very insulting. Thanks for your time in reviewing this matter.

Since this client chooses to continue to lie and twist words into threats, [redacted] has outlined the exact timeline of events from start to finish so we can understand what is actually happening here:
1. February 5th, 2015:
[redacted] contacts [redacted] via email to request his services:
"Hi [redacted],
I just stumbled upon your website.  I have a on-line clothing line targeting the Explosive and ever expanding assimilated Latino market.  [redacted] - as you probably know - is a Spanish/English hybrid term for underwear, that is widely known within, and beyond the South-Western United States.  I am on a shoestring budget, but would like to know how your services can Help me spread my Idea - Far & Wide with as little cost as possible?   Please see my website, and accompanied 1 minute video for your professional opinion and analysis of my ideas.   Please see  [redacted]   for basic idea.  I am designing a new website with a new product offering within in the next 6 weeks.  I need to drive massive traffic to the site, with as little expense as possible.   Is this something you can help me with?
    Thanks,
     [redacted]
                                        ... />      [redacted] responds:
"Have you tried using [redacted] Ads?
One thing I would suggest is a way to build your network that doesnt waste 90% or more of your efforts. Email marketing & social media get about a 5-10% open rate within 24 hours. I'm pioneering a technology right now that lets you grow a mobile network and send an unlimited amount of text messages to that network with a 95% open rate within 90 seconds!
It's perfect for sending promotions, coupons, incentives, new product lines, anything of value you want to share with people who have expressed an interest in your brand.
What kind of budget were you working with so I may be of assistance. There are many ways I can help you bring traffic to your e-store. If you want to talk, reach me at714-[redacted]. You can also browse my website: www.[redacted] It has direct links to my mobile app so you can see the technology for yourself."
[redacted] responds:
"I can start with $1500-2000.  I need to jump start this on my own, and if successful - I have a couple family members who will invest in my ideas.  I have to learn to market this as much as I can on my own, but I know I need help in the beginning.  There are several small internet marketing companies and individuals that like the idea, and believe they could help  me jump start this relatively inexpensively.  I am just not sure how to spend this small budget to get the  most 'Bang for my Buck' .  I have been asked to participate in this years Latin Grammy's gift bag program - so I will be able to get 150 pieces in the hands of nominees and winners of the awards show.  I am just fishing at this point-as I can't afford to make many mistakes."
[redacted] responds:
"I would suggest our mobile app then use [redacted] to drive traffic. We can target the Latino market with specific demographics. I was named "One of the Best" by [redacted] in 2013 when they hit 1 million advertisers.
I can bring my mobile app down from $1497 to only $397 for Android and $397 for Apple.  The rest of your budget we'll put towards ads.
Every 1000 people we reach would cost you around $1-$2 so very cost effective to help grow your network.
Does that seem fair?"

