I am rejecting this response because:In response to Brimfield Concrete, #Brimfield concrete was whom the contract was signed withThere were no contracts made for subcontractors Brimfield concrete did not offer to excavate the patio and replace with proper depth of concrete pour and also the subpar unacceptable surface finishing and cracks and peeling of brand new patioThe only way to fix this is to excavate it out and start overAnything otherwise is unacceptable for a new pour patioThis company needs to step up to the plate and accept responsibilityThey subcontracted the work to an inexperienced unprofessional unknown to me person who made a horrific mess of my yard, killed a large evergreen and ruined my lawn strewn gravel all over , broke Spinklers heads which I paid $out of my own pocketThey never cleaned up the mess or replaced the tree or grass! This had been dragged out over the entire summerBrimfield demanded more money before they would fix my patio which they wanted to cut a foot off all around the entire perimeter of the newly poured solid surface concrete and re pour the concrete around the edgesThis would not be acceptable to anyone in their right mindI did not pay for a bandaid patio! Also the issue of multiple surface and color differences inconsistent throughout the entire patio! I would be glad to supply pictures of this mess! They were given more than ample time to fix this patio and failed to step up to the plate The city inspector merely approved the forms that were set for the pourThe inspector was called out after the pour and I can produce affidavits that this was not the correct thickness of pour and the surface was unacceptable per the city of Aurora Inspector who is an engineerThe city does not control how Brimfield Concrete does their work , pouring the correct depth of concrete and working it and finishing the surface appropriatelyThis company was trying to cut costs by not pouring the correct depth of concrete , used subpar materials probably cheaper and didn't do the job! Lastly, the steps were an entirely different color without stamping and were crooked to the patioAgain to fix this it must be excavated out This company deserves the worst rating and continues to lie and argue about their wrong! They need to just do the right thing I had not been able to use my patio all summerI feel as a female I was taken advantage ofI tried to be fair but in light of all that has happened this is beyond the point of me fixing itThe have a duty and have failed to live up to their contractDoNot Give .This Company a good rating!!!! Sincerely, [redacted]

Business owner left voicemail that he is sending a response by mail to Revdex.comThe consumer did not accept the business' offer for resolution He has filed a Small Claims suit against the business, so the matter is in litigation

In our continuing ongoing efforts to satisfy all of our customers, Brimfield Concrete has reached an agreement with the subcontractor to perform a complete tear out and replacement of [redacted] 's patio and steps as well as repair any disturbed landscapingThis agreement is contingent upon Ms [redacted] 's outstanding balance, per the contract, to be placed in an escrow account payable to Brimfield Concrete upon completion of the new patio/steps replacementDue to winter approaching and the changing weather, the tear out would take place within days upon acceptance of this offer, weather permitting, and the new patio/steps installation would take place in early Spring as the weather allows

I am rejecting this response because:
The concrete pour was not the depth contractedThe sides of the pour were irregular and the cement not worked down properlyThe surface finish was not uniform nor was the colorThe steps were not finished stamped as they were to be done and the color was the wrong color on the stepsThe contractor is responsible himself for the job not the subcontractorI did not sign a contract allowing subcontracting or with this other named personThe whole job was a botched job!His subcontractors wanted to cut one foot off my concrete poured stamped patio all the way around and repour only that portion? Now that would not look right nor am I paying for a dog and pony show job who in their right mind would agree to this or give this guy any more of their moneyHe took advantage of me! He tore up my yard and lawn in the back broke my sprinkler heads and killed a foot evergreen roughly another $in damages to my yard and loss of use of my back yard and patio the entire summerNo there was no sanely offer for any replacement of the damages to my yard or the bad cement pour job or the lack of the correct depthBrimfield concrete had no intention on fixing this mess that was createdThe only way to fix this is to rip it out costing Brimfield Concrete time and money and he blew me off the entire time after it was pouredThis company is a fly by night group with no ethical standardsI will do whatever to make sure nobody else is taken advantage of especially womenIf you call exposing the thief a threat than add that to the list of problems with the jobYou can not communicate with this company.I am insulted by his response when he knows he has done wrongI have pictures to prove the bad job for anyone who would like to see his work I would like him to post these on his website if this is what he calls a proper jobYes I'm Angry and frustrated with this company who wouldn't beThe inspector for Aurora city and *** *** both are witnesses to the bad pour and finish jobThe inspector himself came out afterwards and said this was incorrect and not done correctlyThe finish is several different colors peeeling and hazed now The concrete has cracked and sagged in a large portion and the slope is inconsistent

I am rejecting this response because:I need to have documentation that the subcontractor that was at my house who was incompetent will not be doing the job. I had my yard tore up all summer and had to have it repaired asthetically due to the homeowners association and my neighbors. I will need to be financially compensated for yard repairs and tree and sprinkler head replacement and clean up of debris.    The yard is too wet to have work done on it in the winter. This project would need to be done in the spring when the ground is dry and hard and fully completed within 5 days. Upon completion, pavers present will need to be reset at the cost of Brimfield concrete. Upon completion of the entire project and reimbursement for yard , tree and Spinklers damage by Brimfield Concrete and inspection by inspector after job is done to appropriate standards of a newly poured stamped concrete patio with proper products and cement used according to set standards. The yard must be left in pristine condition with no damage to grass , trees or sprinklers or house or downspouts. At this time, the remainder of due fees will be paid. The homeowner has acted in good faith with deposit and has no reason to put money in an account for holding. It has been Brimfield Conrete who should be held to standard for loss of use of the clients yard and for aggravation and loss of time and wages disputing this poor cement job. Owner of Brimfield Concrete will be present during work to assure proper production of job as contracted.            [redacted]

The business owner informed Revdex.com that the matter was decided in...

the [redacted] Municipal Court in [redacted] County, OH.  The court judged in favor of the Brimfield Concrete in the amount of $1,438.55, plus court costs and statutory interest at the rate of 4% per annum for the date of judgement.

Business owner left voicemail that he is sending a response by mail to Revdex.com. The consumer did not accept the business' offer for resolution.  He has filed a Small Claims suit against the business, so the matter is in litigation.

performed and did pass inspection. The owner of Brimfield Concrete fielded complaint calls from homeowner and relayed all concerns to [redacted], owner of [redacted], LLC. Upon homeowner not receiving satisfaction from [redacted], LLC, owner of Brimfield Concrete arranged a meeting between himself, [redacted], Owner of [redacted], LLC, and the homeowner. The meeting took place right on the patio in question at the homeowner's residence. All issues were discussed at that time and several different proposals were subsequently offered to correct any concerns including removing and replacing a portion of the concrete areas of concern. The homeowner agreed to one of the proposals but then stated that she WAS NOT GOING TO PAY THE BALANCE DUE OF $4,350,00, after the problem was corrected. The homeowner took this position and would not act in a reasonable manner but rather felt that she deserved this discount. Brimfield Concrete made every effort to satisfy this customer but only received being cussed at, threatened with "...the people I know...", further saying that she would drive us out of business if her demand for fixing the issues, while not having to pay the balance she owed, were not met. [redacted], Owner of [redacted], LLC refused to perform any further work based on her absurd demand. Brimfield Concrete also refused any further dealings with this homeowner. For the record, we will NOT give half-priced concrete jobs to anyone because a homeowner threatens us with filing a complaint or because the people in power that they know.

I am rejecting this response because:In response to Brimfield Concrete,      #1. Brimfield concrete was whom the contract was signed with. There were no contracts made for subcontractors.        2. Brimfield concrete did not offer to excavate the patio and replace with proper depth of concrete pour and also the subpar unacceptable surface finishing and cracks and peeling of brand new patio. The only way to fix this is to excavate it out and start over. Anything otherwise is unacceptable for a new pour patio. This company needs to step up to the plate and accept responsibility. They subcontracted the work to an inexperienced unprofessional unknown to me person who made a horrific mess of my yard, killed a large evergreen and ruined my lawn strewn gravel all over , broke Spinklers heads which I paid $150 out of my own pocket. They never cleaned up the mess or replaced the tree or grass! This had been dragged out over the entire summer. Brimfield demanded more money before they would fix my patio which they wanted to cut a foot off all around the entire perimeter of the newly poured solid surface concrete and re pour the concrete around the edges. This would not be acceptable to anyone in their right mind. I did not pay for a bandaid patio! Also the issue of multiple surface and color differences inconsistent throughout the entire patio! I would be glad to supply pictures of this mess!       3. They were given more than ample time to fix this patio and failed to step up to the plate.         4. The city inspector merely approved the forms that were set for the pour. The inspector was called out after the pour and I can produce affidavits that this was not the correct thickness of pour and the surface was unacceptable per the city of Aurora Inspector who is an engineer. The city does not control how Brimfield Concrete does their work , pouring the correct depth of concrete and working it and finishing the surface appropriately. This company was trying to cut costs by not pouring the correct depth of concrete , used subpar materials probably cheaper and didn't do the job!          5. Lastly, the steps were an entirely different color without stamping and were crooked to the patio. Again to fix this it must be excavated out.             This company deserves the worst rating and continues to lie and argue about their wrong! They need to just do the right thing . I had not been able to use my patio all summer. I feel as a female I was taken advantage of. I tried to be fair but in light of all that has happened this is beyond the point of me fixing it. The have a duty and have failed to live up to their contract. Do. Not . Give  .This Company a good rating!!!!                                      Sincerely, [redacted]

The patio job was inspected by a city inspector to ensure proper base and depth prior to pouring any concrete. The city inspector APPROVED the job to be poured. While some concrete along some of the edges stuck to the forms, it was offered to cut the entire edge section all the way around the patio out and re-pour it. As far as color and sealer goes, it was offered numerous times to completely strip the sealer from the entire patio, re-teak the entire patio, and then re-seal the entire patio. The disturbed areas of the yard were offered to be repaired but let it be known that the homeowner had told us to back the truck through her yard when delivering the necessary gravel for the patio base. The homeowner was specifically told that, due to the elevation of the patio she requested, that soil, seed, and a straw mat would need to be installed RIGHT AWAY to prevent the base from washing out from under her patio. This necessary step was not followed by the homeowner. Now, the erosion of the elevated base along the edges is causing her problems. As stated before, numerous offers were made to correct and problems and the homeowner agreed to a course of action but then stated very profoundly that she would not pay her balance of over $4,000.00 once completed. This is neither reasonable nor acceptable.