[redacted] responds:
"Ok [redacted] - I think we should talk.  I can go to your office next Friday mid-morning if that works for you.  I think you can see the vision, and I've got many ideas.  I want to do for the Latino Market what [redacted] of [redacted] did with the [redacted].  I'm re-starting on a shoe string-but so be it.  I would rather deal with one of my own and  I can see you got talent.  I'm going for this in middle age -so -failure is not an option."
2. February 13th, 2015:
[redacted] (owner of [redacted]) meets [redacted] directly at his office. Brings dozens of different products with the [redacted] brand on them. T-shirts, pajamas, hats, beanies, etc. Client outlines his vision for his brand, shares his opportunity to display his brand at the Latin Grammy's and proceeds to ask [redacted] how he should develop the brand after telling him he has full confidence in his council. [redacted] shares his technology on mobile marketing and app platform that will help him grow his network, send unlimited FREE text messages, sell his product directly from mobile devices, and inform his network of events, promotions, coupons, incentives, and value with a 95% open rate within 90 seconds.
[redacted], amazed by the opportunity to be able to grow his brand using mobile marketing automation, informs [redacted] he has about $1500-$2000 to put towards this idea and asks [redacted] where he should put the funds for the best return. [redacted]'s mobile app product costs $1497 at the time for the package [redacted] needs but agrees to discount his services heavily to only $714 (close to cost) so [redacted] can keep the remaining funds to put towards marketing & advertising expenses. [redacted] gives [redacted] a check for $714 and [redacted] shares what is needed to start building and developing the mobile app to give [redacted] what he needs to launch his business.
That same day, [redacted] sends [redacted] 6 different emails with content outlining business plan, video, & artwork to get started on the mobile app. The app was then put into production. The cost paid to [redacted] went to graphics designed for the app along with the work completed in building the mobile app. [redacted] built a mobile app for Apple, Android, mobile website, and desktop & laptop version.
3. February 18th 2015:
[redacted] emails [redacted] asking about costs for a website which [redacted] responds with details on what would be needed to get a simple website put together that would run about $1000 in total. Here is the response from [redacted] on that day:
"[redacted]--as I said before - presentation is everything to me - because it will be backed by quality.  I want you to help me brand this in the best light for 'our...and all people-aka-potential customers'.  How many pages do you think is appropriate?  I listened to your interviews on your page-and suffice it to say - I am Very Impressed with you, for being such a young Man. You are the Real Deal. I'm going to put my total trust and confidence in you and your counsel.  I looked and prayed far and wide for the Right person and company to help me-and I Know I found it in [redacted].  Thanks and God Bless You...which he obviously has. We'll meet again in the next 2-3 weeks to discuss."
4. March 9th 2015:
[redacted] emails [redacted] about introducing him to [redacted] and this is what was emailed to [redacted]:"Hey [redacted],
I understand [redacted] called you regarding the mobile app.  I hired her to kinda make sure I'm  taking the right steps-and for help in the Latin Grammy's [redacted]products to go in the bag .  We'll she got back to me and said 'she was impressed with you and your ideas'.  I knew she would be - because I was impressed with you.  So - I'm gonna need a website done soon.  Can you build a cool and easily navigable WS that Pops?  I want to stay consistent on the whole presentation -so my thinking is to just let you do it.  Help me Kick As on this [redacted]-and who knows what good things the future holds. - [redacted]"
5. June 12th 2015:
[redacted] calls [redacted] and informs him of "great news" which consisted of refunding 100% of the $714 paid to [redacted] for building the mobile app and holding the price [redacted] paid for 1 year should he decide to keep the app at a later date. [redacted] informed [redacted] that there is a strict no refund policy on work completed. [redacted] then offered to allocate the $714 paid toward a different service that [redacted] provides. Which could be a video commercial, [redacted] Sales Funnel, or website design. [redacted] then explains why the mobile app will be the best tool for their business at it combines everything they are doing online in 1 place and allows communication at 95% open rates within 90 seconds. None of his other products offer that. [redacted] then asks to see the app as she has not even looked at what was put together by [redacted] for the [redacted] brand. This is the email that was then sent to [redacted] on June 12th:
"Hi [redacted] & [redacted], here is the preview design of the[redacted]app to test features.

[redacted], as far as your request for a refund, unfortunately, that cannot happen. Like we discussed, I am able to offer a credit of the cost towards another service if need be, which I don't think you should since the app is the most powerful tool he can have for his business today.
Your offer of a refund and to hold the pricing for a year is not something I would consider "good news" by what we've setup for [redacted]. Being that [redacted] knows we discounted our app pricing heavily to bring him on initially.
He told me his total budget, and I didn't want him to commit everything he had to this technology so I brought him in at just over cost.
As someone of your caliber, [redacted], I'm sure you researched our site and saw the cost of getting our app is a lot higher than what [redacted] has paid us.
Unfortunately, everyone who worked on the account has already been paid and I can't ask them to work for free.
When we met with [redacted], he gave us a total breakdown of how he wanted the business to be branded. I was notified of your involvement with the brand officially on May 8th, far after we got everything put together and the work was done on his account.
As you can see from the attachment, we've been working on his stuff since February so to come in 3 months after the fact, then ask for a refund because you decided to re-brand him, unfortunately, that's not my doing and you'll have to bite the bullet on that one.
Like I've said since day 1, I can help him get this off the ground in any means we can provide. I just can't force my team to not get paid for the work that's already been done.
Look forward to hearing from you soon."
[redacted] then proceeds to say they do not need it and requests a refund again but that we can keep $100 for the work we did. Here is [redacted]'s response:
"As I've mentioned numerous times, any refund will be in the form of credit towards another service. Everything we received from [redacted] when we started gave us the impression you had a business model tied down.
Now that you've come into the picture and changed everything, the best we can do is update to the branding you wish to have. We cannot refund over 80% of the cost because you came on board and want to revamp the entire brand.
When [redacted] came to us, he was very specific on how he wanted to proceed which we followed. Coming in 3 months after is out of my control and not my issue to take the loss on. I'm sure you understand.
By the way, we don't build templates. We build apps. :)"
Then the response is to let [redacted] keep $214 of the $714 paid and refund $500. Here is the response by [redacted] on June 15th:
"Here's the thing [redacted]. You came into my office with tons of product. You then sent me 6 separate emails on Feb 13th with multiple streams of content including your "Biz-Plan-Pt.1" that outlined where you saw your business heading.
You provided more content than most of my clients who come on board so to say you didn't have a business plan in place is kind of misleading.
You then sent me this email on the 18th:
Then on March 9th, I received this after many back and forth conversations about starting an ADDITIONAL project on top of the app:
"Hey [redacted],
I understand [redacted] called you regarding the mobile app. - [redacted] "
30% of the balance paid doesn't even cover the cost of production. Like I've said many times, we discounted our retail pricing heavily in the hopes of working with a brand I liked and knowing the $49 monthly fee would offset the lost revenue in the long run.
I believed in you, you believed in me. Seems that [redacted] got in the middle and now everything's changed.
If anyone needs to come out of pocket to fix your situation, it's her. I'm not going to refund any amount, as the initial design has been completed and everyone who worked on your account has already been paid.
Even a 10% refund would put me in the red. I discounted my app to basically cost to bring you on board as a client. I gave you the best deal you could get from my company since you were working directly with me and not one of my agents.
You'll just need to wait until you see value in this technology I guess so we can move forward. Other than that, you're app is ready for submission or revisions. But no refunds will be given. That's final.
June 15th that same day, [redacted] replies asking to see what the app can do and wants to review the preview link that was put together again. [redacted] resends the link and after review, here is what [redacted] responds with on June 15th:
"Ok [redacted].  I'll keep the app.  I am just not going to be able to activate  right now.  So - is that good?  Sorry about [redacted] and you not hitting it off.  I have decided to put some resources into the Brand Architecture.  I need to determine Exactly what the brand stands for. I got to get this part right.  With the app - I put the cart before the horse - unless you can convince me otherwise. Here's a hypothetical situation:  If I was to start a 'crowdfunding reward campaign'  - how would your services help drive potential crowd funders to my page?"
[redacted]'s response a couple minutes later:
"I could help in that. We got one of our apps funded that way.
Use a service like [redacted] and you can start generating donations today![redacted]'s response that same day:"Ok -- My gut says you could probably deliver. I hired [redacted] to help me develop the Brand.  She has many years in building new apparel brands.  She Knows what she is doing - believe me.  I'm too old to [redacted] this up now, she sees the promise of [redacted] and has also reduced her rates to help me out.  I'm going to go thru my meager budget soon-so I have no choice but to attempt a crowdfunding campaign.  I have good products for rewards - once they get it in there hands.Ok--so give me an idea of the costs to do this.  If you were me on a limited budget - how & what  you do it?  If I get some quantifiable traction - I want to bring in investors - even the right equity partners when the time is right.  How I can do this on the relative cheap?"

[redacted]'s response:
"Crowd funding doesn't cost anything. Just setup the page for free and invite people.  Go to [redacted] and sign up. Fill in the blanks and send me the link once you've done it. I'll review it to give it tweeks to start promoting.
I can push it to my network since you're my client."
[redacted]'s response:
"Ok--I see.  Would buying targeted fb ads - also be a way-or is that prohibited to solicit crowdfunding on fb?  I want to do this  so I could attend The Latin Grammy's gift-program in LV in person this fall.  It's 5 grand(sponsorship fee) plus 350 pieces of product-and 3 days of expenses - so about 10 grand to be on site, scmooze with the celebs, and even place any photographs taken in the website. I'm doing 6 designs of capz right now, and a custom [redacted]/short.  I work full time - so I do my best to juggle my time.  Put that app on hold for now. So no harm - no foul."
[redacted]'s response:
"Don't do ads. Find networks that will share your cause for free. I'll make some calls once it's all setup. I've got a big network to tap into. "
[redacted]'s response:
"Ok  - sounds good.  I'll let you know when I'm ready.  Thanks"
At that point, [redacted] put [redacted]'s account on hold until he heard from them on what they want to do next.
6. October 8th 2015:
[redacted] starts sending [redacted] requests for allocating the funds towards an e-Commerce [redacted] Funnel and sending additional content via email. Then the 9th, [redacted] sends this email to [redacted] directly:
"Hello [redacted]
Per the voicemail I just left you, we are ready to take you up on your offer to reallocate the $700.00 credit still on your books from [redacted], from phone app development to [redacted] commerce development.
[redacted]santa fe, nm
usa
[redacted]'s response:
"If you would like for me to go out of my way to extend an offer of crediting the app cost toward another service, please stop discrediting the work I've done.
Otherwise, stop bugging me with your annoying insults."
After sending this email response, [redacted] didn't hear anything back until this Revdex.com complaint was filed, saying [redacted] stole their money, ignored their requests for a refund, blocked their emails, and acted like a "thug" as they described. As you can see above, [redacted] has only asked to be treated with respect if they want him to go out of his way to do something that is not in his written and agreed to contract. Instead of acting professionally, [redacted] threatens [redacted] with legal action if he doesn't respond by end of business day bowing to her commands. Then, when [redacted] agrees to honor a special offer he gave months ago which [redacted] already declined to accept by saying he would keep the app, she decides to try and defame his character and lie about the way the conversation happened. All communications are documented and as you can see, [redacted] has been nothing but accommodating to the needs of this very irrational client.
Now she wants to say that [redacted] is threatening them? All he is doing his protecting his brand from defamation and said he would file a cease and desist if they should continue to spread lies about the way [redacted] conducts business. [redacted] did not go to a public forum and try to shame the [redacted] brand. [redacted] and [redacted] were the ones who decided to take their disagreements to a public forum and try to paint [redacted] in a way that he obviously is not a part of. The proof of work was delivered in a previous response along with many emails of the correspondence back and forth.
This is the email [redacted] sent directly to [redacted] once he was informed of the Revdex.com complaint filed against him:"I would really look into what your hired "professional" is saying about me in a public forum. [redacted] is blatantly lying about me and my company saying that I am not honoring my side of my agreement and that I did no work, no effort, blocked her email, etc.
She has also lied about her request for a credit toward services. I offered that as a remedy to what she thought brought no value to your company since we cannot offer a refund on work completed.
Her offer was a refund and to hold the pricing for a year while you guys figured out how to position the brand. She is lying a very high degree which is going to put your company and self a very bad position.
I have many emails from you saying you are going to keep the app (June 15th) after [redacted] asked for a refund (June 12th) and that you are going to "put it on hold" and will let me know when you are ready to proceed.
I have already contacted my attorney since she decided to put these lies into a public forum which cannot be removed. I have an appointment with him later today to discuss all available options.
I'm really disappointed that it has come to this point but since you have authorized her to speak on your behalf, you are going to be liable just as much as she is. I have everything in writing from start to finish so she really needs to check her verbiage on what she has accused me of.
I'd suggest getting in touch with her and finding a remedy to this situation very quickly. I've been nothing but helpful and a resource for you throughout our relationship and since you brought on this lady, she has brought nothing but problems.
Look forward to hearing from you very soon. Reply to this email with any questions."
As you can see, [redacted] is very professional in his response and just wanted some clear answers on why [redacted] went to a public forum and lied about [redacted]'s actions. Should they want to respond, please respond with facts, as [redacted] has.  Attached you will find the entire conversation in writing from June 12th on when the request for refund was made along with [redacted] saying he will keep the app and he will let me [redacted] know once he is ready to move forward with it.  You will also find attached the conversation from Friday, Oct 9th in which [redacted] responds to [redacted]'s threats and receives no response. And lastly, you'll find attached the entire conversation from October 15th where [redacted] explains the Defamation of Character he is going to pursue should [redacted] & [redacted] not admit they lied. Should you need anymore hard evidence, please advise.
I'll consider this case closed until further notice.

I'm quite confused at this complaint. It holds little merit. We DID complete the logo, We DID complete the Facebook design, and client was not happy with design since he wanted to include a mortgage calculator (which was not secure, which means it was not allowed to be displayed on...

Facebook)

Client took that as a failure to render service and asked for a refund. I explained to the client the situation and I offered him to create him a mobile app for his company, which I did! All proof of work links are provided in this response.

Our mobile app platform alone costs $997, which is what we charge to new clients based on how many features he received in his app. I guess his choice is to not continue with what he agreed to, which is fine, but like our agreement states, he is paying our company for the time invested in design and creation of his custom designed products, which we completed over $2000 worth of work on his account, and didnt charge him $1 more from what his initial investment was.

We have a strict no refund policy on the time and effort done on our part. To put this into context, does a lawyer have to refund his client if his client lost their case or was unhappy with the result of the case? No. He knew upfront what his costs were and that it included any amount of revisions necessary to make him happy. We make it VERY CLEAR!

We cannot be held liable for clients who want to work outside the frame of their agreed terms. He did not pay for the $997 mobile app we created for him, we provided that free of charge in lieu of his Facebook design which he no longer wanted. Now he wants a full refund?

Looks like another case of a client that cannot appreciate the time and effort done by a custom branding agency and thinks that he can get our work delivered to him free of charge. Sorry buddy, it doesnt work that way.

PROOF OF WORK:

Logo design: (Client already said that was provided and he is satisfied) (again we went over budget on this by providing him with a total of 24 different logo designs to try and satisfy this difficult client. He only paid for a total of 5 different styles. Again, we did NOT charge the client additional, even though we should have)

Facebook Website: (client was unhappy with all revisions, even though this is all we had to work with as far as content: http://uwlonline.com/
http://brightsideadvertising.com/designs/united.html

Mobile App Design: (this was given to the client free of charge, which client FAILED to even mention is his complaint)
http://uwl.4yourmobile.com

So as you can see, there is 2 sides to this story. Thanks for taking the time to review this.

Review: Mr. [redacted] sold my client a product he did not need. When said client came to that realization I was asked to interface with Mr. [redacted] and request a refund. He declined the request. I asked if we could redirect the payment he had in his possession and he agreed, then declined saying that he never made that offer, which we have in writing. He then wrote me an email saying that he wasn't going to give us $30,000 worth of services for what he owed me. We only have been requesting either a refund or to re-direct that amount to building a [redacted] page. Given that the ** page is already in place, that $700.00 should go a long way.Mr [redacted] then decided that he wasn't going to honor that $700.00 agreement, then stopped all communication with both my client and I sent me a rather arrogant accusatory email and blocked my email addresses so I could not respond. We both asked him to do the right thing and he declined. He is still in possession of the $700.00, refusing all communication. That is called stealing in my book. My client and I gave him options if he wanted to keep the money and he has decided that he will not do any work for us and will not refund the money. He did send us a template of the app after we made a fuss. Having been a project manager, content writer/editor, art director for web builds I can't tell that its an app template. He put zero time and effort, did not deliver any product and is keeping our $700.00. Unacceptable. He acts like a thug not a pro.Desired Settlement: just give us back the money. he didn't deliver anything and is unwilling to honor his own offer to work with us on our ** page. Neither of us has the faith or confidence that even if he says he's going to do the ** page, he will, and he's end up ripping us off for even more money.Just the refund. Thats all.

Response:

I never said I would not honor the agreement I offered. This client has no basis for this complaint. She threatens me with legal action which she has no basis for and then I respond with telling her if she wants me to go out of my way to give a client more than what they paid for, then show respect, which I guess instead of doing, she files a complaint.

Review: On February 5th, 2014 I paid $785.52 to [redacted] and Brightside Advertising for a logo design, a Facebook page design, and production of a video commercial. To date, May 29th of 2014 I have only received the logo, not the video commercial nor the Facebook page. The company proprietor, [redacted], will not take my calls, will not answer my voicemails, text messages, nor emails, and on May 13th of 2014 [redacted] stated that the contract did not allow for refunds implying he was not willing to refund my money.Desired Settlement: I would like a full refund including the cost of the logo design because [redacted] of Brightside Advertising has caused me undue stress.

I'm quite confused at this complaint. It holds little merit. We DID complete the logo, We DID complete the Facebook design, and client was not happy with design since he wanted to include a mortgage calculator (which was not secure, which means it was not allowed to be displayed on Facebook)

Review: On November 18, 2014 I paid [redacted] at Brightside to build a website, mobile apps and an introduction video for my business. Today is February 7th, 2015 and I have not received the product and services I paid for in the amount of $1680.30. He requested payment up front, but has not delivered on his promised work.

He has given me excuses that he has not worked on my project as he has a sick child.

He no longer will respond to my texts, emails requesting a full refund on my purchase.Desired Settlement: I would like a full refund in the amount of $1680.30 posted back to my credit card

Business

Response:

This is an unrelated customer to Brightside. They are through a different company. I will outline what is going on with this client either way. Yes, she paid up front for our services totaling $1680. She paid for a logo design, website design, and app design. The 1st thing to be completed is the logo design which we delivered many different examples for her to choose from. She liked many but wanted changes which we obliged. She then sent us a picture of her business card she took from her phone and asked us to incorporate that into her logo.

Review: In May 2013 I contracted with Mr. [redacted] owner of Brightside Advertising to create for a website for my company [redacted] Inc. I paid an initial deposit of $600 and through December 2013 paid the balance of $900. The contract was for a website and to have branding services for my Facebook page and Twitter account. I initial was shown a draft website and this was available through Jan of 2014. Once I paid the balance in Dec 2013 I no longer heard from Mr. [redacted]. My last response from him was in March of 2014 via text stating his server had been sabotaged and that he would get back in contact with me soon. To date he has not contacted me despite my numerous attempts to reach out to him. Yet he still continues to advertise this business and several online branding businesses. I would like to reach a resolution a part from court but I do not believe this is going to be possible. He website no longer list a street address to deliver a certified letter to him requesting payment.Desired Settlement: I would like a full refund of the money I paid to Mr. [redacted] of $1500 as soon as possible.
